HomeMy WebLinkAboutOrdinance 24111-04-2020 Ordinance No. 24111-04-2020 AN ORDINANCE RESTRUCTING APPROPRIATIONS FOR THE CENTERPORT TRAIL PROJECT BY DECREASING RECEIPTS AND APPROPRIATIONS IN THE PARK IMPROVEMENTS PROGRAMMABLE PROJECT OF THE PARD GAS LEASE CAPITAL PROJECTS FUND IN THE AMOUNT OF$200,000.00 AND INCREASING RECEIPTS AND APPROPRIATIONS IN THE CENTERPORT TRAIL PROJECT OF THE FUND BY THE SAME AMOUNT FOR THE PURPOSE OF CONVERTING FROM A PROGRAMMABLE TO A STATIC PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the budget of the City of Fort Worth for Fiscal Year 2019-2020, as enacted by Ordinance 23835-09- 2019, as amended, is hereby further amended to reduce receipts and appropriations in the Park Improvements Programmable Project of the PARD Gas Lease Capital Projects Fund in the amount of $200,000.00, and increasing receipts and appropriations in the Centerport Trail Project of the Fund by the same amount for the purpose of converting from a programmable to a static project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision,opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23835-09-2019 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. City of Fort Worth,Texas Mayor and Council Communication DATE: 04/07/20 M&C FILE NUMBER: M&C 20-0256 LOG NAME: 80PROJECT RECLASS SUBJECT Adopt Ordinances to Restructure Certain Capital Appropriations by Reclassifying Appropriated Funds in the Amount of$230,866.00 from Programmable to Static Project Types for Improvements at Centreport Trail,and Sunset Hills Park,and Combining Funds from Duplicate Projects at Marine Creek Lake Park in the Amount of$500,000 for the Park and Recreation Department and Update the Corresponding Capital Improvement Plans(COUNCIL DISTRICTS 2,4,and 5) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached ordinance restructuring the appropriation for the Centerport Trail project by decreasing receipts and appropriations in the Park Improvements programmable project(City Programmable No. P00059)of the PARD Gas Lease Capital Projects Fund in the amount of $200,000.00 and increasing receipts and appropriations in the Centreport Trail(static)project(City Project No. 100082)by the same amount; 2. Adopt the attached ordinance restructuring the appropriation for the Marine Creek Lake Park project by decreasing receipts and appropriations in a duplicate Marine Creek Lake Park project(City Project No. 102335)of the 2018 Bond Program Fund in the amount of $500,000.00 and increasing receipts and appropriations in the pre-existing Marine Creek Lake Park Imps project(City Project No. 100577)by the same amount;and 3. Adopt the attached ordinance restructuring the appropriation for the Sunset Hills Park Drainage project by decreasing receipts and appropriations in the Park Improvements programmable project(City Programmable No. P00059)of the PARD Gas Lease Capital Projects Fund in the amount of$30,866.00 and increasing receipts and appropriations in the Sunset Hills Park Drainage(static)project(City Project No. 100771)by the same amount. DISCUSSION: The purpose of this Mayor and Council Communication (M&C)is to adopt revised appropriation ordinances to restructure certain Park and Recreation Department capital projects as"Static"rather than"Programmable"appropriations and projects and to get funds for improvements at Marine Creek Lake Park under the same project number. The Fiscal Year(FY)2020 Capital Improvement Plan(CIP)appropriated$200,000.00 for the Centreport Trail project in the Park Improvements Programmable Project. Because the Centreport Trail project is a static project and cannot receive funding from a programmable project,staff recommends adopting an ordinance to decrease appropriations in the Park Improvements Programmable Project and to increase appropriations in the Centreport Trail static project. The FY2019 CIP appropriated$135,000.00 for the Marine Creek Lake Park Imps Project(City Project No. 100577)from PARD Dedication Fees Fund. During the FY2020 CIP process,additional funding, in the amount of$500,000.00 from the 2018 Bond Program was appropriated for Marine Creek Lake Park. Rather than being appropriated into the pre-existing project,those funds were appropriated in a separate,duplicate project with the same name but a different numeric designation(City Project No. 102335).To correct this situation,staff recommends adoption of the second attached ordinance,which decreases appropriations in the duplicate project and increases appropriations in the pre-existing project. After the funds are removed from the duplicate project, it will be closed. The FY2019 CIP appropriated$30,866.00 for the Sunset Hills Park Drainage project in the Park Improvements Programmable Project.Because the Sunset Hills Park Drainage project is a static project and cannot receive funding from a programmable project,staff recommends adoption of the third attached ordinance,which decreases appropriations in the Park Improvements Programmable Project and increases appropriations in the Sunset Hills Park Drainage static project. NOTE ON CIP-Appropriations for these projects were included in prior year CIP's.Previously appropriated funds are not generally included in the forward-looking CIP. Therefore, prior year projects for which funding was appropriated were not included in the FY2020 CIP,which was presented to the City Council in August 2019. The action in this M&C will serve to update the FY2020 CIP. The Marine Creek Lake Park is located in Council District 2; Sunset Hills Park is located in Council District 4;and the Centreport Trail project is located in Council District 5. A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances,the funds are currently available in the PARD Gas Lease Capital Project Fund and the 2018 Bond Program Fund. Prior to an expenditure being incurred,the Park&Recreation Department has the responsibility of verifying the availability of funds.
