AN ORDINANCE APPROVING "_'HE REPORT OF THE DEPARTMENT OF PUBLIC WORKS: AWARDING THE CONTEACT FOR THE IM- PROVEMBNT OF A PORTION OF EL CAMPO AVENUE IN THE CITY OF FORT WORTH, TEXAS, AND AUTHORIZING ITS ERECUTION: MAKING APPROPRIATION FOR THE INDEBTEDNESS INCURRED THEREBY: AND DIRReTING THE CITY ENGINEER TO PREPARE ESTLUTES. WHEREAS, on the 29th day 'of September, 1949, by Ordinance passed and approved by the City Council of the City of Fort Worth being Ordinance No. 2591, the City determined the necessity for and ordered the improvement of a portion of El Campo Avenue, to-wit: EL CAMPO AVENUE from the westerly line of Horne Street to the westerly line of Halloran Street. WHEREAS, subsequent to the passage and approval of said ordinance, plans and specifications for said improvements were submitted by the City Engineer and said plans and specifications were approved and adopted by the City Council; and, WHEREAS, notice to bidders was given as required by the City Char- ter; and, WHE_H.EAS, the bid of Texas Bitulithic Company was found to be the lowest and best bid for the making and construction of said improvements, to- wit, excavating present street, placing thereon a 5 inch compacted gravel foundation course, and paving with 11 inches of Hot Mix Asphaltic Surface on AN of Hot Mix Asphaltic Concrete Base with combined concrete curb and gutter, together with incidentals and appurtenances, all as provided by said plans and specifications. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,TEXAS: SECTION 1. That the work of making and constructing such improvements and con- tract therefor is hereby awarded to Texas Bitulithic Company at and for the prices stated in the proposal of the said Company and as reported and re- commended by the Department of Public Works. The;.Mayor and City Secretary are hereby directed to execute the said contract in the name of the City of*Fort Worth, Texas, and to impress the corporate seal of the City there- on, the said Contract embracing therein, among other things, the prices for the work. SECTION 2. That to provide for the payment of the indebtedness incurred by the City of Fort Worth b�! said Contract, there is hereby appropriated out of available funds which have been set aside for said purpose, an amount sufficient to pay said indebtedness so incurred. SECTION 3- That the City Engineer of the City of Fort Worth be and he is hereby or- dered and directed to file with the City Council estimates of the costs of such improvements in accordance with the terms of the powers and provisions of Chap- ter 106 of the-acts of the First called Session of the Fortieth Legislature of the State of Texas, now shown as Article 1105b of Vernon's Civil Statutes of the State of Texas, Annotated, which law has been adopted as an amendment to and made a part of the Charter of the City of Fort Worth. APPPOVED AS TO FORM: 2�j CIT A ORNEY TO THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXASt Referring to the report of the Department of Public Works in con- nection with Bids for the improvements of E1 Campo Avenue, from the west- erly line of Horne Street to the westerly line of Halloran Street, in the City of Fort Worth, Texas, and to the proposed Contract therefor, it ap- pears that the amount which the City will pay in connection with such Contract and improvements is the sum of Seven Thousand Dollars($7,000.00). I do hereby certify to the City Council of the City of Fort Worth that the money required for such contract and expenditures which will be incurred thereby is in the Treasnry to the credit of the Street Improve- ment Fund and not appropriated for any other purpose.
