AN ORDINANCE ORDE UNG A SPECIAL H0ME-RULE ELECTION IN THE
CITY OF FORT WORTH, TEXAS, TO BE HELD ON SATURDAY, THE
7TH DAY OF NOVEMBER, 1953, FOR THE PURPOSE OF SUBMITTING
TO THE gUALIFIED VOTERS OF SAID CITY, FOR ADOPTION OR RE-
JECTION, PROPOSED AMENDMENTS TO THE EXISTING CHARTER OF
THE CITY OF FORT WORTH, INCLUDING IN SAID PROPOSED AMM-
MENTS WORKING CONDITIONS AND OVER-TIME PAYMENT TO MEMBERS
OF THE FIRE DEPARTMENT, THE CREATION OF BOARDS FOR THE
ADMINISTRATION OF THE CHILDREN'S MUSEUM AND ART MUSEUM,
PROVIDING FOR AN ANNUAL AD VALOREM TAX OF TWO CENTS (20)
ON THE ONE HUNDRED DOLLARS ($100.00) OF ASSESSED VALUE OF
ALL REAL AND PERSONAL PROPERTY IN THE CITY OF FORT WORTH
NOT EXEMPT FROM TAXATION FOR THE USE AND BENEFIT OF THE
CHILDREN'S MUSEUM AND ART MUSEUM, RESPECTIVELY, AND THE
REPEAL OF SECTION 23, CHAPTER XXVIII OF THE CHARTER OF
THE CITY OF FORT WORTH WHICH PROVIDES A TAB LIMIT OF ONE
AND 90/100 DOLLARS ($1.90) ON EACH ONE HUNDRED DOLLARS
($100.00) VALUATION OF TAXABLE PROPERTY SITUATED WITHIN THE
LIMITS OF THE CITY; DESIGNATING THE PLACES AT WHICH SAID
ELECTION IS TO BE HELD; APPOINTING PRESIDING OFFICERS THEREOF;
AND DECLARING AN EMERGENCY.
WHEREAS, on Wednesday, the 26th day of August, 1953, an ordinance
was duly passed by the City Council of the City of Fort Worth, Texas,
giving due notice, in strict compliance with the statutes of the State
of Texas and the Charter of the City of Fort Worth, Texas, of ids inten-
tion to pass an ordinance providing for the submssion to the qualified
voters of the said City of Fort Worth of proposed amendments to the
existing Charter; and,
WHEREAS notice of intention to submit such chanter amendments was
,
duly given by publication in the Fort Worth Star-Telegram, a newspaper pub-
lished daily in the City of Fort Worth and the official newspaper of said
City, which notice was published for ten (10) days, the date of the first
publication thereof being not less than twenty (20) days next preceding the
date of this ordinance; and,
WHEREAS, the City Council of the City of Fort Worth, in the exercise
of the discretion reposed in it by the Constitution and the laws of this
State relating to.the amendment of city charters by cities having more than
five thousand (5,000) inhabitants, deems it wise and expedient to submit
the proposed amendments of the existing Charter of said City hereinafter
set forth at a special election to be held in said City on Saturday, the
7th day of November, 1953; and,

WHEREAS, it appears that no regular municipal election Will
be held in said City within the time specified in Article 1166 of the
Revised Civil Statutes after the passage of this ordinance; NOW THERF,FORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION le
That a special election be held in the_City of Fort Worth, Texas,
on Saturday, the 7th day of November, 1953, for the purpose of submitting
to the qualified voters of said City, for adoption or rejection, the
following proposed amendments to the existing Charter of the City of Fort
Worth:

SECTION 2.
That the polling places and the presiding officers of said election
shall be,respecti'vely, as follows:
AMENDMENT I
Shall Chapter XUIII of the Charter of the City of Fort Worth
be amended by adding thereto Section 5a, reading as follows:
All members of the Fort Worth Fire Department engaged in Fire
Fighting or in the supression of Fire shall not be required to work
more than sixty (60) hours in any one week or more than one hundred
and twenty (120) hours in any two week period, this shall include all
apprentice Firemen, Firemen lst Class, Drivers, Lieutenant, Captains,
District Chiefs, and Senior District Chiefs, or any member of the
Department who shall ever work in any of these capacities. The mem-
bers of the Fire Department in these ranks or positions shall continue
to work in shifts or tours of duty in the same manner as at present,
which shall be 24 hours on duty and 24 hours off duty. Shifts shall
be changed at 12 o'clock noon of each day, with the members of these
respective divisions of the Fire Department divided into two (2) equal
shifts, except that there shall be designated by the Chief of the Fire
Department or any Fire Department Officer, whom the Chief might desig-
nate, one (1) twenty-four (24) hour tour of duty in each week, which
would ordinarily be a regular or normal tour of duty, at which time
each such Fireman shall not be required to work, thereby amounting to
a maximum of sixty (60) hours in any one week or one hundred and twenty
(120) hours in any two-week period.
All other members of the Fire Department shall not he required to
work more than forty (40) hours in any one week or more than eighty (80)
hours in any two week period. This shall include all Assistant Chiefs,
Fire Marshals, assistant Fire Marshals, Chief Drill Instructors, As-
sistant Drill Instructors, Fire Inspsators, Executive Officers, Chief Fire
Alarm Operators, Fire Alarm Operators, Custodians of Mechanical Equip-
ment, Mechanics, Secretaries to the Chief, Fire Prevention Secretaries,
and Secretaries to the assistant Chief, or any member of the Fire Depart-
ment who shall ever work in any of these or other administrative capacities.
The provisions of this amendment shall not prevent the Chief of the
Fire Department or any Officer of the Fire Department, whom the Chief
might designate, from requiring any member of the Fire Department to work
hours in excess of the maximum hours prescribed by the provisions of this '
amendment, or to be present at meetings called by the Chief of the Fire
Department or any Fire Department Officer whom the Chief might designate,
however any such Fireman required to work extra hours or attend meetings
on his off duty time shall be compensated, in addition to his regular
salary, an amount of money at the rate of one and one-half (1J) his
regular rate of pay.
The provisions of this charter amendment shall not be construed to be
violated when members of the Fire Department exchange time with each other
or hire a substitute to work in his place, with the consent of the Fire
Chief or any Fire Department Officer whom the Chief might designates
If the provisions of this charter amendment are adopted by a major-
ity of the qualified voters voting in this election, the base salaries
in effect on Oct. 1, 1951, for each classification in the Fire Department
shall be established as a minimum base salary for members of the Fire
Department in each classification.
If any part or parts of this charter amendment shall be held unconsti-
tutional, such unconstitutionality shall not affect the validity of the
remaining parts of this charter amendment.
If any section of the Charter of the City of Fort Worth is in con-
flict with this charter amendment as it pertains to wages and hours of
work of the Fire Department, such section is hereby repealed.
AMENDMENT II
Shall Chapter XXVIII of the Charter of the City of Fort Worth
be amended by adding thereto Section 4a reading as follows:
The Children's Museum of the City of Fort Worth is hereby
created and it shall be administered by a board consisting of twenty-
one (21) members to be known as the Children's Museum Board.
The members of the Children's Museum Board shall be nominated by
the Children's Museum Association and elected by the City Council.
Any citizen of Fort Worth may become a member of the Children's
Museum Association. The membership of the Children's !museum Board
shall include at least ten women and one member of the City Council.
The members of the Children's Museum Board shall serve without com-
pensation and they shall be subject to removal from office by the City
Council for any cause deemed by the Council sufficient for their
removal in the interest of the public service, but only after a
public hearing before the City Council upon charges publicly made,
if demanded by such member within ten (10) days. Any vacancy in the
membership of said Board shall be filled for the unexpired term
in the same manner as the original selection of the members. The
said Board shall have power and authority to equip, operate, supervise
and maintain the Children's Museum. The said Board shall have
power to appoint and employ all necessary officers and employees and
prescribe and fix their duties, authority and compensation. They
shall have the management and disposal of all funds legally apportioned
or received from any source for the support of the Children's Museum.
All supplies exceeding fifty ($50.00) dollars in cost shall be
purchased for the department by the Purchasing Department of the
City of Fort Worth under rules and regulations prescribed by the
City Council of the City of Fort Worth. No expenditure shall be
made or liability incurred by the Children's Museum Board exceeding
Five Hundred Dollars ($500.00) in amount without first being
authorized and approved by the City Council. This provision shall
not apply to employees that the said Board shall deem necessary to
employ for the operation of said department for the current year,
where the salary of such employee loam not exceed Two Thousand Dollars
($2,000.00) per annum, but all salaries of that amount or larger
shall be first submitted to the City Council and approved by it
before such appointment shall become effective. The annual budget
of the Children's Museum Board shall be submitted to the City Council
the same as all other departments of the City, in accordance with the
provisions of Chapter X of the Charter of the City of Fort Worth.
AMENDMENT III
Shall Chapter XXVIII of the Charter of the City of Fort Worth
be amended by adding thereto Section 4b reading as follows:
The City Council of the City of Fort Worth, when levying the
taxes for each fiscal year, shall levy an annual ad valorem tax of not
less than two cents (2¢) on each One Hundred Dollars ($100.00) of
assessed value of all real and personal property in the City of Fort
Worth not exempt from taxation by the Constitution and laws of the State
for the use and benefit of the Children's Museum. The said tax, when
collected, shall be deposited with the City Treasurer to the credit of
the Children's Museum, and said sums, together with all sums appropriated
by the City Council in the annual budget for the Children's Museum or
received from other sources, shall be deposited and held by the City
Treasurer in a separate account to the credit of the Children's Museum,
subject to the order and 'disbursement of the Children's Museum Board,
for the purposes and in accordance with the provisions of the Charter of
the City of Fort Worth, and the same shall be paid out upon warrants
issued by the Children's Museum Board, signed by the President or Vice-
President of said Board and countersigned by the Commissioner of Accounts
of the City of Fort Worth and the Secretary of the Children's Museum Board.
AMENDMENT IV
Shad Chapter XXVIII of the Charter of the City of Fort Worth
be amended by adding thereto Section 4c reading as follows:
The Art Museum of the City of Fort Worth is hereby created
and shall be administered by a board consisting of twenty-one (21)
members to be known as the "Art Museum Board". The members of the board
shall be nominated by the members of the Fort Worth Art Association and
elected by the City Council. Any citizen of Fort Worth may become a
member of the Art Association. The membership of the Art Museum Board
shall include at least ten women and one member of the City Council.
The members shall serve without compensation and they shall be subject
to removal from office by the City Council for any cause deemed by
the Council sufficient for their removal in the interest of the public
service, but only after a public hearing before the City Council upon
charges publicly made, if demanded by such member within ten (10) days.

nominated and elected. The said Board shall have power and authority

and qualifications. The said Board shall have the management and
disposal of all funds legally apportioned or received from any source
for the support of the Art Museum. All supplies exceeding Fifty Dollars
($50.00) in cost shall be purchased for the department by the
Purchasing Department of the City of Fort Worth under rules and
regulations prescribed by the City Council of the City of Fort Worth.
No expenditure shall be made or liability incurred by the Art Museum
Board exceeding Five Hundred Dollars ($500.00) in amount without
first being authorized and approved by the City Council. This
provision shall not apply to employees that the said Board may deem
necessary to employ for the operation of said department for the current
year where the salary of such employee does not exceed Two Thousand
Dollars (42,000.00) p6or annum, but all salaries of that amount or larger
shall be first submitted-to the City Council and approved by it
before such appointment shall become effective. The annual budget
of the Art Museum Board shall be submitted to the City Council the
same as all other departments of the City in accordance with the
provisions of Chapter X of the Charter of the City of Fort Worth.
AMENDMP]NT V
Shall Chapter XXVIII of the Charter of the City of Fort
Worth be amended by adding thereto Section 4d reading as follows:

AMENDMENT VI
Shall Section 23, Chapter XXVIII of the existing Charter
of the City of Fort Worth be repealed, which section now reads
as follows:
"In Case the Public Schools Removed From Control of City
Rate of Taxation Not to Exceed $1.90 Per $100.00 Valuation
of Taxable Property, Subject to Be Increased to $2.50 per
$100.00 Valuation, Provided Such Increase Be Voted by the
Electorate in Elections Held to Determine Same From Time
to Time.-- In the event that the Public Schools of this
City should be removed from the control of the City of
Fort Worth, so that the City should not be required to
provide for the support and maintenance thereof, then the
limit of taxation for all other municipal purposes from
and after said date shall not exceed One and Ninety/one-
hundredths (41.90) Dollars per annum on each One Hundred
($100.00) Dollars valuation of all taxable property
situated within the limits of the City, -- such rate to
be fixed and determined by the Council annually when pass-
ing the appropriation ordinance.
"The said rate of taxation may be annually increased,
from time to time, by the Council until the constitutional
limit' of Two and fifty/one-hundredths 42.50) Dollars on
each one hundred dollars valuation of taxable property
shall have been reached; provided, that any increase of
the annual rate of taxation beyond the $1..90 limit here
established shall never be valid unless first authorized
by a majority vote of the qualified tax paying voters
participating; in an election lawfully held for that
purpose. No more than one election in any one year
shall ever be held for such purpose."
SECTION 3.
That said election shall be held in the manner and within the hours
prescribed for general elections by the laws of the State of Texas so far
as they may be practicable, and all persons qualified to vote in said
City under the laws of this State regulating general elections shall be
allowed to vote.
SECTION 4.
That it shall be the duty of the City Secretary to prepare the of-
ficial ballot, on which official ballot shall appear the proposed amend-
ments set out in Section 1 of this ordinance, and after each of said pro-
posed amendments shall be printed the words "Yes," "No," in order that
the voter may vote "Yes" or "No" on each of said proposed amendments.
SECTION 5.
That all voters desiring to vote for the adoption of any of the
proposed,.amendments shall permit to remain on their ballot, with respect
to each proposed amendment which they desire to have adopted, the word
"Yes"; and those opposed shall permit to remain on their ballot, with
respect to each amendment which they desire to have rejected, the word
"No."
SECTION 6.
That the City Secretary shall, in accordance with the provisions of
Article U70 of the Revised Civil Statutes, mail a copy of each of the
proposed amendments to every qualified voter in the City of Fort Worth
as appears from the rolls of the Tax Collector of Tarrant County, Texas,
for the year ending January 31, 1953.
SECTION 7.
That a copy of this ordinance shall be sufficient notice of said
election, and thirty (30) days' notice of the time and places of holding
the said election shall be given by publication of such notice in the of-
ficial newspaper of said City once each week for four (4) weeks, the date
of the first publication being not less than thirty (30) full days prior
to the date of the election.
SECTION 8.
That each proposed amendment as is set forth hereinabove, if ap-
proved by a majority of the qualified voters voting upon said amendment,
shall become a part of the Charter of the City of Fort Worth as soon as
an official order and ordinance has been entered upon the records of
said City by the governing body thereof, declaring the same adopted.
SECTION 9.
The fact that the present Charter of said City is inadequate and
the importance of the proposed charter amendments create an emergency
and an imperative public necessity for the immediate taking effect of
this ordinance, and it is hereby ordained that this ordinance shall
take effect and be in full force and effect from and after the date
of its passage.
