ORDINANCE NO. �g� ORDINANCE ACCEPTING IMPROV 'VS ON A POORTION OF KILPATRIC AVENUE AND PORTIONS OF SUMIMY OTH M STR7nTS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARIctG THE CONTRACT WITH �-y 'J. E. BRITTAIN FAR THE CONSTRUCTION OF SAID ANC MOUTION AND DELIVERY NTS FULLY �OF CERTIFICATLn_ 2D AND E EVIDENCE DIRECTING U DE'NCEOF SPECIAL ASSESS RENTS LEVIM AFTER GIVING EFFECT TO SUNDRY CRT'DITS HEPEIN AUTHORIZE FT WORTN, T� AND ALLOWED AGAINST SOME OF SAID ASSESSM�'PS; DIRECTING THE CITY SECRMTARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP- TION OF SAME IN THE MINUTE BOOK OF THE, CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AND EFFRCTIVE DATE. WHEREAS. the City of Fort Worth, Texas, has heretofore entered into a contract with W. E. Brittai.ar for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public plebes in said City, to-wit: 1 KILPATRICK AVENUE From east line Horne Street to east line Faron, known and des- ignated as Unit No. 1. 2 FARNSWORTH STREET From east line Littlepage to west line Horne Street, known and designated as Unit No. 2. 3 BLACKP:.ORE AVENUE From west line Faron Street to west line Bourine, known and designated as Unit No. 3. 4 BLACKMCRE AVENUE From east line Littlepage to east line of Guilford Road, known and designated as Unit No. 4. 5 BLACKMORE AVENUE From east line Hervie Street to west line Prevost Street, known and designated as Unit No. 5. 6 BONNELL AVENUE From east line Merrick Street to east end of street, known and designated as Unit No. 6. 7 HUMBERT AVENUE From west line Horne Street to east line Guilford Road known and designated as Unit No. 3. 8 BOLAND STREET From south line West 4th Street to south line Bristol Road, known and designated as Unit No. 8. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 4 72 7 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHER AS, the City Council of the City of Port Worth, Texas, has, upon re— view, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 472 7 , and V=AS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avFnuee and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THME-FORE, BE IT ORIXINED BY TIE CITY COUNCIL OF THE CITY OF FORT WORTH, TT;RAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with re— ference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro— perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certifi— cates, together with the names of the owners of said. property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: Itt. When each of the certificates has been duly executed as hereinabove provid- ed, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Working Time Bid: 64 Working Days Working Time Used: 57 Working Days Project Cost and Financing: Bid Price: $77,891.98 Final Contract Cost: $76,051.10 Partial Payments Previously Made: 5 Amount: $67,336.56 Final Payment Due: $8,714.54 Payment to be made from Account No. 97-B4-1 Deviation from Bid Price: Variations between estimated and measured quantities account for the difference in contract price and contract cost. Pavement Tests: Attached is a tabulation of paving test cores showing compliance with specifications within acceptable construction tolerances. Prior to stabilization of the grabel base with cement, soil constants including plasticity index, and gradation tests were made and showed that the material used was in compliance with specifications.
