OF A STATE OF WAR WITH A FOREIGN NATION; REQUIRING ALL PERSONS, FIRMS AND CORPORATIONS TO OB- SERVE REGULATIONS ESTABLISHING BLACKOUTS; AND PROVIDING A PENALTY FOR THE VIOLATION THEREOF. WHEREAS, the United States of America is now engaged in a war witk the Empire of Japan and the Governments of Germany, Italy and Hungary, and, consequently, a grave national emergency exists requir- ing the City Council of the City of Fort Worth to take immediate steps to protect the public against the perils of war and to preserve the public peace, health and safety; and WHEREAS, the burning of lights aide the enemy in reaching military and other objectives; and AREAS, it is imperative that all visible lights be extinguished during blackouts; and WHEREAS, the movement of traffic during such period& imperils and endangers life and property; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXASt SECTION 1. The term "blackout" is hereby defined as any period of time desig- nated by the Chief of Police for extinguishing lights of all kinds. The term "person" shall be construed to be all inclusive of every person, natural or artificial& SECTION 2• Whenever the Chief of Police or any officer acting under his direction orders a blackout, it shall be the duty of each and every person, firm and corporation to immediately extinguish or cause to be extinguished the lights in any room, house, apartment or building under his control, and keep such lights extinguished until the order is rescinded* SECTION 3• During the period of any blackout 1t shall be unlawful (1) for persons to congregate in groups of five or more on any sidewalk, street, alley or public thoroughfare; (2) to display or allow to be displayed any light visible from out of doors or from any vehicles; and (3) to drive any vehicles along any street, alley or public thoroughfare. This provision shall not apply to emergency vehicles equipped with lighting facilities approved by the Chief of Police, but such vehicles shall not exceed a speed of twenty miles per hour. SECTION Q. It shall be unlawful for any person, firm or corporation to wilfully refuse or neglect to obey or to promptly cooperate with any police officer in carrying out the provisions of this ordinance during the period of a blackout* SECTION 5. If any section, part or provision of this ordinance should be de" Glared invalid by a court of competent jurisdiction, such decision shall in no way affect any of the other provisions, but said provisions shall remain in full force and effect. SECTION b. If any person, firm or corporation wilfully fails, neglects or re• fuses to comply with any of the provisions of this ordinance they shall, upon conviction, be fined in any sum not to exceed Two Hundred Dollars ($200.00). SECTION 7.
