AN ORDINANCE AMENDING CHAPTER 43 OF THE CODE OF THE CITY OF FORT WORTH, TEXAS (1964) , AS AMENDED, BY ADDING THERETO SECTIONS 43-10 THROUGH 43-13; PROVIDING FOR THE CREATION AND OPERATION OF AN ETHICS ADVISORY COMMISSION TO BE COMPOSED OF FIVE MEMBERS FROM DESIGNATED CIVIC AND PROFESSIONAL ORGANIZATIONS; MAKING THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES AND PROVISIONS OF THE CITY CODE; REPEALING ALL ORDINANCES OR PROVISIONS OF THE CITY CODE IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Chapter 43 of the Code of the City of Fort Worth, Texas (1964) , as amended, be and the same is hereby amended by adding thereto Sections 43-10 through 43-13 inclusive, which Sections shall be and read as follows: "Sec. 43-10. Ethics Advisory Commission. "An Ethics Advisory Commission is hereby established, to be composed of five (5) members, all of whom shall reside in the City of Fort Worth. The Commission membership shall be comprised of one member from each of the following organizations: Tarrant County League of Women Voters; Fort Worth/Tarrant County Bar Association; National Conference of Christians and Jews; National Association for the Advancement of Colored People; and Fort Worth IMAGE. Each organization shall appoint or elect one of its members to serve on the Commission. The Commission members shall receive no salary, compensation or remuneration for their services on the Commission. Each member of the Commission shall serve for a term of two (2) years or until his successor is appointed. The initial appoint- ments to the Commission shall be three members for terms of one (1) year, and two members for terms of two (2) years. The Commission members serving for initial terms of one (1) year shall be those members appointed or elected by the Tarrant County League of Women Voters, the National Conference of Christians and Jews, and Fort Worth IMAGE. "Sec. 43-11. Organization of the Commission. "The Ethics Advisory Commission each year shall elect from its membership its Chairman and Secretary and upon its formation shall promulgate its own rules and regulations as to its forms and procedures and maintain proper records of its opinions and proceedings. "Sec. 43-12. Authority and duties of the Ethics Advisory Commission "The Ethics Advisory Commission may render advisory opinions to and at the request of the City Council,as authorized by Section 16, Chapter XXVIII, of the Charter of the City of Fort Worth,concerning conflicts of interest, ethical conduct, and interest of City officers and employees in contracts of any nature. The Ethics Advisory Commission may make recommendations to the City Council with respect to the amendment of this Code of Ethics. "Sec. 43-13. Cooperation of City boards, commissions, departments, officers and employees "All boards, commissions, departments, officers and employees of the City shall furnish to the Ethics Advisory Commission such data, in- formation and statements as may in the opinion of the Commission be necessary for the proper exercise of its functions, authority and duties. " SECTION 2. That this ordinance shall be cumulative of all provisions of the Code of the City of Fort Worth (1964) , as amended, and all other ordinances of the City of Fort Worth, except in those instances where the provisions of this ordinance are in direct conflict with the provisions of such Code or other ordinances, in which instances said conflicting provisions of such Code or other ordinances are hereby repealed. SECTION 3. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective or unconstitutional by the valid judgment or final decree of any court of competent jurisdiction, -2- such voidness, ineffectiveness or unconstitutionality shall not affect any remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. That this ordinance shall become effective and be in full force and effect from and after the date of its passage and publication as required by law, and it is so ordained.
