HomeMy WebLinkAboutOrdinance 1127 ORDINANCE NO. � AN ORDINANCE PROVIDING FOR THE ABANDONMEBiT, CLOSING AND VACATING OF HAWLET AND OR HOPKINS STREET AS SET OUT AM) SHOWN BY PLATS 'OF "FISHBURN PLACE" AND "FISHBURN LITTLE FARM" RECORDED IN THE PLAT RECOBIDS OF TARRANT COUNTY, VOL. 309, PAGE 68 AND VOL. 742, PAGE 324, RESPECTIVELY, SAID STREET PARTICULARLY DESCRIBED AS BEGINNING ON THE EAST LINE OF AYRES AVENUE AND RUNNING THENCE IN AN EASTERNLY DIRECTION FT FTY FEET (50 1) IN WIDTH 'THROUGH "Fi SHBURN PLACE" AM "FISHBURN LITTLE FARMS" TO THE EAST BOUNDARY LINE O! "FISHBURN LITTLE FARMS",THE SOUTH LINE OF SAID STREET BEING APPROX* INATELY TWO HUNDRED FEET (2001) NORTH OF THE NORTH LINE CF THE TEXAS AND PACIFIC RIGHT-OF-WAY, ALL OF SAID STREET BEING WITHIN THE BOUNDARIES 0 "FISHBURN PLACE" AND"FISHBURN LITTLE FARMS"; AND PROVIDING FOR THE LOCATING AND OPENING OF ANOTHER. STREET SO AS TO HAVE THE EAST END OF SAID STREET OPEN ON AYRES AVENUE THE N(R TH LINE OF WHICH SHALL BE THE SOUTH LINE OF THE STREET HERE CLOSED AND VACATED, AND TO RUN THROUGH "FISHBURN PLACE" AND"FISHBURN LITTLE FARMS" AND TO TERMINATE ON THE WEST LINE OF UPTON AVENUE AS SHOWN BY SAID PLATS AND PROVIDING FCR THE REPEAL OF ALL ORDINANCES OR PORTION& OF ORDINANCES IN CONPZICT HEREWITH. WHEREAS, it appearing to the City Council of the City of Fort Worth from the petition of Pacific Investment Company of Fort 'forth and W. C. Hargis, the report of the City Plan Board and plats and other evidence exhibited to it that Hawlet and or Hopkins Street lies wholly va thin the additions known as "Fishburn Place" and "Fishburn Little Farman running east and meat through said additions the south line of said street being approximately two hundred feet (2001) north of the north line of the Texas and Pacific Right-of-fray and that there are no oontimations of said street either east or west; THAT said street has never been improved or in anywise used by the public and that it exists only by virtue of the plats and dedications of "Fishburn Place" and "Fishburn Little Farms" as set out and shown in the caption above; THAT all of the property contiguous to and abutting on said street is owned by petitioners, to-wit: Pacific Investment Company of Fort Worth and W. C. Hargis, who are now desirous and are here petitioning for the closing of said street as now located and shown by former plats and dedications; and are desirous of opening another street to be located fifty feet (501) south of the location of the present Hawlet and or Hopkins Street. That is to say t)te new street to be opened is to have the south line of the present street for its north line and its south line to be fifty feet (501) south of the south line of the present street; its eas on to terminate onv Avenue and its west end to terminate on' Avenue; ro H pKER5 THAT said new street to be opened will in all respects serve the public necessity and be a better and more advantageous location for said thoroughfare than the present street; THAT application o£ petitioners for these purposes and to these ends has been approved by v. L. Lewis, City Engineer, and by the City Plan Board of the City of Fort Worth. NOW TMMFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FOR T WORTH: SECTION I. That that certain open-way, passage way and street situated on the properties known as "Fishburn Place" and *Fishburn Little Farms"--Additions to the City of Fort Worth--beginning on the east edge of Ayres Avenue, running thence eaetwardly through said two additions to the east boundary line of "Fishburn Little Farms", a street fifty feet (501) in width, the south line of which Is approximately two hundred feet (2001) north of the north line of the Texas and Pacific Right-of-way and the location of which street is specifically and definitely shown by the plats of "Fishburn Place" and Fishburn Little Farms" as set out in the caption above, be and the same is hereby vacated, closed and permanently abandoned as a street, passage way and thoroughfare of any kind and character. SECTION II. THAT the petition of Pacific Investment Company of Fort Worth and W. C. Hargis be and in all respects hereby granted and that in accord therewith Hawlet and or Hopkins Street, as now located and set out in the Section No. 1, next above, be wholly closed, vacated and permanently abandoned as a street, passageway and thoroughfare and that in exchange therefor the abutting property owners be and are hereby permitted to open another street to be fifty feet (501) in width to begin on the east edge of Ayres Avenue to run eastwardly through "Fishburn Place" and "Fishburn Little Fame" and to terminate on the west edge of Upton Avenue, the north line of said street to be the suth line of the said Hawlet and or Hopkins now closed, abandoned and vacated. a s� SECTION III. TUT all ordinances or parts of ordinances in conflict herewith are hereby repealed, and this ordinance and these presents shall be in full force and effect from and after its passage. At a regular meeting of the City Council of the City of Fort Worth held in the City Hall on Tuesday, the same being the 19th day of January, A. D. 1926, a quorum being present, the adoption of the above and foregoing ordinance was moved by Councilman A. E. Thomas and seconded by Councilman , and being put to a vote and all voting "Aye" and none voting "No", the same was declared to be unanimously adopted and passed and ordered to be spread upon the minutes.
