HomeMy WebLinkAboutOrdinance 733 n� A rt ORDINANCE NO, -y AN ORDINANCE granting to the National Sup^ly Company of Tex- as and to the Republic Supply Compnay, both corporations, for a period of t.,enty-five years, the right to construct and maintain a spur or switch railway track on the south side of North Street and within the curb or side walk lines in the City of Fort Worth, Texas. BE IT ORDAINED BY, THE BOARD OF C01'..ISSIONERS, vF THE CITY yF FORT WORTH: Section I: The National Supply CL;uoan5 of Texas and the Republic Supply Company, both corrora,tions, are hereby grant- ed the right, Rower, privelige and franchise to b ild, construct, ..aintain, and oper.,te a certain connecting railwaytrack ar switch over and along a certain rtion of North Street as follows: Beginning at a point in North Street on the East line of Ash Street produced, and 14 feet North of the South property line of North Street; thanes in an easterly direction as shown on attached sketek, to a point in the East line of Lamer Street and 33 test South Of the North line of forth Street. Section 3: It is provided that said spur,,as constructed along the said North Street, as rrovided herein, shall be upon such grade as shall be approved by the City Engineer of the City of Fort Worth, and the top of each rail of each and ev-ry part of said track, and the spacing bet �een the rails shall be kept level with the street alongside; and the tracks, and all other eYui-•,.ent used in such extension or connection shall be of standard quality and so constructed and. mainta.ined that travel on said streets shall not be a...:eceaaaFi3g ocstructed or at any _lace, arxc3..all matters of construction and maintenance shall b= subject to the approval of the City Engineer and Board of Coz.-issioners of the City of Fort Worth; and all tracks of said streets, or portions thereof, that are now, or shall hereafter be paved, shall be first class rails of such kind as shall be designated by the City Engineer, and shall be laid in such manner as to make the least possible obstructions to vehicles, and shall be maintained in that condition. Section 3: The National Supply Company of Texas and the Republic Supply Company, their successors and assigns, shall �t their costs and expense, . ave the line track between the rails and eight- een inches on each side thereof and repa a or otherwise surface and resurface s-.id main line track and eighteen inches on each aide there- of , and k.=ep constantly in good order and condition, with the same material with which the stxL:,4ts on the outside are pav„"� and sur"faced all that part of s.:.id streets occupied by,y its .. .ain line tradk, and that which 'Lies bet een the rails of said"(mWa line tracks occupied by it, and for eighteen inches on each side thereof, as may be laid under this franchise, and said National Sup ly Company of Texas and Republic Supply C&paay, their assigns and successors, shall conform its or thr:ir tracks , or any part thereof, to the pro-er grade of said streets and change the level of siad tracks of :.ften and when- ever the grade of said street is changed, so that every part of each track shall always be kept duly established grade line, or as near thereto as the surface of the grade of the street outside therof •will permit. Section 4: Said National Supply Company of Texas and re- public Supply[ Company, their successors and assigns, do hereby agree to indemnify and hold the City of Fort 'Forth harmless becauseof, and promptly pay off and discharge , or repay '-o the said City ::f Fort Worth, all damages, claims, judgements, attorneys fees and other costs and expenses rendered against, or incurred or paid out by the City of Fort Worth by reason of injuries either to persons or pro- perty, occasioned as the proximate result of anything . o-e or per- - mitted, or in any way proximately arising out of the location, con- struction, operation or mal-n`telance of said tracks upon the above named streets.
