AN ORDINANCE MAKING IT AN OFFENSE FOR ANY PERSON, EITHER AS OWNER, LESSEE, EXHIBITOR OR AGENT OF AN OWNER, LESSEE OR EXHIBITOR, TO KEEP, OPERATE OR EXHIBIT FOR OPERATION ANY MARBLE BOARD OR ANY CHAR- ACTER OF WHAT IS COMMONLY KNOWN AS A PINBALL MA- CHINE WHICH IS OPERATED BY UNITED STATES COIN OR TOKEN WITHIN THE CITY OF FORT WORTH, TEXAS; DEFINING MARBLE TABLES AND PINBALL MACHINES AS A NUISANCE; PROVIDING THAT IN THE EVENT OF CONVICTION UNDER THIS ORDINANCE SUCH PERSON SHALL BE DEEMED TO BE MAINTAINING A PUBLIC NUISANCE AND AUTHORIZING POLICE OFFICERS OF THE CITY TO SEIZE MARBLE BOARDS AND PIN- BALL MACHINES AND CAUSE THEM TO BE DESTROYED; PRO- VIDING FOR A PENALTY; PROVIDING THAT EACH DAY'S VIOLATION SHALL CONSTITUTE A SEPARATE OFFENSE; PRO- VIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EF- FECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: 1. That the exhibition, operation and presence of marble boards, marble tables or pinball machines of any character in places and establishments where goods, wares, food or merchandise are sold or purchased or where persons of the general public assemble and congregate by invitation or otherwise are cal- culated to allure and entice habitual loafers and vagrants; to encourage, pro- mote, foster and cause the general public, including minors and those of tender years to engage in gambling; to disturb and provoke breaches of the peace and tranquility of the City and among its citizens; to foster and encourage loiter- ing, loafing, idleness and vagrancy; that the presence, exhibition and operation of any marble boards, marble tables or pinball machines of any character in the City of Fort Worth is hereby declared to be a nuisance. 2. That it shall hereafter be unlawful in the City of Fort Worth, Texas, for any person as owner, exhibitor, lessee or agent or employee of any owner, exhibitor or lessee of a marble board or pinball machine operated by a United States coin or token to keep, operate or exhibit for operation any marble board or any character of what is commonly known as a pinball machine. 3• That any person, firm or corporation who violates any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in a sum not to exceed Two Hundred Dollars (M.00), and each day that such violation shall continue shall constitute a separate offense. That any person guilty of violating the provisions of Section 1 of this ordinance shall be and is hereby deemed to be creating and maintaining a public nuisance and any police officer of the City of Fort Worth, Texas, may seize any marble board or pinball machine found in operation in said City and may cause same to be destroyed as provided by the Statutes of the State of Texas. 5• Should any word or words, section, clause or provision of this ordinance be declared unconstitutional by a court of competent jurisdiction the said decision shall in no manner affect any portion of this ordinance except the particular part held to be invalid, but all of the remaining portion shall continue in full force and effect. It is the intention of the City Council that this ordinance shall be cumulative of all other ordinances of the City of Fort Worth. 6. This ordinance shall take effect from and after its date of passage and publication as by law provided.
