COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth (City) and TCB, Inc., formerly known
as Turner, Collie & Braden, Inc., (Engineer) made and entered into City
Secretary Contract No. 31833 (the Contract) which was authorized by the
City Council by M&C C-20660; and
WHEREAS, the Contract involves engineering services for the following
project:
Pavement Reconstruction and Water and Sanitary Serer
Replacement on Provine Street (Normandy Road to Ederville Road),
Norma Street (north Hughes Avenue to north Edgewood Terrace),
Morris Court (Rand Street to East Dead End), City Project No. 00170
WHEREAS, it has become necessary to execute Amendment No. 3 to
said Contract to include an increased scope of work and revised maximum
fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following agreement
which amends the Contract:
1.
Article I of the Contract is amended to include the additional
engineering services specified in a proposal letter dated May 23, 2008, a
copy of which is attached hereto and incorporated herein. The cost to City
for the additional services to be performed by Engineer total $5,200.00.
2.
Article II of the Contract is amended to provide for an increase in the
maximum fee to be paid to Engineer for all work and services performed
under the Contract, as amended, so that the total fee paid by the City for all
work and services shall not exceed the sum of $138,912.40.

All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

On May 15,2008,TCB,the City of Fort Worth,and the contractor met at Morris Court with some
residents of the court that will be affected by the street construction of the cul-de-sac. The radius of
the court's cul-de-sac will be widened from about 70-feet to 80-feet. This widening will impact
homeowners'yards around the court. One resident in particular has been vocal about the widening
and would like for the impacts to be minimized as much as possible.
The meeting was set to explore different options to reduce the impact of the construction. At the
conclusion of the meeting, two options were suggested,one option is to construct a retaining wall
around the court and the other is to raise the profile of the court.
The retaining wall would be an expensive addition to the project,and thus,the City of Fort Worth
asked TCB to explore the second option of raising the pavement of the cul-de-sac. The City of Fort
Worth said that they would give TCB a supplemental agreement to the existing Provine-Norma-
Morris contract to review this second option and to prepare revised sheets detailing the option. The
purpose of this memorandum is to request additional compensation for the required work.
The following tasks are necessary for the review and design modifications of the cul-de-sac of
Morris Court. The fees associated with these tasks are provided in Attachment A.
1. Review Possibility of Raising the profile on the Court—This task includes the time for
reviewing the feasibility of raising the profile of Morris Court,including reviewing driveways
around the court. The fee required to perform this task is$1,040.
2. Redesign the profile of the Court—This task is necessary to modify the Morris Court Plan
and Profile sheet showing the cul-de-sac, as well as modifications to cross-sections for the
cul-de-sac. TCB will revise the plan and profile sheet showing the centerline profile,the top
of curb profiles,and spot elevations. The fee required to perform this task is$3,160.
3. QA-QC—TCB will provide quality control and assurance during the preparation of the plans
and details pertaining to this supplemental. TCB estimates that the fee required to perform
this task is$1,000.

The total fee to perform the work described above is$5,200. This fee is shown in Attachment A.
