AN ORDINANCE ALTERING AND EXTENDING THE BOUNDARY LIMITS AND ANNEXING CERTAIN TERRITORY LYING ADJACENT TO THE CITY OF FORT WORTH; PROVIDING THAT THE ORDINANCE BE ADVERTISED IN A DAILY NEWSPAPER PUBLISHED IN SAID CITY IN ACCOHDANCE WITH THE PROVISIONS OF SECTION 40, CHAPTER XXVIII OF THE CITY CHARTER; AMENDING ALL ORDINANCES IN CONFLICT HEREWITH; PRESCRIBING A SAVINGS CLAUSE AND SPECIFYING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: { Section 1. That the hereinafter described territory lying adjacent to the City of Fort Worth is hereby annexed and brougbtwithin the corporate limits and made an integral part of said City of Fort Worth, said territory being situated in Tarrant County, Texas, and being described by metes and bounds as follows: Being a tract of land lying west of the City of Fort Worth in the J. Wilcox Survey No. 38, T. Smallwood, D. Perry, S. Best, L. Bil.lington, W. E. Boswell, E. T. Rice, E. W. Bill.ingston, S. T. Hovens, Thomas Hicks, A. L. Hill, M. Hunt, J. Wilcox No. 36, J. Wilcox No. 39, J. Wilcox No. 40, J. Wilcox No. 42, J. Wilcox No. 43, J. A. McCarty, 0. K. Davis, S. A. &. M. G.R.R. Co. and D. P. Newsom Surveys in Tarrant County, Texas. BEGINNING at a point in the present city limit line of the City of Fort Worth, at its intersection with the north line of the J. Wilcox Survey No. 34. THENCE westerly along the north lines of the J. Wilcox Survey No. 34 and the M. Hunt Survey to the northwest corner of the M. Hunt Survey. THENCE southerly along the west line of the M. Hunt Survey and along the west line of the M. Hunt Survey produced southerly, to its intersection with the south right-of-way line of State Farm to Market Road No. 1886.. THENCE westerly along the south right-of-way line of State Farm to. Market Road No. 1886, to its intersection with the west line of Tarrant- County. THENCE northerly along the west line of Tarrant County to its intersection with the north line of the D. P. Newsom Survey. . THENCE easterly along the north line of the D. P. Newsom Survey, to its northeast corner. THENCE southerly along the east line of the D. P. Newsom Survey to the northerly northwest corner of the S.A. & M. G. R.R. Co. Survey. THENCE easterly along the north line of the S. A. & M. G. R. R. Co. Survey to its northeast corner, in the west line of the J. Wilcox Survey No. 43. THENCE northerly along the west line of the J. Wilcox Survey No. 43, to the northwest corner of the J. Wilcox Survey No. 43. THENCE east along the north line of the J. Wilcox Survey No. 43 to its intersection with the westerly right-of-way lire of State Highway No. 199. THENCE southeasterly along the westerly right-of-way line of State Highway No. 199, the present city limit line of Azle, approximately 2800 feet to a corner of the City Limits of Azle. THENCE north 45 degrees east, along the present city limit line of Azle, to the northeasterly right-of-way line of State-Highway No. 199. THENCE southeasterly along the northeasterly right-of-way line of State Highway No. 199 to its intersection with the south right-of-way line of Scotland Ave. THENCE easterly along the south right-of-way line of Scotland Ave., the present city limit line of Azle, to its intersection with the west line of the J. Wilcox Survey No. 42. THENCE northerly, along the west line of the J. Wilcox Survey No. 42, the present city limit line of Azle, to its intersection with the south right-of-way line of County Road No. 4032. THENCE easterly along the south right-of-way line of County Road No. 4032, with its meanders, to its intersection with the present city limit line of the City of Fort Worth, in the J. Wilcox Survey No. 42. THENCE south, east, southeast, east, south, east and south, along the present city limit line of the City of Fort Worth, with its meanders, to the place of beginning, and containing approximately 9.125 square miles. Section 2. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, and more particularly this ordinance expressly amends Ordinance No. 3827 heretofore passed on first reading May lb, 1958, but as to all other ordinances or sections of ordinances not in direct conflict herewith this ordinance shall be and is hereby made cumulative. Section 3. That this ordinance shall be published one time in a daily newspaper published in the City of Fort Worth, in accordance with the provisions of Section 40, Chapter XXVIII of the City Charter. Section 4. If any section, subsection, clause, sentence, phrase, or word of this ordinance is for any reason held void or unconstitutional by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining sections, subsections, clauses, sentences, phrases or words, except as the same are inseparable from and indispensable to the remaining portions of the ordinance. Section 5. That this ordinance shall become effective and be in full force and effect upon its final passage, Which in no event shall be less than thirty (30) days from the date of its publications, as aforesaid, and it is so ordained. C. D. Development Company that an area of 91.83 acres located southeast of 4zle and under first reading to Fort Worth be released from first reading in order that it might be annexed by Azle. Action has not been taken upon the request and the Planning Department has prepared the attached report which recommends that the request be denied for the lack of ,justification. During the course of the study, the need for clarification of Fort Worth's first reading area and the city limits of Azle became apparent. A pro- posed ordinance has been prepared which, if adopted, would clarify exist- ing boundaries. It is recommended that the proposed ordinance be adopted and that the 91.83 acres remain under first reading to Fort Worth.
