HomeMy WebLinkAboutContract 49779-A2 CSC No.49779-A2 �,�G 0 20ti AMENDMENT No.2 100, �� TO CITY SECRETARY CONTRACT No. 49779 WHEREAS, the City of Fort Worth (CITY) and Pacheco Koch Consulting Engineers, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 49779, (the CONTRACT) which was authorized by M&C C-28344 on the 291-h day of August, 2017 in the amount of $ 200, 000 .00; and WHEREAS, the CONTRACT involves engineering services for the following project: Citywide Storm Drain Projects; and WHEREAS, Amendment No. 1 to the CONTRACT to include an increased scope of work for an amount of $95, 000 and total revised fee amount of $295, 000 was approved administratively on February 12, 2019 and filed with the City Secretary (No. 49779-A1) ; and WHEREAS, it has become necessary to execute Amendment No. 2 to the CONTRACT as authorized by M&C 20-0235 on the 7th day of April, 2020 to include an increased scope of work for an amount of $50, 000 and revised total fee of $345, 000 . NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated December 4, 2019, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $50, 000. 00. (See Attached Funding Breakdown Sheet, Page -3-) 2 . These additional services are required due to needing additional miscellaneous storm drain design services. The previous design contract and Amendment No 1. were for $295,000 for on-call storm drain design services and included ten (10) Task Orders, eight (8) of which are complete and two (2) are currently ongoing. This amendment is for a $50,000 increase to the original contract amount. All the additional services proposed will be performed in accordance with the original contract dated October 11,2017. This Amendment, consisting of one page, and the attached MBE/SBE goal good faith estimate represent the entire amendment to the original agreement between the City of Fort Worth and Pacheco Koch Consulting Engineers, Inc. If the terms of this Amendment are acceptable, please indicate by acknowledging acceptance of the terms of this document. DISCUSSION: The purpose of this Mayor and Council Communication (M&C)is to provide for additional engineering services under this city-wide storm drain projects contract for the project to improve storm drainage at Eighth Avenue and W.Arlington Avenue(Eighth and Arlington Storm Drain Improvements)(City Project No. 101277). Pacheco Koch Consulting Engineers, Inc. (PK)was awarded a task order contract on August 29,2017 to provide engineering services for various small drainage projects around the city.The contract was amended administratively on February 12, 2019. To date,the consultant has completed nine task order projects and is working on the design of this last project assigned under this contract.To meet the requirements of the permit from Fort Worth and Western Railroad (FWWR)and complete this project, additional engineering effort is required to demonstrate no impact on the downstream channel. PK proposes to complete the work for an amount not to exceed $50,000.00. Staff considers the fee to be fair and reasonable for the scope of services proposed. Therefore Pacheco Koch Consulting Engineers, Inc. remains in compliance with the City's BDE Ordinance and attests to its commitment by its signature on the Acceptance of Previous SBE Commitment form executed by an authorized representative of its company. This project is located in COUNCIL DISTRICT 9. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are available in the current capital budget, as appropriated, of the Stormwater Capital Projects Fund Eighth and Arlington Drainage project to support approval of the above recommendation and execution of the amendment.
