AN ORDINANCE AUTHORIZING THE EXECUTION OF CONTRACT FOR THE INPROVENENT OF NORTH CALHOUN STREET AND SUNDRY OTHER STREETS AND AVENUES IN THE CITY OF FORT WORTH; WING APPROPRIATION FOR THE INDEBTED- NESS INCURRED THEREBY; AND DIRECTING THE CITY EN- GINEER TO PREPA$E ESTI1LATES. WHEREAS, on the 30th day of January, 1946, by ordinance passed and approved by the City Council of the City of Fort Worth, being Ordinance No. 2288, the City determined the necessity for the improvement of the portions of streets and avenues therein described; and, WHEREAS, on the 20th day of February, 1946, by ordinance passed and approved by the City Council, being Ordinance No. 2296, the City determined the necessity for, and ordered and provided for the improvement of the por- tions of streets therein described; and, WHEREAS, subsequent to the passage and approval of said ordinances, plans and specifications for said improvements were submitted by the City Engineer and said plans and specifications were approved by the City Coun- cil; and, WHEREAS, notice to bidders was given as required by the City Charter; and, WHEREAS, the bid of Austin Road Company, a corporation, was found to be the lowest and best bid for the making and construction of said im- provements, to wit, raising, grading and filling same; constructing con- crete curbs and gutters where adequate curbs and gutters are not now in- stalled on proper grade and line, by paving with reinforced concrete pave- ment, together with incidentals' and appurtenances, including drains where necessary, all as provided by said plans and specifications; NOW, THERE- FORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS; SECTION 1. That the work of making and constructing such improvements and con- tract therefor is hereby let to Austin Road Company, a corporation, which said contract is dated the ; day of May, 1946, and is on file with the City and executed by Austin Road Company, and the Mayor and City Secretary are hereby directed to execute the said contract in the name of the City of Fort Worth, Texas, and to impress the corporate seal of the City there- on, the said contract embracing therein, among other things, the prices for the work. SECTION 2. That to provide for the payment of the indebtedness incurred by the City of Fort Worth by said contract, there is hereby appropriated out of available funds which have been set aside for said purpose, an amount sufficient to pay said indebtedness so incurred. SECTION 3. That the City Engineer of the City of Fort Worth be and he is here- by ordered and directed to file with the City Council estimates of the cost of such improvements in each unit in accordance with the terms of the powers and provisions of Chapter 106 of the Acts of the First Called Session of the Fortieth Legislature of the State of Texas, now shown as Article 1105b of Vernon's Civil Statutes of the State of Texas, Annotated, which law has been adopted as an amendment to and made a part of the Charter of the City of Fort forth.
