STREET AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH TEXAS BITULITHIC COMPANY FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PER- FORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSh,1ENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a con- tract with Texas Bitulithic Company for the making and construction of certain street improve- ments on the hereinafter described portions of streets, avenues and public places in said City, to-wit: 1. South Grove Streets From the northerly line of Ripy Street to the southerly line of Shaw Street, known and designated as Unit No. 3A. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 4356, a portion of the cost of said improve- ments was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 4356; and, WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT. I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby accepted, and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owners thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of property assessed and shall be issued in the amount equal to the difference between the principal amount of the assessment � -1- and the amounts of any credits issucd thereon. U Uz TII1l o Nev CITY OF FORT WORTH mr' "4 TEXAS OFFICE OF THE CITY MANAGER Communication to Mayor and Council No. PW1- 571 October 13, 1961 Honorable Mayor and Members of the City Council Re: Assessment Paving on City of Fort Worth Various Streets - Six Locations (AP 59-18) Project No. 94-84-8 CIP A-101 Mrs. McKnight and Gentlemen: On February 5, 1960, the City awarded Contract No. 4223 for the construction of assessment paving at six locations to Texas Bitulithic Company on its low bid of $179,269. 12 on an assessment basis. Construction has been completed on Unit 3A, Grove Street from Ripy Street to Shaw Street, in accordance with plans and specifications. The contract price on this unit was $32,019.00 and the final contract cost is $32,198.00 with the abutting property owner's portion of the cost amounting to $18,975 and the City's portion amounting to $13,223.00. Variations in contract quantities account for differences in the contract cost. The construction has been inspected by the Public Works Department and it is recommended t-hat the ordinance accepting the project be adopted and Estimate No. II and Final for Unit No. 3A. in the amount of $1,322.30 be approved for payment.
