HomeMy WebLinkAboutOrdinance 7718 ORDINANCE NO, 07 1 AN ORDINANCE VACATING, ABANDONING AND CLOSING HUNTER STREET IN THE 1500 BLOCK A WIDTH OF 60' AND A LENGTH OF 185' FROM WORKS STREET SOUTH TO 3RD STREET; 3RD STREET A WIDTH OF 60' AND A LENGTH OF APPROXIMATELY 651' FROM HANDLEY DRIVE EAST TO THE WEST LINE OF THE ALLEYS IN BLOCKS 38 AND 41; AND THE 15' WIDE NORTH/SOUTH ALLEY EXTENDING FROM 4TH STREET TO 3RD STREET IN BLOCK 41; ALL IN TOWN OF EDERVILLE ADDITION TO THE CITY OF FORT WORTH; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Hunter Street in the 1500 Block a width of 60' and a length of 185' from Works Street south to 3rd Street; 3rd Street a width of 60' and a length of approximately 651' from Handley Drive east to the west line of the alleys in Blocks 38 and 41; and the 15' wide north/south alley extending from 4th Street to 3rd Street in Block 41; all in Town of Ederville Addition to the City of Fort Worth, be and the same are hereby vacated,abandoned and closed as streets and as an alley. SECTION 2, That the fee to the land in the above described street right-of-ways and alley is hereby released and will revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are reserved for any and all existing utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed® SECTION 4m That this ordinance shall take effect and be in full force and effect from and after the date of its passage and it is so ordained. V-78-2 Hof Charles C. Gumm, Jr. , with the consent of all other abutting owners, has requested that the City vacate Hunter Street in the 1500 block a width of 60 feet and a length of 185 feet from Works Street south to 3rd Street; 3rd Street a width of 60 feet and a length of approximately 651 feet from Handly Drive east to the wrest lane of the hlleys in Blocks 38 and 41; the 15 foot wide north/south alley extending from 4th Street to 3rd Street in Block 41; all in the Town of Bderviile Addition, as shown on the attached map. The subject street and alley rights-of-way, acquired by dedication, are unimproved, not open, and apparently contain no utilities. Reviewing City departments and private utility companies have raised no objections to the requested vacations, provided the vacated rights-of-way are replatted with abutting properties. The Plan Commission has concurred with the recommended vacations subject to an appropriate replat to include emergency access easements, approval of the plan by the Fire Marshall, and a statement prohibiting fencing along property lines adjacent to other private property unless such owners consent to the fencing. Although the submitted replat does not include all of the rights-: f-way being vacated, assurances have been received that those owners will submit appropriate replats when their property is redeveloped.
