AN ORDINANCE PROVIDING THAT THE PORTION OF THE ALLEY IN BLOCK 14, EVANS-PEARSON-WESTWOOD ADDI- TION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, ADJACENT TO LOTS 3, 4, 5 AND 27, BE ABAN- DONED, VACATED AND CLOSED; PROVIDING FOR THE RE- VERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the portion of the east-west alley in Block 14, Evans-Pearson Westwood Addition to the City of Fort Worth, Tarrant County, Texas, adjacent to Lots 3, 4, 5 and 27, extending from Greenleaf Street eastward to the west line of the north-south alley, be and the same is hereby vacated, closed and permanently abandoned as an alley or public thorough- fare of any kind or character whatever. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said portion of the alley is hereby released and shall revert to the adjacent owner of the fee as provided by law, save and except that an easement is retained for the ex- isting sanitary sewer. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. APPROVED AS TO FORM AND LEGALITY: City Attorney BILARDI City of Fort Worth, Texas UN� n Q BINSON Mayor and Council Communication GRAHAM WALLS HANCOCK HINEWATE REFERENCE SUBJECT: Vacation of Alley in Block 14 PAGE NUMBER Evans-Pearson-Westwood Addition Ior _ REED H A^Y+/16/73 PZ-556 V ILKES KI BRO Williams Tool Saless Inc. , has requested that the City vacate a portion of the east-west Alley in Block 14, Evans-Pearson-Westwood Addition, adjacent to Lots 3, 49 5, & 27 a width of 10 feet and a length of 130 feet from Greenleaf Street eastward to the west line of the north-south Alley, as shown on the attached map. Subject right-of-way, acquired by dedication, is unimproved. There is an existing sanitary sewer located therein. The reviewing City departments and private utility companies have no objections to this request provided the vacated right-of-way is replatted with adjoining property and retained as an easement for the existing sanitary sewer. A satisfactory replat includigg :�ecessary easements has been submitted to the City by the applicant. The ity Plan Commission has reviewed this request and recommends adoption' ©f an ordinance vacating the public right-of- way as requested. Recommendation It is recommended that an ordinance be adopted vacating subject right-of-way as recommended by the City Plan Commission.
