AN ORDINANCE AUTHORIZING THE EXECUTION
OF A CONTRACT BETWEEN THE CITY OF FORT
WORTH, TEXAS AND TRINITY RIVER AUTHORITY
OF TEXAS; DECLARING AN EMERGENCY; AND
PROVIDING THAT THIS ORDINANCE SHALL BE
IN EFFECT FROM AND AFTER THE DATE OF ITS
PASSAGE
WHEREAS, it is necessary and advisable that the
City of Fort Worth, Texas enter into the contract hereinafter
authorized; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH:
1. That the City Manager and the City Secretary
of said City are authorized .and directed, for and on behalf
of the City of Fort Worth, Texas, to date, sign, seal and
otherwise execute a contract in substantially the form and
substance attached hereto and made a part hereof, said contract
having been approved as to form and legality by the City Attorney.
2. That upon execution said contract shall be bind-
ing upon the City of Fort Worth for all purposes.
3. That it is hereby officially found and deter-
mined that a case of emergency or urgent public necessity
exists which requires the holding of the meeting at which this
Ordinance is passed, such emergency or urgent public necessity
being that the execution of the proposed contract is required
as soon as possible and without delay for necessary and urgently
needed public improvements; and that said meeting was open to
the public, and public notice of the time, place and purpose of
said meeting was given, all as required by Article 6252-17,
V.T.C.S.
4. That this Ordinance shall be in full force and
effect from and after the date of its passage, and it is so
ordained.

City Council action is requested on the following proposed contract:
Background:
Sale of the portion of the GSIA Property containing the GSIA Wastewater
Treatment Plant (to Redman Industries, Inc.) included provisions for
discontinuing operation of that plant in 1976. In addition, improvement
of the existing plant facilities to meet stringent effluent quality
standards now required by the Texas Water Quality Board for plants
discharging to the West Fork of the Trinity River would be prohibitively
expensive, both in capital outlay and maintenance and operation costs.
Accordingly, it is proposed to abandon the plant and construct a sanitary
sewer interceptor, thereby, diverting all sewage from this area into the
Trinity Fiver Authority (TRA) West Fork Collector. The TRA is in
agreement with this concept and has submitted a contract to the City for
execution.
The contract provisions are briefly summarized as follows:
Right of Connection:
The City is given the right of connection to the TRA West Fork
Collector at such points as are mutually agreed to between the City
and TRA. The initial connection will be made on the TRA Collector
essentially due south of the CSIA Wastewater Treatment Plant, but
subsequent connections will be made to the TRA Collector at points
west of the initial connection as additional development occurs
within the City of Fort Worth between the GSIA property and the
Bell Helicopter Plant.
Metering:
The Authority will furnish, install, operate and maintain, at its
own expense, at each point of entry, the necessary equipment to
properly measure the wastewater discharged under this agreement
into the TRA system. Such meters and other equipment will remain
the property of the Authority, but the City shall have access to
metering equipment for inspection, examination and testing, as it
desires.

Quality:
The contract provides that the quality of sewage discharged into
the TRA system at the various points of entry will meet essentially
the same requirements as the City requires for industrial connections
to the Fort Worth system. The specific TRA requirements are spelled
out in the new contract.
Surcharges:
Surcharges will be levied for exceptionally high BOD or suspended
solids determinations made by the Authority on sewage discharged by
the City of Fort Worth to the TRA system at any of the various
points of entry, if such high values of these sewage characteristics
are found. The manner of determination and application of the
surcharge is essentially the same as that applied by the City of
Fort Worth to industrial connections to the Fort Worth sanitary
sewer system.
Industrial Connections:
The City would be required to provide notice to the TRA of any
industrial connections proposed to be made to the portion of the
Fort Worth sanitary sewer system discharging to the TRA system.
The type of information required is the same as that required by
the City of potential idustrial connections to its system, and this
information would merely be duplicated and provided to TRA under
the agreement.
Months Payments:
Monthly payments are to be made of the estimated City of Fort Worth
share of the TRA annual requirement of funds to operate, maintain
and make bond payments on the TRA system. The initial Fort Worth
share, based on Fort Worth's annual flow as a ratio to the total
annual flow anticipated, is estimated to be 0.13 per cent.
The current level of sewage flow to the GSIA Wastewater Treatment
Plant is only about 35,000 gpd, the flow equivalent to that generated
by approximately 350 people, and the current TRA charge for service
will be approximately $0.08 per 1,000 gallons of sewage delivered.
This would indicate a current annual charge of substantially less
than $1,000.
However, by 1980 the TRA charge for service is expected to peak at
about $0.30 per 1,000 gallons*, and the load generated by the area
served in Fort Worth could increase to as much as 1,400,000 gallons
per day. This would indicate an annual cost by that time of approx-
imately $150,000.
*TRA current and projected costs for sewage treatment are comparable to
those of the City of Fort Worth.

This dramatic increase in load generation would occur only if there
is substantial development on the GSIA property itself, and in the
substantially undeveloped areas in the City west of GSIA and east
of the Bell Helicopter Company plant, all of which would be afforded
interceptor sewer availability under the proposed TRA contract.
These other areas to the west would require construction of branch
sewers in addition to the one proposed to eliminate the GSIA plant
from operation, but they would serve an area many times larger than
the GSIA plant service area. In all, the proposed TRA contract
provides interceptor sewer to four separate drainage areas in
addition to the one containing the GSIA plant. (Exhibit "A")
The TRA charge for treating sewage generated in the areas to be
served under this contract is essentially equal to the City's
projected treatment costs at the Village Creek Wastewater Treatment
Plant, and use of the already in-place TRA collector system is the
least expensive method of providing sewer availability to the
service area as a whole.
The charges made by the City to customers in this area for sewer
service will be the same as charges made for similar service else-
where in the City.
Payments to be Operating Expenses:
The contract provides that the City payments to be made under the
contract are to be considered as operating expenses of the City's
waterworks and sanitary sewer systems and never to be considered as
an obligation on tax revenues.
Advisory Committee:
One member of the City Council and one City staff member are to
become members of the Advisory Committee for the TRA Central Waste-
water Treatment System, and, as members of that committee, to be
parties to the review of, and advisors to the Authority on, plans
for expansion, service improvements, budgetary and management
matters.
Authority's Right to Contract with Others:
The TRA authority reserves in the contract the right to contract
with others for provision of similar service by connection to the
TRA sanitary sewer system, but to guarantee that no contract will
be negotiated on terms more favorable than those in this contract
with the City.
Effective Date: Date of execution
Term of Contract: Contract will continue in effect until November 29,
2023.

On December 29, 1975, by approval of M&C G-2935, funds were provided for
construction of the 10,000 feet of 24-inch sanitary sewer main required
to bypass the GSIA Wastewater Treatment Plant and direct sewage from the
mains contributing to the plant to the Trinity River Authority West Fork
Collector. These funds in the amount of $500,000 were provided as part
of the recent bond sale.
Recommendations:
It is recommended that the "Certificate for Ordinance Authorizing Con-
tract", prepared by the staff, be approved for execution by the Mayor
and the City Secretary, and that the City Manager be authorized to
execute the contract on behalf of the City of Fort Worth.
