AN ORDINANCE ALTERING AND EXTENDING THE BOUNDARY LIMITS AND ANNEXING CERTAIN TERRITORY LYING ADJACENT TO THE CITY OF FORT WORTH; PROVIDING THAT THE ORDI- NANCE BE ADVERTISED IN A DAILY NEWSPAPER PUBLISHED IN SAID CITY IN ACCORDANCE WITH THE PROVISIONS OF SECTION 40, CHAPTER XXVIII OF THE CITY CHARTER; AMENDING ALL ORDINANCES IN CONFLICT HEREWITH; PRE- SCRIBING A SAVINGS CLAUSE AND SPECIFYING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the hereinafter described territory lying adjacent to the City of Fort Worth is hereby annexed and brought within the corporate limits and made an integral part of said City of Fort Worth, said territory being situated in Tarrant County, and Johnson County, Texas, and being described by metes and bounds as follows: Being a tract of land about 12 miles south from the Court House of Tarrant County, Texas, and lying in the G. Hernandez, G. Hamilton, John Sise, J. Jennings, S. A. and M. G. Railroad Co., Henry Lane, William Stone, John Steele, Sarah Gray, I. and G. N. Railroad Co., H. Alsbury, C. Martin, R. W. Waggoner and H. G. Catlett No. 5-157 Surveys in Tarrant and Johnson Counties, Texas. BEGINNING at a point in the present City Limit Line of Fort Worth, at its intersection with the east line of the M. K. T. Railroad Co. right-of-way, in the G. Hernandez Survey. THENCE southerly along the easterly line of the M. K. and T. Railroad Co. right-of-way to its intersection with the south line of Tarrant County, Texas. THENCE west along the south line of Tarrant County, Texas, to its intersection-with the northeasterly line of the H. G. Catlett Survey No. 5-151, the present City Limit Line of Burleson. THENCE northwesterly along the northeasterly line of the H. G. Catlett Survey, No. 5-151, the present City Limit Line of Burleson, to the north corner of the H. G. Catlett Survey No. 5-151, the east corner of the H. Alsbury Survey. THENCE southwesterly along the southeasterly line of the H. Alsbury Survey, the present City Limit Line of Burleson, to its intersection with the south line of Tarrant County. THENCE westerly along the south line of Tarrant County, the present City Limit Line of Burleson, to its intersection with the easterly right-of-way line of the western route of County Road No. 1017. THENCE southwesterly along the southeasterly right-of-way line of said road, the present City Limit Line of Burleson, approximately 300 feet to its intersection with the northeasterly right-of-way line of the Burleson-Crowley Public Road. THENCE southeasterly along the northeasterly right-of-way line of the Burleson-Crowley Public Road, the present City Limit Line of Burleson, to its intersection with the northwest line of the H. G. Catlett Survey (No. S-151). THENCE southwesterly, along the northwest line of the H. G. Catlett Survey (No. S-151), the present City Limit Line of Burleson, passing a corner of Burleson's City Limits, and continuing southwesterly along the northwest line of the H. G. Catlett Survey (No. S-151), to its intersection with the northeast line of the H. G. Catlett Survey No. S-157. THENCE southeasterly, along the northeast line of the H. G. Catlett Survey No. S-157, to its east corner. THENCE southwesterly, along the southeast line of the H. G. Catlett Survey No. S-157, to its south corner. THENCE northwesterly, along the southwest line of'the H. G. Catlett Survey No. S-157, to its intersection with the east line of the G. C. and S. F. Railroad Co, right-of-way. THENCE northerly, along the east line of the G. C. and S. F. Railroad Co. right-of-way, to its intersection with the south line of Tarrant County, the present City Limit Line of Crowley. C. and S. F. Railroad Co. right-of-way. THENCE northeasterly, along the easterly line of the G. C. and S. F. Railroad Co. right-of-way, to its intersection with the north line of the S. A. and M. G. Railroad Co. Survey. THENCE east, along the north line of the S. A. and M. G. Railroad Co. Survey and the north line of the S. A. and M. G. Railroad Co. Survey produced easterly, to its intersection with the westerly line of the M. K. and T. Railroad Co. right-of-way. THENCE northeasterly, along the westerly line of the M. K. and T. Railroad Co. right-of-way, to its intersection with the present City Limit Line of Fort Worth. THENCE southeasterly, along the present City Limit Line of Fort Worth to the place of beginning, and containing approximately 5.337 square miles. t SECTION 2. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, and more particularly this ordinance expressly amends Ordinance No, 4382 heretofore passed on first reading October 28, 1960, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. SECTION 3. That this ordinance shall be published one time in a daily newspaper published in the City of Fort Worth, in accordance with the provisions of Section 40, Chapter XXVIII of the City Charter. SECTION 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional by a court of competent jurif,dietion, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases or words, except as the same are inseparable from and indispensable to the remaining portions of the ordinance. SECTION S. That this ordinance shall become effective and be in full force and effect upon its final passage, which in no event shall be less than thirty (30) days from the date of its publications, as aforesaid, and it is so ordained. TEXAS WAS P"ES`1T7V.D TO TifE CITY COUNCIL OCT417—FrilcZ 2 1.1., WASROVr THS CITY MANAGER Communication to Mayor and Council No. PZ-34 `r/q - j October 8, 1962 J � City Secretary Honorable Mayor and Members of the City Council Re: Request to Realign Boundaries City of Fort Worth between Fort Worth and Burleson Mrs. McKnight and Gentlemen: On April 9, 1962, the City Council received a request from the Mayor of Burleson that Fort Worth release an area of approximately 183 acres from first reading in order that Burleson might annex it. The request was referred to the City Manager �Tbr study and the attached report has been prepared by the Planning Department. As explained in the attached report, the Planning Department recommends that the 183 acre area not be released from first reading because of evidence that release of the area could result in uncontrolled develop- ment which would be detrimental to the cities of Crowley and Burleson, as well as to the future growth of Fort Worth in this are.a; 411'.?o, tho Planning Department recommends that another area which was released-from first reading in 1960 be again placed under first reading. In the course of the study, the need for clarification of Fort Worth's first reading area and the city limits of Burl�on.became apparent. A proposed ordinance has been prepared which, if adopted, will (1) Place under first reading the part of the area described in the report which was released from first reading in '1960 and (2) clarify the boundaries between Fort Worth and Burleson. Taylor, Mayor of Bi3rleson,, addressed to the Honorable John Tustin, Mayor of Fort Worth, and. dated March 28., 1962, asking the City of Fort Worth to release approximately one hundred eighty-three (183) acres of first reading land.s., so that the area could be annexed by the City of Burleson" RECOMKE,DTDATIONS Evidence in this study shows that release of the area in question from first reading of Fort Worth could allow uncontrolled developnBnt, which would possibly be detrimental to the cities of Crowley,, Burleson., and to .future development areas of Fort Worth in this portion of Tarrant and Johnson Counties. It is therefore recomnended that the area requested for release be retained under first reading ordinances of Fort Worth and that the request for deletion be denied. Also,,, it is recommended that the area released to Crowley in 1960, which was not annexed by that City, be again placed under first reading by the City of Fort Worth. _2,_4 LOCATION The area requested for deletion is located in the I. & G. N. RR. , H. Alsbury, and H. G. Catlett Surveys, It lies in both Tarrant and Johnson Counties west of U. S. Highway No. Rl between the City of Burleson and the City of Crowley. The tract lies approximately 14 miles south of the Court House and appro-xi- matel-,T 5 miles south from the roresent city 'Limit line of the City of Fort Worth. ANNEXATION STATUS This tract is a portion of an area of approximately 4.6 square miles which was placed under first reading by Ordinance No. 43820 adopted on October 28, 1960. ORDINANCE CONFLICT A conflict presently exists between Fort Worthts First Reading Ordinance No. 4382, adopted October 28,, 1960., and Burleson's Annexation Ordinance No. 18., adopted July 17., 1960. A small tract within the area in question was annexed by the City of Burleson prior to the time it was placed under first reading to the City of Fort Worth. A new first reading ordin4nce should be adopted deleting this small tract from our first reading. The area that should be e released is a small triangle (approximately 3000 square feet) of land lying south of the Tarrant-Johnson County Line,, east of County Road No. 101" and northwest of the northwest line of the H. G. Catlett Survey. During 1960, the City of Fort Worth released ll,,000 acres of first reading lands near the City of Crowley for annexation to the City of Crowley. In February, 1961, the City ofBurleson attempted to annex a large portion of this area ('outlined in purple on enclosed map) and constructed a water supply tower upon this property. In the opinion of the Planning Director, the tract annexed b-,7- Burleson is riot contiguous to the original city; therefore ' it was an invalid annexation. Another large portion of the tract released by Fort Worth in 1960 remains unclaimed to the present time (outlined in blue on enclosed map). BURI;ESON GROWTH NEEDS There is apparently no city planning program in effect in Burleson, and therefore it would be extremely difficult to determine when or if the area in question will be needed by the City of Burleson for growth. At P­resent, it is not con- tiguous to the urbanized area of Burleson. FORT WORTHvS GROWTH NEEDS The area is not anticipated to have sufficient population to be considered as continguous urban development of Fort Worth until about 1970. However, it appears that sporadic growth could cause development of this area at any time, as major directional growth of the city has been to the south and southwest. The area in question is within the Fort Worth drainage area and should eventually become a part of the City of tort Worth. 3 Utility Service by Fort Worth The 1962 Long Range Capital Improvement Program contains plans for the con- struction of a water main along the west side of U. S. Highway No. 81 to Burleson°s City Limits. There is a possibility this line could be completed in 1963,, The area proposed for de-annexation could easily be served with water by tapping into this main. At present, there are no plans by the City of Fort Worth for construction of a sewer main that could serve the area in which the major portion of the re- quested .de-annexation lies. In the 1962 Long Range Capital Improvement Pro- gram are plans for the construction of an extension of the Village Creek Collector Main to the eastern limits of the City of Crowley. This program r is to be initiated in the period 1963-65 and would serve the area north of the proposed de-annexation. All of the area in question and all of the area surrounding Burleson and Crowley are within the Fort Worth drainage basin and could eventually be sewered back to the Village Creek Disposal Plant. Utility Services by Burleson Mr. Hobert Bartlett, Mayor of Burleson, stated that the City of Burleson can furnish sewer coverage to the area whenever it should develop. The area in question is separated from the built-up area of Burleson by a strip of vacant land approximately one-quarter mile wide. Unpaved and unopened street dedi- cations in over one-half of the city, intermixing of commercial and resi- dential land uses, and a 'very low occupancy rate illustrate what can occur when development is allowed before the area population is ready to absorb it and without proper regulatory controls. There is little,if any, basic industry in Burleson to provide the tax base necessary to adequately serve the area in question. Land Use Controls The City of Burleson has no type of land use controls, zoning or subdivision regulations to insure that t a area in question will not be developed in a sub-standard manner and be detrimental to Fort Worth, Crowley, Burleson and the metropolitan area. Large platted residential areas of western Burleson are presently carrying up to 30% vacancies in existing housing, and 40% of one area has been repossessed by F. H. A. Land Use Conflicts It is presumed that the area in question will be used for future residential purposes by the City of Burleson. As the area lies between the City of Burleson and the City of Crowley and the major portion of both cities is residential, this use would not conflict with land uses contemplated for the future. The area should be used for residential purposes; however, the quality of development and construction can only be insured if the area is eventually annexed to the City of Fort Worth. d Effects of .Disposition The area ,in question is a small corridor lying adjacent to and between the City of Crowley and the City of Burleson. This area is the southern tip of our first reading area with a portion of it lying in Johnson County, Because of this and the fact that it lies between Burleson and Crowley, it is improbable that its release could block the future development of Fort Worth in the forseeable future, However, the factors studied show that release of this area would open the way for uncontrolled development and the possible creation of future pro- blems to the cities of this portion of the county and the City of Fort Worth,
