AN ORDINANCE providing for the sanitary regulation of food establishments in the City of Fort Worth, including restaurants, hotel dining rooms, cafes, cafeterias, lunch counters, ice cream parlors, soda fountains, soft drink stands, grocery stores, fruit stands, and all other places where food is sold, prepared for sale, distributed orldisplayed for sale, and providing for a penalty. BE IT ORDAINED BY THE BOARD OF 00181ISSIONERS OF THE CITY OF FORT WORTH, TEXAS: Section 1: That the term "food establishment" as hereinafter used in this Ordinance, shall be construed to mean restau- rants, hotel dining rooms, cafes, cafeterias, lunch counters, ice cream parlors, soda fountains, soft drink stands, grocery stores, fruit stands, and all other places where food is sold, prepared for sale, distributed or displayed for sale. Section 2: That the term "foodl-�as used in this 0ldinanoe shall be construed to mean all articles used for food, drink, confectionery or condiment, and all articles used in the preparation thereof. Section 3: That no food establishment shall be located on premises which are poorly drained or which are expeabd to nearby sources of contamination, and no food establishment 1%oA shall be maintained within 60 feet of any insanitary toilet, stable, hog pen, or any other unwholesome or insanitary condition. ,. 4 Section 4: That every building or room used as a food establishment shall have the floors, side walls and ceilings constructed and maintained so that they may be readily kept clean, well lighted, drained and ventilated and so as to exclude animals, — insects, dust, dirt and all other contaminating agents. The flooring of such buildings or rooms shall be constructed of water tight material, and shall be cleaned by a dustless method. Section 5: That every food establishment shall be provided with adequate, sanitary and conveniently located toilet and lavatory facilities for the use of all employees. No common towel shall be maintained in any lavatory. Section 6: That no sleeping or living quarters or toilet shall be located in rooms used for the storage, preparation, serving or distribution of food, and no wearing apparel shall be stored within the rooms used for the preparation or serving of food. Section 7:� That all doors, windows, ventilators and other apertures of food establishments shall be effectually screened with metal screening against flies at all times. The screen doors shall be provided with automatic self-closing devices. Section 8: That all food served or stored in a food establishment shall be kept at all times in a sanitary manner -in -ele-en places. All refrigerators shall be kept clean and wholesome in all parts and shall be drained in a sanitary manner-,(but no refrigerator tall be drained by direct communication to any sewer. d� V q t Sectioh 9: That all food offered for sale, sold, servi�d or stored in any food establishment shall be wholesome and safe for human consumption. No milk or cream shall be removed by dipping from containers. Section 10: f That all food served to customers for immediate con- sumption shall be handled with proper utensils in a cleanly manner, and so far as is possible in the preparation or serving of such food, the hands of the workers shall be pre- vented from coming in contact with the food ingredients or with the inner surfaces thereof. Section 11: That all food establishments shall be provided with adequate, and suitable equipment and utensils for the storage, preparation and serving of all food, so as to protect it fr= contamination. Such_equipment_shall be kept, at all times in a sanitary manner. No utensils shall be used in the preparation of food which are cracked, chipped or otherwise in such condition as to prevent them from being readily cleaned. r Section 12: That all utensils served to customers shall be cleaned after each use by being washed in hot water with soap, by being thoroughly immersed in clear boiling water or sterilized by other approved methods and by being dried in a sanitary manner. No water shall be used for cleaning such utensils which has become insanitary from previous use. * k' Section 13i That individual paper vessels may be used in the place of glassware in the serving of food, but such paper vessels shall be used only once for service and then shall be ti disposed of in a sanitary manner. All straws furnished to A the customers shall be kept in covered dust and fly-proof, metal, glass or sealed paper containers. Section 14: That all persons engaged in the preparation or serving of food shall be clean in person and clothing et "all times, and such persons shall thoroughly clean their hands before begianing work and after a visit to the toilet or urinal. Section 15: That no person having any communicable disease or carrying the infedtion of any communicable disease shall en- gage in or be permitted to engage in the preparation or serving of food, and no person shall work or be employed in any food establishment during the time when a case of com- municable disease exists in the place where he or she resides, unless granted a special permit by the City Health Officer. Section 16: That no person or employee shall expectorate or discharge from the body,or any organ thereof, upon the floors, walls, equipment or food of any food establishment. Section 17: Y That accumulations of garbage and other"waste within, under or around any building or room used as a food establish- ment shall be prevented. All garbage from such food establish- ments shall be placed in fly-proof, water tight, metal con- tainers of adequate capacity. Such containers shall be kept closed at all times, except when garbage is being deposited therein or removed therefrom, and all garbage shall be removed from the premises and the oontainers thoroughly cleared at least once daily. Section 18: That whatever condition ac t or thing in any food establishment, as abov eacribed, which may be dangerous r I • F to human health, or whatever may render the building, air or food hazardous or injurious to human health, in the opinion of the City Health Officer, is hereby declared to 1 constitute a nuisance, which nuisance shall be abated in such manner as may be prescribed by the City Health Officer. Section 19: That any person or persons, firm or corporation ,or the agents of any such who neglects, fails or refuses to comply with any of the provisions of this Ordinance, shall be deemed guity of a misdemeanor and when convicted shall be fined in the sum of not less than Ten ($10 .00) Dollars, nor more than One Hundred ($100. 0) Dollars, and each time such person or persons, firm or corporation, neglects, fails or refuses to comply with any of the provisions of this Ordinance, shall be deemed a separate offense. Section 20 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 21: Should any section or part of section of this ordinance be declared unconstitutional or invalid by a court of ccmpetent jurisdiction, such decision shall not affect the other or remaining pactions or parts of sections of this crdinanoe, but the same shall continue and be in full force and effect. Section 22: Be it furt-.er ordained, that this Ordinance shall be in n full force and effect on and after passage and publication as required by law.
