ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF BRYAN STREET
AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS, DECLARING
THE CONTRACT WITH TEXAS BITULITHIC COMPANY FOR THE CONSTRUC-
TION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED,
DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES
IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT
TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME
OF SAID ASSESSMENTS, AND DIRECTING THE CITY SECRETARY TO EN-
GROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME
IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS,
AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE
RECORD OF SAID CITY.
14HEREAS, the City of Fort Worth, Texas, has heretofore entered into
a contract with Texas Bitulithic Company for the making and construction of
certain street improvements on the hereinafter described portions of streets,
avenues and public places in said City, to wit:
1. BRYAN STREET FROM THE SOUTHERLY LINE OF RIPY STREET TO THE
NORTHERLY LINE OF BUTLER STREET KNOWN AND DESIGNATED AS
UNIT NO. 1.
2. BRYAN STREET FROM THE NORTHERLY LINE OF BUTLER STREET TO
THE NORTHERLY LINE OF DICKSON STREET KNOWN AND DESIGNATED
AS UNIT NO. 2.
and,
WHEREAS, by sundry proceedings heretofore passed by the City Council
of the City of Fort Worth, Texas, including Ordinance No. 4219,4220 & 4356, a
portion of the cost of said improvements was levied and assessed against the res-
pective properties abutting on each of the above described portions of streets,
avenues and public places and against the real and true owners thereof; and,
W111EREAS, the City Council of the City of Fort Worth, Texas, has,
upon review, found and determined that, in some instances, in order to effect
substantial justice and equality it is desirable and necessary to grant and
issue certain credits against some one or more of the assessments levied by
Ordinance No. 4356; and,
WHEREAS, the street improvements hereinabove mentioned have been
completed upon each of the portions of streets, avenues and public places here-
inabove described, and have been inspected and found to be in complete accordance
with the contract therefor;
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS, THAT:

The improvements on each of the portions of streets, avenues and
public places hereinabove described be, and they are hereby, accepted; and the
contract with reference thereto be, and it is hereby, found and declared fully
completed and performed.

The Mayor be, and he is hereby, directed to issue and execute
in the name of the City, certificates in evidence of the special assessments
levied against abutting property and the owners thereof for such improvements,
and the City Secretary is directed to attest same and impress thereon the
corporate seal of the City, all in accordance with the proceedings relating
to such improvements and assessments. The certificates shall be numbered,
shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective
parcels of property assessed and shall be issued in an amount equal to the dif-
ference between the principal amount of the assessment and the amounts of any
credit issued thereon. The numbers of the certificates, with the property des-
criptions to be shown on the respective certificates, together with the names
of,the owners of said property, the principal amount of the assessment, the
respective credits, if any, which are hereby authorized, granted and allowed
against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued
after giving effect to such credit, if any, are hereby enumerated and itemized
as follows:

When each of the certificates have been duly executed as hereinabove
provided, same shall be delivered to Texas Bitulithic Company as part payment
of the contract price.
IV.
The City Secretary is hereby directed to engross and enroll this
ordinance by copying the caption of same in the Minute Book of the City Council
of Fort Worth, Texas, and by filing the complete ordinance in the appropriate
Ordinance Records of said City.
V.
This ordinance shall take effect and be in full force and effect from
and after the date of its passage.

Members of the City Council Re: Assessment Paving on Various
City of Fort Worth Streets at Six Locations
(AP 59 18) Project 94 84 8
Mrs. McKnight and Gentlemen:
On February 5, 1960, Contract No. 4223 was awarded for construction of
assessment paving at six locations. The contractor has completed the
construction on Units I and 2, Bryan Street, in accordance with the plans
and specifications. - -
It is recommended that an Ordinance accepting the improvements on the above
two units be adopted. This will permit the contractor to bill the property
owners for their assessment. Final estimate to the contractor will be sub-
mitted at a later date.
