Subject: Update on the Development of a Scrap Tire Ordinance.
In late January 2008, staff updated City Council on the rules and regulations for the transportation and
disposal of waste and scrap tires. Aside from illegal dumping ordinances and laws that pertain to illegal
dumping, laws pertaining to transportation and disposal are addressed under state statutes and enforced
by Texas Commission on Environmental Quality (TCEQ).
Given the lack of enforcement resources available to
transportation and disposal of waste and scrap tires,
review.
Summary:
TCEQ and the growing problem with illegal storage,
staff has drafted a Scrap Tire Ordinance for public
In drafting the ordinance, staff met with the TCEQ and several municipalities to discuss this issue
and review their ordinances and operations. Staff drafted an ordinance that essentially mirrors
state statutes (so that tire shops and haulers would not have two sets of rules). By making this a
local ordinance, Fort Worth will have better enforcement and control:
Recommended New Ordinance
• Require a manifest for all
businesses and transporters of
scrap and used tires.
• Grant authority to Code
Compliance and FWPD to routinely
inspect manifest documents.
• Require all tire businesses to be
licensed /registered by the City
similar to metal recycling.
Current State Law
• Generators storing more than 500 tires
must be registered with the Texas Natural
Resource Conservation Commission
(TNRCC), Executive Director.
• Transporters shall register their operations
with the Texas Natural Resource
Conservation Commission (TNRCC),
Executive Director.
• Transporters shall maintain records using a
manifest system.
• TCEQ Enforces — Limited staff.
• Not required to register.
• Generators must follow established rules
for storage and record keeping.

Next steps:
Staff will schedule five public meetings in May 2008 to discuss and receive input on the issues and the
draft ordinance. Meeting notices and information will be posted on the City Page, intemet, distributed to
neighborhood associations, tire shops, and other stakeholders. Following these meetings, staff will report
back to Council with a recommendation.
