AN ORDINANCE ORDERING A SPECIAL HOME-RULE ELECTION
IN THE CITY OF FORT WORTH, TEXAS, TO BE HELD ON
TUESDAY, THE 8TH DAY OF APRIL, 1975, FOR THE PURPOSE
OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY,
FOR ADOPTION OR REJECTION, PROPOSED AMENDMENTS TO
THE EXISTING CHARTER OF THE CITY OF FORT WORTH;
AUTHORIZING THE CITY COUNCIL TO DESIGNATE THE
PLACES AT WHICH SAID ELECTION IS TO BE HELD; PRE-
SCRIBING PRESIDING OFFICERS THEREOF; AND DECLARING
AN EMERGENCY.
WHEREAS, the City Council of the City of Fort Worth, in
the exercise of the sound discretion reposed in it by the
Constitution and laws of this State, and more particularly
Articles 1165 through 1174, inclusive, Vernon's Texas Civil
Statutes, relating to the amendment of city charters by cities
having more than five thousand (5,000) inhabitants, deems it
wise and expedient to submit proposed amendments to the exist-
ing charter of said City, hereinafter set forth, at a special
election to be held in said City on Tuesday, the 8th day of
April, A. D. 1975; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That a special election be held in the City of Fort Worth,
Texas, on Tuesday, the 8th day of April, 1975, for the purpose
of submitting to the qualified voters of said City, for adop-
tion or rejection, the following proposed amendments to the
existing Charter of the City of Fort Worth:
PROPOSED AMENDMENTS
I.
Shall Section 1, Chapter III, The City Council, of the
Charter of the City of Fort Worth be amended so that same shall
hereafter read and be as follows:
"Section 1. The powers of the City Govern-
ment shall be vested in a body to be known as
the city council, composed of nine members.
Their term of office after the first election
under this amendment shall be for a period of
four years and until the election and qualifi-
cation of their successors; provided that at the
first election after the adoption of this amend-
ment, there shall be elected a full Council, four
of whom shall hold office for a period of only
two years and four of whom shall hold office for
a period of four years. The Mayor shall be elected
and hold office as hereinafter provided in Section 2.
The Council shall determine by lot which members of
the said body shall serve for the two year and four
year periods, respectively. Two years after the
first election, there shall be held another election,
at which the successors to the four two-year Coun-
cilmen shall be chosen. Thereafter, elections shall
be held every two years to elect members of the
City council whose terms are expiring."?
II.
Shall Section 1, Chapter IV, Method of Nominating and
Electing Members of the City Council, of the Charter of the
City of Fort Worth be amended so that same shall hereafter
read and be as follows:
"Section 1. Councilmen -- Eligibility -- As
provided by Article 1.05-1, V.T.C.S., as amended,
only qualified electors under the laws of Texas
who are residents of the City and twenty-one (21)
years of age or more shall be eligible to hold the
office of Councilman or Mayor."?
III.
Shall Section 3, Chapter IV, method of Nominating and
Electing Members of the City Council, of the Charter of the
City of Fort worth be amended so that same shall hereafter
read and be as follows:
"Section 3. With the exception of Place No. 1
to be held by the Mayor as provided for in Section 2
of Chapter III of this Charter, the City Council
shall provide by ordinance for eight (8) single mem-
ber districts so that with the exception of the Mayor,
one member of the City Council shall be elected from
each of such defined districts by the voters resid-
ing therein, and each candidate therefrom shall be

a qualified elector of the City and shall have re-
sided in the district from which he seeks election
for a period of at least six months next preceding
the election.
"The City Council shall, as often as census
data is available, determine as nearly as practica-
ble the population of the respective districts and
shall, by ordinance, revise the boundaries of any or
all of said districts to maintain a substantial
equality of population in each. Within sixty (60)
days after passage of this amendment, the City Coun-
cil shall, by ordinance, designate the original dis-
trict limits."?
IV.
Shall Sections 1 through 8, inclusive, of Chapter VII,
Corporation Court, of the Charter of the City of Fort Worth
be amended so that said Chapter shall hereafter read and be
as follows:
"Section 1. Municipal Court -- Municipal
Court System -- There is hereby established and
created a municipal court system for the City of
Fort Worth, which shall have jurisdiction and au-
thority in cases arising under ordinances of the
City and applicable statutes of the State of Texas.
"Section 2. This Chapter is hereby declared
to be cumulative of any laws that may now or here-
after be passed by the Legislature regulating or
increasing the jurisdiction of the municipal courts
in cities of the grade and size of the City of Fort
Worth."?
V.
Shall Section 1, Chapter VIII, Administrative Depart-
ments to Be Controlled and Administered by the City Manager,
of the Charter of the City of Fort Worth be amended so that
same shall hereafter read and be as follows:
"Section 1. Number of Administrative Depart-
ments to Be Controlled and Administered by the
City Manager -- There is hereby created and placed
under control of the City Manager six administra-
tive departments of the City Government as follows:

(1) Department of Finance
(2) Department of Police
(3) Fire Department
(4) Department of Public Works
(5) Department of Public Health
(6) Water works Department
"The City Council shall have power to estab-
lish by ordinance such other departments, divisions
and offices as it deems necessary for the efficient
operation of the municipal government. The City
Council may discontinue any department or office
established by ordinance and may prescribe, com-
bine, consolidate, distribute or abolish the func-
tions and duties of departments, divisions or of-
fices. No administrative department, division or
office created by ordinance, and no consolidation
as hereinbefore provided, shall be established or
discontinued until the recommendation of the City
Manager thereon shall have first been heard by the
Council.
"The Directors of the departments appointed by
the City Manager shall be immediately responsible
to the City Manager for the administration of their
departments, including the preparation of reports
and recommendations concerning their departments
as required by the City Manager."?
VI.
Shall sections 1 through 9, inclusive, of Chapter IX,
Department of Finance, of the Charter of the City of Fort
Worth be amended so that said Chapter shall hereafter read
and be as follows:
"CHAPTER IX.
DEPARTMENT OF FINANCE
"The City Council is authorized to provide by
ordinance for the creation of a Department of
Finance, which department shall be charged with
the administration of the financial affairs of the
City, including the keeping and supervision of all
accounts, the custody and disbursement of City
funds and moneys according to ordinances and regu-
lations of the City Council, the assessment and col-
lection of all taxes, including special assessments,
the issuance of licenses and the collection of li-
cense fees, and such other duties as the City Coun-
cil may, by ordinance, require."?

VII.
Shall Section 11, Chapter X, The Budget and Financial
Procedure Relating Thereto, of the Charter of the City of
Fort Worth, which section reads as follows:
"Section 11. Limitations on Expenditures
Contained in Sections 8 and 10 of this Chapter
Not to Apply to Purchases by Park Board and
Recreation Board in Certain Extraordinary Cases
When Approved by the City Council -- The limita-
tions and restrictions contained in Section 8 and
10 of this Chapter shall not be applicable to the
Park Board where an advantageous opportunity is
presented to said Board to purchase an additional
park for any year upon a cash payment out of the
appropriation set apart to the Park Department for
that year and the contract or agreement to pay the
balance of the purchase price for the said park in
not to exceed ten annual installments; provided,
that such contemplated purchase of park property
shall first be reported to the City Council and ap-
proved by the Council. When so approved, the said
purchase may be consummated, and thereafter pro-
vision shall be made in the annual budget for the
payment of the annual installment with interest
thereon, to be charged against the annual appro-
priation for such department.
"The said restrictions and limitations shall
not apply to an expenditure on the part of the
Recreation Board for an improvement, such as a
swimming pool, playgrounds or golf course, or other
improvements of a permanent character, beyond the
appropriation made for such purpose in the annual
budget, where the Council shall deem it advantageous
to the interest of the said department to authorize
the creation of an indebtedness for such character
of improvements, covering a period of not to exceed
ten years, in annual payments, after applying there-
on the amount provided therefor in the annual budget
for the year in which such outlay is made; but such
investment may be made by the Recreation Board when
approved and ordered by the City Council. Each year
thereafter the said annual installment with inter-
est shall be provided for and paid out of the annual
budget appropriation for said department.",

VIII.
Shall Sections 1 through 7, inclusive, of Chapter XI,

Department of police., of the Charter of the City of Fort
Worth be amended so that said Chapter shall hereafter read
and be as follows:
"CHAPTER XI.
DEPARTMENT OF POLICE
"The City Council shall provide by ordinance
for the establishment and regulation of a Depart-
ment of Police."?
IX.
Shall Sections 1 through 9, inclusive, of Chapter XII,
Fire Department, of the Charter of the City of Fort worth be
amended so that said Chapter shall hereafter read and be as
follows:
..The City Council shall provide by ordinance
for the establishment and regulation of a Fire
Department."?
X.
Shall Sections 1 through 5, inclusive, of Chapter XIII,
Department of Engineering, of the Charter of the City of Fort
Worth be amended so that said Chapter shall hereafter read
and be as follows:
"CHAPTER XIII.
DEPARTMENT OF PUBLIC WORKS
"The City Council shall provide by ordinance
for the establishment and regulation of a Depart-
ment of Public Works, which department shall be
in lieu of the 'Department of Engineering' formerly
provided for in Chapter XIII of the Charter of the
City of Fort Worth."?
Xi.
Shall Sections 1 through 3, inclusive, of Chapter XIV,
Water Works Department, of the Charter of the City of Fort
Worth be amended so that said Chapter shall hereafter read
and be as follows:
"CHAPTER XIV.
WATER WORKS DEPARTMENT
"The City Council shall provide by ordinance
for the establishment and regulation of a Water
Works Department, which department shall have
jurisdiction and control over the water and sani-
tary sewerage systems of the City of Fort Worth."?
XII.
Shall Sections 1 through 19, inclusive, of Chapter XV,
Department of Public Health and Welfare, of the Charter of
the City of Fort worth be amended so that said Chapter shall
hereafter read and be as follows:
"CHAPTER XV.
DEPARTMENT OF PUBLIC HEALTH
"The City Council shall provide by ordinance
for the establishment and regulation of a Depart-
ment of Public Health."?
XIII.
Shall Sections 1 through 11, inclusive, of Chapter XVII,
Department of Public Libraries, of the Charter of the City
of Fort Worth be amended so that said Chapter shall hereafter
read and be as follows::
.CHAPTER XVII.
DEPARTMENT OF PUBLIC 'LIBRARIES
"The City Council shall provide by ordinance
for the establishment and regulation of a Department
of Public Libraries."?
XIV.
Shall Section 4, Jurisdiction of Park Board -- Scope of
Activities, of Chapter XVTTT, Department of Public Parks,
and Section 4, Powers and Duties of Public Recreation Board
***, of Chapter XTX, Department of Public Recreation, and
Section 42 of Chapter XXVTTT, Miscellaneous, of the Charter
of the City of Fort Worth be repealed and a new chapter sub-
stituted therefor to read as follows:

"CHAPTER XVIII.
PARK AND RECREATION DEPARTMENT
"The City Council shall provide by ordinance
for the establishment and regulation of a Park
and Recreation Department."?
XV.
Shall Chapter XXIV, Civil Service, of the Charter of
the City of Fort Worth be repealed and a new chapter sub-
stituted in lieu thereof to read as follows:
"CHAPTER XXIV.
DEPARTMENT OF PERSONNEL AND
CIVIL SERVICE
"Section 1. organization -- The City Council
may provide by ordinance for the establishment,
organization and regulation of a Department of
Personnel and Civil Service and a Civil Service
Board or commission.
"Section 2. No person in the employ of the
City or seeking admission thereto shall be appointed,
reduced or removed, or in any way favored or dis-
criminated against because of political or religious
opinions or affiliations. No officer or employee of
the City shall, directly or indirectly, solicit or
receive or be in any manner concerned in soliciting
or receiving any assessment, subscription or contri-
bution for any political party or for any political
purpose whatever. No person in the employ of the
City shall take part in political management or
affairs, or in political campaigns, further than to
cast his vote or express privately his opinion.
"Section 3. Relating to City Councilman Accept-
ing Different office and Providing for Forfeiture
of offices and Positions of Aspirants for office --
No person elected to the City Council shall, during
the term for which he was elected, be appointed to
any office or position in the service of the city.
if a member of the Council shall become a candidate
for nomination or election to any public office,
other than that of his present place in the Council,
he shall immediately forfeit his place in the Council;
and any appointive officer or employee of the City
who shall become a candidate for nomination or elec-
tion to any public office shall immediately forfeit
the office or employment held under the City.
XVI.
Shall Section 2, Chapter XXV, Assessment and Collection
-a-
of Taxes -- Provisions Relative to Issuance and Sale of
Bonds, of the Charter of the City of Fort Worth be amended
so that same shall hereafter read and be as follows:
"Section 2. Board Of Equalization -- The
City Council shall each year prior to the first
day of July appoint a Board of Equalization, to
be composed of three members to be selected by
the Council, who may or may not be members of the
Council, and who are taxpaying citizens, well ac-
quainted with real estate values, one of whom shall
be designated as Chairman of the said Board and
another as Vice-Chairman. The said Board shall con-
vene as near as practicable on the first day of July
and continue their labors until their said work is
completed, but not to continue longer than the 15th
day of the August following. it shall be the duty
of the Council, as soon as the assessment of rolls
of taxes due the City are completed, to refer the
same to the Board of Equalization, whose duty it
shall be to equalize the taxes assessed on said
rolls and to make all necessary corrections and ad-
justments to that end; and, in addition to the
powers granted them by this Charter, they shall also
have the same powers and perform the same duties as
the County Commissioners' Courts of this State in
regard to the assessment of property for taxation
and the equalization thereof, and shall be governed
in their procedure and acts in this respect as now
provided by the laws of this State relating to the
equalization of State and County taxes by said Com-
missioners' Courts. in addition to the foregoing,
the said Board shall have the power, when sitting,
to compel the production of all books, documents,
stocks, bonds and other papers pertinent to the in-
vestigation, to be produced before them in the inves-
tigation of the taxable values of any person or per-
sons, firm or corporation having or owning property
within the corporate limits of the City subject to
taxation. Said Board shall have full power to cor-
rect any mistake or injustice or inequality in the
assessment of property, the rendition of same, or in
the payment of taxes, and shall have power to correct
such mistake and make redress therefor; and the said
Board may add to the rolls any property omitted there-
from, either for the current year or for previous
years, and lawfully taxable within said City. A
majority of the said Board shall constitute a quorum
for the transaction of business. The City Secretary
or his assistant shall he ex-officio the clerk of
said Board. The members of the Board selected by
the City Council, while serving on the said Board of
Equalization, shall receive such compensation as may
be provided for them by the Council. immediately
upon completion of said work, the said Board of Equal-
ization shall place their certificate upon the said

Rolls, with a brief statement of the work done by
them, and return the said rolls to the Council,
who shall thereupon either approve the said rolls
as returned to them by the Board, or make such cor-
rections and changes therein as they may deem ad-
visable, and thereupon adopt the same as the assess-
ment rolls to be used for the collection of taxes
for the current year."?
XVII.
Shall Section 23, Chapter XXVIII, Miscellaneous, of
the Charter of the City of Fort Worth be repealed and Sec-
tion 14, Chapter XXV, Assessment and Collection of Taxes ***,
of the Charter of the City of Fort Worth be amended so that
same shall hereafter read and be as follows:
"Section 14. Rate of Taxation -- Real and
Personal Property Defined -- The City Council shall
have power to levy for general purposes an annual
ad valorem tax on all real, personal and mixed
property within the territorial limits of the City
of Fort Worth not exempt from taxation by the Con-
stitution and laws of the State of Texas, based
upon the fair cash value thereof, to the extent
of the constitutional limit now permitted by the
Constitution of the State of Texas to cities of
over five thousand population, the same being Two
Dollars and Fifty Cents ($2.50) on each one hundred
dollars of valuation. The meaning of the term
'real property, ' as used in this Chapter, shall be
construed to mean lots, lands, and all buildings
or machinery and structures of every kind located
upon or affixed to the same; and the meaning of the
term 'personal property, ' as used in this Chapter,
shall be construed to include all household furni-
ture, money, goods, chattels and capital, and all
franchises subject to taxation under this Chapter
of the Charter, all stocks of corporations, moneyed
or otherwise, and generally all property which is
not real, including all buildings and improvements,
machinery and fixtures of every kind upon lots and
lands not owned by the owner of the said improvements."?
XVIII.
Shall Section 15, Chapter XXV, Assessment and Collec-
tion of Taxes -- Provisions Relative to Issuance and Sale
of Bonds, of the Charter of the City of Fort Worth be amended
so that same shall hereafter read and be as follows:

"Section 15. Delinquent Taxes -- Interest --
The taxes herein and hereby authorized to be levied
shall become due and payable in two equal annual
installments. The first installment, which amount
shall be fifty per cent of the total sum of the
taxes due and payable for the current year, shall
be due and payable on the first day of October of
each year, and the second installment, which amount
shall be the remaining fifty per cent of the total
sum due and payable in taxesfor the current year,
shall become due and payable on the first day of
April of the ensuing year. No demand for such taxes
shall be necessary in order to insure or enforce
their collection; but it is made the duty of the
taxpayer to attend at the office of the Assessor
and Collector of Taxes and make payment of such taxes
in cash as herein provided. The first installment
of taxes required to be paid by virtue of this Charter
for the current year shall become delinquent on the
first day of December of such year, and the second
installment of taxes required to be paid by virtue
of this Charter for the current year shall become
delinquent on the first day of June next succeeding.
Should any taxpayer. permit his taxes to become de-
linquent, that is to say, shall fail or refuse to
pay the first installment, and said installment be-
ing fifty per cent of the total amount of taxes due
for the current year, before the first day of Decem-
ber of such current year as above specified, then
and in that event the second installment shall also
immediately become due and delinquent and interest
shall attach to the payment of such taxes at the
rate of one per cent per month, or fraction thereof,
for each month thereafter; and should any taxpayer
pay the first installment of his taxes as hereinabove
provided but should permit the second installment of
his taxes to become delinquent, that is to say, shall
fail or refuse to pay said second installment before
the first day of June of the next ensuing year as
above specified, then interest shall Attach to the
payment of the second installment at the rate of one
per cent per month, or fraction thereof, on each month
thereafter, and in addition to the interest above de-
scribed, such delinquent taxpayer shall be subject to
the payment of all costs and expenses that may be in-
curred in the advertisement of such delinquent property
and the collection of said taxes through any of the
methods prescribed by this Charter or any of the stat-
utes or laws of the State of Texas."?
XIX.
Shall Section 16, Chapter XXV, Assessment and Collection
of Taxes -- Provisions Relative to Issuance and Sale of Bonds,

of the Charter of the city of Fort worth, which section
reads as follows:
"Section 16. Poll Taxes -- The City Council
shall have power to levy annually and collect a
poll tax of one dollar of and from every inhabitant
in the City of Fort Worth over the age of twenty-
one years, and under sixty years of age, who shall
be a resident therein on the first day of January
of the year for which such tax may be levied, and
the same shall go to the public school fund, unless
otherwise directed by the City council.",

SECTION 3.
That said election shall be held and conducted in the
manner and within the hours prescribed for general elections
by the laws of the State of Texas insofar as they may be
applicable, and all persons qualified to vote in said City
under the laws of this State regulating general elections
shall be allowed to vote.
SECTION 4.
That each proposed charter amendment shall be separate
and distinct so that the voters shall pass upon each one
separately and apart from another and so that each voter may
vote "Yes" or "No" on any amendment or amendments without
voting "Yes" or "No" on all of said amendments.
That absentee voting shall be on paper ballots, and such
ballots shall conform to the requirements of Article 6.05 of
the Election Code of the State of Texas, as amended, which
provides that a square shall be placed beside the proposed
amendment, in which the w ter is requested to place an "X"
or other clear mark to indicate the way he wishes to vote,
but which also provides that failure of a voter to mark his
ballot in strict conformity with the instructions on the ballot
shall not invalidate the ballot, and the ballot shall be
counted if the intention of the voter is clearly ascertainable,
except where the law expressly prohibits the counting of the
ballot. It is specifically provided that the election officers
shall not refuse to count a ballot because of a voter having
marked his ballot by scratching out the amendment for which he
does not wish to vote.
The ballot shall include substantially the following:

SECTION 5.
That voting machines approved by the Commissioners,
Court of Tarrant County, Texas, if available, may be used
at the charter amendment election on the 8th day of April,
A. D. 1975, in strict compliance with the applicable pro-
visions of Article 7.14 of the Election Code of the State
of Texas, as amended, and all other applicable provisions
of such Election Code.
SECTION 6.
That the official ballots to be used shall be in com-
pliance with applicable provisions of Article 6.05 of the
Election Code of the State of Texas, as amended, and shall
have written or printed thereon the following:

SECTION 7.
That the City Secretary is hereby ordered and directed
to prepare and issue ballots for absentee voting and for the
special election and to stamp same "Official Ballot, " on which
ballots shall be printed the proposed charter amendments here-
inabove set forth.
SECTION 8.
That the City Secretary shall furnish election officials
said ballots, together with any other forms, blanks or in-
structions in accordance with the Charter of the City of Fort
Worth, Texas, and the laws of the State of Texas insofar as
same are applicable, and the provisions of this ordinance
unless a court of competent jurisdiction orders otherwise.
SECTION 9.
That the way and manner of holding this election, the
notice to be given therefor, the polling places, the personnel
of the officers, precinct judges and substitutes therefor who
are to hold the same, and all details connected with the hold-
ing of the election shall be determined and arranged by the
City Council and administered under the direction of and by
the City Secretary,
SECTION 10.
That this ordinance shall constitute the election order
for such special election, a substantial copy of which shall
serve as the notice of election under Article 1170 of the Re-
vised civil Statutes of the State of Texas.

SECTION 11.
That the City Secretary is hereby authorized and directed
to cause notice of said election to be given by posting a
substantial copy of this election order in each of the election
precincts of said City and also at the City Hall; and that
this notice of said election shall also be published on the
same day in each of two (2) successive weeks in a newspaper
of general circulation published within said City, the date
of the first publication to be not less than fourteen (14)
days prior to the date set for said election, and the City
Secretary shall see that proper publication is made and proper
notice of this election is given, in full conformity with the
applicable statutes of the State of Texas.
SECTION 12.
That the proposed amendments as hereinabove set forth,
if approved by a majority of the qualified voters voting upon
said amendments, shall become a part of the Charter of the City
of Fort Worth as soon as an official order has been entered
on the Council Minutes of said City by the City Council there-
of, declaring the same adopted.
SECTION 13.
That this ordinance, election order and notice shall
take effect and be in full force and effect from and after
the date of its passage, and it is so ordained.
