An Ordinance providing for the rQMOval of buildings,sheda, awnings, fonoea,vv*j- lz and other s'•ructures within the corporate limits of the Ctty of Fort 'Worth whose condition is dangerous to persona and propert. r,and providing for notice to the owner or oeoupant of same and the way in vdhIoh such removal *hail be made,f1,1fhg penalties for t}�e 'violation of this ordiasnoe and repealing Sections 658,859,060,661 and 882 of Chapter 2 of Title � 1 VI of the Revised Ordinances of the City of Fort Worth as com- piled by Wm.D.Wi-LIiams and T. J. Poaeli. BE IT ORDAINED by the Board of Commissioners of the Clty of Fort Vbrth: Seetten 1 . That whenever any irt{,lding,house,fence,shed, Awning,wal I or any anther structure. like or unlike, or any part there9f,,xitW4 the corporate limits of the City of Fort Worth Is in a condition who" same is liable or likol► to fell and thereby endianger persons or property, it shall be the dtlllYof the owner or his or her agent, or the occupant Herron, upot notice 1 , to that effect from tha Commissioner of Atreets and Public GVounds, to take down and remove said dangerous structure or part thereof, and put the proulses whereon said structure was standing in a safe,eanitary and sound condition. 9ec.2.The notice hereinabove mentioned shall consist in an oral or �rk tton notice in the name of the Conmisbioner of Strea is� and Public grounds and may be executed T;y tim Commission" in person or by the Chief of Police, Assistant Chief, or any of- ficer of the City of Fort Worth,and it shall suffice if same is served v$on the owner of said structure or of the land upon which wane _a standing or upon his or 'irr agent or upon the ocen- pant of said prokises,and a general description of the property, where said notice is in writing, shall be sufficient. Soo.3. If after the expiration of five days from and after the service of notice as aforesaid,said own -,agent or occupant should fail or refuse to tame flown and remove said dangerous atruc- turs Or part thereof and place said proxises in a safe,sound and sans tart' condition then it shall be and in hereby made the duty of the Commissioner of Streets and Public Grounds to hm s said structure dismantled, taken down and removed and said premisoa made safe, and secure to persons and property,shd the reasonable expense of such weak shall be taxed against and shall be and be- came a charge and liability against the eyvner of said propevty and reoeverable by suit of the City of Fort worth in any court of competent Jurisdiction, $ec .4. The Commissioner of Streets and Public Grounds,the Comanissioner of Fire and Pol.ice,the City Nngineer,tbo Chief of Police,the dhisf of Fire Department, or any officer Winder hire or their dissotion shall, have the right,authority and power to enter upon, inspect and examine an.1 structure iand:�pzssmiaes whereon same is ® thin tUo corpor a limits ©f the City of Yort Worth, deemed to be darg*mus to life or prApe -ty. Sec.5. In the event that any structurs mentioned and defined In Bec.1 hereof is in"such iminant and irmeadlato peril of fal- ling down, toppling over, or colla0vi:ng that to await the 1poriod of five days from and after notice as provided for in Section 3 hereof would be 4$Merous to life or praferty,then said notice shall require imediats action and the prescribed five days dis- pensed with,ana on .failure or rsiusai of such owner agent or occu- pant Imediately to remove same alter notice,then said Commis- sioner of Streets and Public Grounds shall at once proceed to have same done and charge expense against the owner thereof as he"Inbeto re pointed Out. Sec.8. Any owner or agent of such oondemno+d building,house, fence,shoed#awning,w&il`er other structure as defined in Section 1 hereof who #hall fail or rtfuse to comply with said notica era served on him9within the �timoe specified ba this ordinance,shall be deemed guilty of a misdemeanor and upon convictitn thereof sha1.1 be fined not lass than ten doe' ors and �.c� mory than fifty !w .ellars,and every day during which this ordinance or any part thereof is violated shall be deemed a separate and distinct "dffense and punishable as such. All ordinances and ;Darts thersof,and Sections R58, 659,660,661 •and 662 of Chapter 2 of Title PI of Revised Civil Ordinances of the City of Fort Worth as compiled by Wm.D.Wil- liama and T.d.Powell, be and the same are hereby repealed. Sec.8. This ordinance shall take effect and be in force from, and after Its passage and publication an required by law.
