HomeMy WebLinkAboutOrdinance 20333-08-2012Ordinance No. 20333 -08 -2012 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $122,136.00, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF PAVEMENT RECONSTRUCTION, WATER AND SANITARY SEWER MAIN REPLACEMENT FOR HATCHER STREET, E. BERRY TO FORBES STREET AND RICHARDSON STREET, S. HUGHES AVENUE TO S. EDGEWOOD TERRACE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2011 -2012 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $122,136.00, from available funds, for the purpose of pavement reconstruction, water and sanitary sewer main replacement for Hatcher Street, E. Berry to Forbes Street and Richardson Street, S. Hughes Avenue to S. Edgewood Terrace. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19911 -09 -2011 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the transfer of $229,992.00 from the Water and Sewer Fund in the amounts of $122,136.00 to the Water Capital Projects Fund and $107,856.00 to the Sewer Capital Projects Fund; 2. Adopt the attached appropriation ordinances increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of $122,136.00 and the Sewer Capital Projects Fund in the amount of $107,856.00 from available funds; and 3. Authorize the execution of a contract with McClendon Construction Co., Inc., in the amount of $484,446.00 for pavement reconstruction, water and sanitary sewer main replacement for the streets listed below. DISCUSSION: As a part of the 2008 Capital Improvement Program for Neighborhood Streets by utilizing $355,160.00 from the 2008 Capital Improvement Program Fund and $229,992.00 from the Water and Sewer Capital Projects Funds to Provide for Construction Contract Costs, Contingencies and Construction Services for a Project Total of $585,152.00, the following streets will be completely reconstructed: Contract 5C — COUNCIL DISTRICT 5: Hatcher Street East Berry Street to Forbes Street Richardson Street South Hughes Avenue to South Edgewood Terrace In addition to pavement reconstruction, deteriorated water and sewer lines are to be replaced as specified by the Water Department. The new pavement section will consist of seven -inch reinforced concrete over six -inch lime stabilized sub -grade with seven -inch integral concrete curb. Concrete sidewalks and driveways are included with the pavement construction. On May 10, 2012 the following bids were received: McClendon Construction Co., Inc Stabile & Winn, Inc. JLB Contracting, LLC Bid Amount Time of Completion $484,446.00 220 Calendar Days $507,890.00 $518,351.72 Staff recommends that the low bid in the amount of $484,446.00 submitted by McClendon Construction Co., Inc., be selected and a contract awarded. In addition,$100,706.00 will be utilized for contingencies and construction services including surveying, material testing and construction inspection. McClendon Construction Co., Inc. is in compliance with the City's M/WBE Ordinance by committing to 13 percent M /WBE participation and documenting good faith effort on this combined project. The City's M /WBE goal on this combined project is 22 percent. This project is located in COUNCIL DISTRICT 5, Mapsco 79S. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that funds are available in the current capital budget, as appropriated, of the Street Improvements 2008 Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current capital budgets, as appropriated, of the Water Capital Projects Fund and the Sewer Capital Projects Fund.
