AN ORDINANCE AMENDING ORDINANCE NO. 3011, BEING AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE, OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STRZET PARKING AND LOADING AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS CF SUCH NUMBER, SHAPE, AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID DESCRIBED AREAS FROM THE USES AS SHOWN ON THE MAPS CONTAINED IN SAID ORDINANCE NO. 3011; PRESCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN $5.00 NOR MIRE THAN $200.00 FOR EACH OFFENSE, AND THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No. 3011 be amended so that the following described uses in the hereinafter described areas be altered, changed and amended as follows to wit: AREAS FROM TO - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - - No. 60-Z-156: The North 1,000 feet, less the North 150 feet and less the West 150 feet; of Tract 4-B, U. The zoning regulations and districts, as herein established, have been made in accordance with a comprehensive plan for the purpose of promoting health, safety, morals, and the general welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers;to provide adequate light and air; to prevent overcrowd- ing of land; to avoid undue concentration of population; to facilitate the ade- quate provision of transportation, water, sewerage, parks and other public requirements. They have been made with reasonable consideration, among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and en- couraging the most appropriate use of land throughout the community. SECTMN 3. This ordinance shall be cumulative of all other ordinances of the City of Fort WorV. affecting zoning and shall not repeal any of the provisions of said ordinance except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. Should any section, clause or provision of this ordinance be declared by the Court to be invalid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. SECTUN 5. Any, person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars 45.00) nor more than Two Hundred and No/100 Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTioN 6. This Ordinance will take effect and be in full force and effect from and after its passage and publication as required by lair. Petitioner plans a neighborhood shopping and recreational center for the residents of this area, at a proposed cost of $250,000. 3. A 150 foot wide strip to the north, and a 150 foot wide strip to the west, left zoned residential by agree- ment of the petitioner, will buffer this site from residential uses and the elementary school to the north; and Ralph Bunche Park to the west. 4. The Commission discussed their proposed Rules of Procedure, and unanimously admpted the final draft submitted, with one corroation to clarify the actions of the Commission in the event there is no presentation made by the petitioner. Copies of the rules will be submitted to the Council, with a letter of transmittal from the Chairman. 2. Discussed the proposed "E-PI Planned Commercial District, and instructed the staff to arrange for advertising a public hearing on this proposal for February 21, 1961, so that all interested parties will have an opportunity to be heard before a final recommendation is made to the Council. 3. Discussed the proposed new off-street parking requirements, and agreed that aI1 member of the Commission would endeavor to acquaint as many people as possible with the proposed new off-street parking and loading requirements, and that the proposal should be as widely advertised as possible, and reviewed in a public hearing so that all interested parties will have an opportunity to be heard. The Planning Director assured the Commission of full staff cooperation at any meetings at which they might desire assistance from the staff.
