HomeMy WebLinkAboutOrdinance 7525 ORDINANCE NO, 75 Z.5 AN ORDINANCE DECLARING CERTAIN FINDINGS; PROVIDING FOR THE EXTENSION OF CERTAIN BOUN- DARY LIMITS OF THE CITY OF FORT WORTH, TEXAS, AND THE ANNEXATION OF 79 ACRES (0,123 SQUARE MILES) OF LAND, MORE OR LESS, WHICH SAID TERRITORY LIES ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS OF FORT WORTH, TEXAS; PROVIDING THAT THE TERRITORY ANNEXED SHALL BEAR ITS PRO RATA PART OF TAXES; PROVIDING THAT THE INHABITANTS THEREOF SHALL HAVE ALL THE PRIVI- LEGES OF ALL THE CITIZENS OF FORT WORTH, TEXAS; PROVIDING THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR ORDINANCE IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT CONFLICT; PRO- VIDING FOR SEVERABILITY AND NAMING AN EFFECTIVE DATE, WHEREAS, a public hearing before the City Council of the City of Fort Worth, Texas, wherein all interested persons were provided with an opportunity to be heard on the proposed annexation of the territory hereinafter described, was held at the City Council Chambers in the Municipal Office Building of Fort Worth, Texas, on the 14th day of March, 1977, which date is not more than twenty (20) nor less than ten (10) days prior to the institution of annexation proceedings; and WHEREAS,notice of such public hearing was published prior thereto in a newspaper having general circulation in the City of Fort Worth, Texas, and in the hereinafter described territory on the 2nd day of March, 1977, which date was not more than twenty (20) nor less than ten (10) days prior to the date of the public hearing; and WHEREAS, the population of the City of Fort Worth, Texas was in excess of 367,000 inhabitants on January 1, 1963 and in excess of 400,000 inhabitants on January 1, 1977, and WHEREAS, the corporate area of the City of Fort Worth, Texas was 152.580 square miles on January 1, 1963 and was 241.936 square miles on January 1, 1977, and WHEREAS, the hereinafter described territory lies within the exclusive extraterritorial jurisdiction of the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory lies adjacent to and adjoins the City of Fort Worth, Texas; and WHEREAS, the hereinafter described territory contains 79 acres (0.123 square miles) of land, more or less; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described land and territory lying adjacent to and adjoining the City of Port Worth, Texas, is hereby added to and annexed to the City of Fort Worth, Texas, and said territory hereinafter described shall hereafter be included within the boun- dary limits of the City of Fort Worth, Texas, and the present boun- dary limits of said City, at the various points contiguous to the area hereinafter described, are altered and amended so as to include said area within the corporate limits of the City of Fort Worth, Texas, to-wit: BEING A PORTION OF A TRACT OF LAND CONVEYED TO MEADOWS WEST CORPORATION IN THE DAMES ROGERS SURVEY, ABSTRACT NO, 1264 TARRANT COUNTY, TEXAS BEGINNING at a point in the existing Fort Worth City Limit line, said point being in the south right-of-way line of proposed Interstate Highway 820- 1-20, said point also being N 89009'45" W a distance of 170.0 feet from the northeast corner of the aforementioned James Rogers Survey, said point also being S 89009145" E a distance of 396.6 feet from the centerline of the Trinity River (Clear Fork Branch) , said point also being the centerline of a 151 sanitary sewer easement; -2- THENCE with said centerline of said sewer easement along a curve with a radius of 797.2 feet; THENCE continuing with said easement centerline S 460 201 W a distance of 550.0 feet to a point. Said point being the beginning of a curve with a radius of 1,792.39 feet; THENCE continuing with said easement centerline and along said curve a distance of 663.0 feet to a point; THENCE leaving said centerline of easement S 690 291 45" E a distance of 18.0 feet to a point, said point being in a curve with a radius of 1,774.89 feet; THENCE along said curve a distance of 46.33 feet; THENCE S 690291 45" E a distance of 12.68 feet to a point, said point being in a curve with a radius of 87.30 feet; THENCE along said curve a distance of 75.0 feet; THENCE S 27029145" E a distance of 50.0 feet to a point, said point being in a curve with a radius of 137.30 feet; THENCE along said curve a distance of 18.32 feet to a point; THENCE S 0802914511 E a distance of 98.34 feet to a point; THENCE S 66030'15" W a distance of 57.0 feet to a point; THENCE S 14029145" E a distance of 156.55 feet to a point; THENCE S 75030115" W a distance of 50.0 feet to a point; THENCE S 10000'15" W a distance of 132.0 feet to a point; THENCE S 04030133" W a distance of 115.08 feet to a point; THENCE S 00151 E a distance of 183.0 feet to a point, said point being in the south line of the afore- mentioned James Rogers Survey, said point being S 89045" W a distance of 385.0 feet from the north- west corner of the J. Watson Survey, Abstract No. 1666 and the northeast corner of the J. Spillman Survey, Abstract No. 1377; THENCE S 890451 W a distance of 1,953.2 feet to a point, said point being in the centerline of the aforementioned Trinity River (Clear Fork Branch) , said point also being in the existing City Limit line of the City of Fort Worth, Tarrant County, Texas. THENCE continuing with said centerline of said river and said existing Fort Worth City Limit line the following courses and distances: N 15006-45" E, 398.3' N 27051115" E, 194.51 N 42056'15" E, 240.21 N 72025115" E, 475.8' N 46043145" E, 173.6' N 27025-15" E, 349.2' N 18009'15" E, 121.21 N 20016'15" E, 96.21 N 16039115" E, 383.8' N 33035'15" E, 353.1' N 62038-15" E, 81.9' N 67 0 36'15" E, 217.3' N 84016'15" E, 315. 9' -3- S 81,16-45" E, 248.5' S 83 0 3945" E, 301.5' N 38031'15" E, 120.0' THENCE continuing with said centerline of river N 00121 15" E a distance of 267.6 feet to a point, said point being in the south line of the afoxementitoned proposed Interstate Highway 20/8207 THENCE with said south line S 89009'45" E a distance of 396.6 feet to THE POINT OF BEGINNING and containing 79 acres of land more or less. SECTION 2. That the above described territory and the area annexed shall be a part of the City of Fort Worth, Texas, and the property so added hereby shall bear its pro rata part of the taxed levied by the City of Fort Worth, Texas, and the inhab- itants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resolutions and regulations of the City of Fort Worth, Texas. SECTION 3. That this ordinance shall and does hereby amend every prior ordinance in conflict herewith, but as to all other ordinances or sections of ordinances not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 4. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared void, ineffective, or unconstitutional by the valid judgment or final decree of a court of competent juris- diction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections -4- hereof, since the same would have been enacted by the City Council without the incorporation herein of any such void, ineffective or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5, That this ordinance shall be in full force and effect from and after the date of its passage on first reading and publication and its passage on second reading as provided for in Section 40 of Chapter XXVIII of the Charter of the City of Fort Worth and it is so ordained, APPROVED AS TO FORM AND LEGALITY: S. Johndroe, Jr. , City Attorney 141 Passed and approved this the 2-8 day of M AIC-N 1977. -5- City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE SUBJECT: PAGE NUMBER Annexation - Meadows West Addition 1 2/28/77 PZ-777 1 Meadows West Corporation has requested that the City Council annex a 79- acre tract of land proposed to be developed as Meadows West Addition, under its involuntary annexation powers. The land requested for annexation is located immediately south of the proposed Interstate Highway 20 (Loop 820) and east of the Clear Fork of the Trinity River, as shown on the attached map. The site is in a Tarrant County Enclave surrounded on all sides by Fort Worth city limits. Fort Worth has extraterritorial jurisdiction over the area and no other city has any jurisdiction, annexation or otherwise. Sanitary sewer is proposed to be made available to the tract from an existing Fort Worth main. Water is proposed to be made available from an existing Benbrook water main by agreement with the City of Benbrook. All other city facilities and services can be made available to the site under normal procedures. Meadows West Corporation has received preliminary plat approval from the Plan Commission. The Plan Commission, in connection with its plat review, recommended that the area proposed to be developed be annexed to Fort Worth. A copy of a proposed annexation timetable is attached. Recommendation It is recommended that the City Council, as recommended by the City Plan Commission, initiate annexation proceedings and authorize and direct the necessary publication and notices for a public hearing to be held on March 14, 1977.
