HomeMy WebLinkAboutOrdinance 7818 ORDINANCE NO4 ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF EVERMAN ROAD AND PORTIONS OF SUNDRY OTHER STREETS9 AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH AUSTIN ROAD COMPANY FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOR OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE® WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Austin Road Company , for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-Vito EVERMAN ROAD From I.H. 35-W Service Road to Oak Grove Road, known and designated as Project No. 104-23000 149, a seven-inch thick reinforced concrete pavement on a six-inch thick lime stabilized subgrade with seven-inch high superimposed concrete curb. Six-inch thick concrete drive- ways will be constructed where specified. The roadway will consist of two thirty-six foot traffic lanes with a twenty-eight foot median. s WHOUS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 7374 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WEMEAS, the City Council of the City of Fort Worth, Texas, has, upon re- view, found and determined that, in some instances, in order to effect substantial ,justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 7374 , and 'ATMAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and pudic places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THFORE, RE IT ORDAIN31D BY TFE CITY COUNCIL OF T?E CITY OF FORT WORTH, T1?XA , THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with re- ference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance wit be the proceedings relating to such improvements and assessments. The certificates shall numbered, shall describe the property against which the assessment has been levied, shall, where renown, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certifi- cates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV® The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Project Description Name: Pavement and Improvements of Everman Road from I-35 W to Oak Grove Road, Project No. 104-23149, Contract No. 8840 dated June 1, 1976. Contractor: Austin Road Company Contract Awarded: June 1, 1976 (M&C C-3417) Work Order Issued: August 31, 1976 Work Order Effective: September 15, 1976 Work Began: September 13, 1976 Project Substantially Complete and Final Inspection Made: June 21, 1978 Final Construction Approval: September 12, 1978 Working Time Bid: 220 Working Days Working Time Used: 222 Working Days Project Cost and Financing Original Bid Price: $1,058,627.31 Change Order No. 1: $6,116�00 (A.R. 1-15; 2.3.1) Revised Bid Price: $1,064,743.31 Final Contract Cost: $1,053,206.01 Less 2 Days Liquidated Damages at $200.00=$400.00=$1,052,806.01 Partial Payments Previously Made. 18 Amount: $942,076.31 Final Payment Due: $110,729.70 Sufficient funds are available for the final payment to be made from Project Number 104-23149. Contract Time: The contractor used two working days in addition to the time allotted. A charge of $200 per day has been deducted from the final payment for liquidated damages as provided for in the contract. Deviation from Bid Price: The final contract cost of this project is $11,537.30 under the revised contract price. The savings resulted because it was not necessary to construct sub-drains. Compliance with Specifications Tests made during construction show materials used and required thicknesses were in compliance with the contract specifications.
