HomeMy WebLinkAboutOrdinance 7225 ORDINANCE NO, y AN ORDINANCE CLOSING AND VACATING THE EASEMENT ALONG THE WEST LINE OF LOTS 1 AND 2, GULF STATE SUBDIVISION, NORTHWARD FROM EAST FIRST STREET; AND PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the easement along the west line of Lots 1 and 2, Gulf State Subdivision to the City of Fort Worth, Tarrant County, Texas, northward from East First Street, and herein- after described by metes and bounds, be and the same is here- by extinguished, vacated, closed and permanently abandoned as an easement for public utilities: Parcel A• Beginning at the southwest corner of said Lot 1, said point being in the north line of East First Street; Thence North 0 degrees 30 minutes West with the west line of said Lot 1, 184.3 feet; Thence North 89 degrees 30 minutes East and parallel with an existing sanitary sewer line, 5.0 feet; Thence South 0 degrees 30 minutes East and parallel with said west line of Lot 1, 184.3 feet to a point in the south line of said Lot 1, and said north line of East First Street; Thence South 89 degrees 30 minutes West with said north line of East First Street and south line of Lot 1, a distance of 5.0 feet to the place of beginning. Parcel B+ Beginning at a point in the west line of said Lot 1, said point being 194.3 feet North 0 de- grees 30 minutes West along said west line from the southwest corner of said Lot l; Thence North 0 degrees 30 minutes West with the said west line of Lot 1 and the west line of said Lot 2, 650.5 feet to the northwest corner of said Lot 2, said point being in the south- easterly line of the Chicago, Rock Island & Gulf Railroad right-of-way; Thence North 53 degrees 53 minutes East with the north line of said Lot 2 and said southeaster- ly line of the Chicago, Rock Island & Gulf Rail- road right-of-way 6.15 feet; Thence South 0 degrees 30 minutes East and parallel with said west line of Lot 2 and Lot 1, 654.08 feet; Thence South 89 degrees 30 minutes West parallel with and 5.0 feet northerly from an existing sani- tary sewer line 5.0 feet to the place of beginning. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said easement above described is hereby re- leased and shall revert to the adjacent owners of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. Subject easement, acquired by dedication, is not in use except for a sani- tary sewer line which crosses the subject easement in an east-west direction on Lot 1. The Water Department notes that a 10' portion of this easement, collinear with the sanitary sewer line, will have to be retained as a utility easement to accommodate the existing sanitary sewer facilities. Reviewing City departments and private utility companies have no objections to this request except for the 10' section for an existing sanitary sewer line. The City Plan Commission has reviewed this request and recommends that an ordinance be adopted vacating subject easement except for the needs of the sanitary sewer line. Recommendation It is recommended that an ordinance be adopted vacating subject right-of- way as recommended by the City Plan Commission.
