AN ORDINANCE AMENDING SECTIONS 37-23, 37-25
AND 37-26 of CHAPTER 37 OF THE FORT WORTH
CITY CODE (1964) WHICH CHAPTER REGULATES
WATER AND SEWER SERVICE IN THE CITY OF FORT
WORTH BY INCREASING CHARGES; REVISING MIN-
IMUM CHARGES; MAKING THIS ORDINANCE CUMU-
LATIVE OF PRIOR ORDINANCES; REPEALING ALL
ORDINANCES AND PROVISIONS OF THE FORT WORTH
CITY CODE IN CONFLICT HEREWITH; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A PENALTY AND
PROVIDING AN EFFECTIVE DATE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Paragraph (c) of Section 37-23 of Chapter 37
of the Fort Worth City Code (1964) as amended, is here-
by amended and, after having been so amended, shall
hereafter read as follows:
" (c) For all customers requesting the
setting of a meter or the activating of a
water service, a $3.00 service charge shall
be made."
SECTION 2.
That Section 37-25, Water And Sewer Rates Within The
City, of Chapter 37 of the Fort Worth City Code (1964) as
amended, is hereby amended and, after having been so
amended, shall hereafter read as follows:
"Sec. 37-25. Water and Sewer Rates Within City.
" (a) The following schedules of rates per
month, or fraction thereof, shall be the charges
to all persons, as herb in defined, for furnishing
water to water consumers and for rendering sanitary
sewerage service to premises located within the
city:

schedule C, based upon an estimated
water use to determine such monthly charge,

" (c) Charges paid by municipal departments
of the city for water service only shall be:
55% of Rate B beginning October 1, 1965,
70% of Rate B beginning October 1, 1966,
65% of Rate B beginning October 1, 1967 and
100% of Rate B beginning October 1, 1968
"Charges paid for sewerage service shall be
at rates in effect.
" (d) The following schedule of rates per
month shall apply for furnishing raw water to
consumers located within the city:

SECTION 3,
That paragraph (a) of Section 37-26, Connection Charge,
of Chapter 37 of the Fort worth City Code (1964) as amended,
is hereby amended and, after having been so amended, shall
hereafter read as follows:
"Sec, 37-26. Connection Charge.
" (a) A minimum charge per month, or fraction
thereof, shall be made for each connection with
the water mains or sewer mains of the city water-
works. This charge shall be based on the size of
the meter through which water is furnished, re-
gardless of source, and shall be as follows:

"The amount of water allowed for water and sewerage
for the respective size of the meter is shown above.
Charges for water furnished through meters shall be made
at rates in effect, and each meter shall be read and billed
separately.

" (1) Fire line meters. The monthly charges for
connections to unmetered automatic sprinkler systems
or other fire lines installed and used for fire pro-
tection only shall be one dollar and thirty five
cents per inch of diameter of the fire service connec-
tion. When it is determined that water has been or
is being used through or from an unmetered automatic
sprinkler system for purposes other than for fire
fighting, the consumer shall pay the full cost of a
meter installation on the fire line.
"All fire protection systems used exclusively for
fire-fighting purposes and provided with outlets other
than standard closed sprinkler heads shall be provided
with detector-type check valves at customer's cost
before connection with the water mains of the city.
In case it is determined that water is used through
such detector check valves for purposes other than for
fire-fighting, the detector check valve installation
shall be replaced with a standard meter with the con-
sumer paying the full cost of the meter installation.
" (2) Meter sizes. Only one five-eighths inch
by three-fourth inch meter shall be attached to and
served by a three-fourths inch tap. No more than two
five-eights inch by three-fourths inch or one one inch
meter shall be attached to and served by a one inch
tap. Not more than one one and one-half inch or three
five-eighths inch by three-fourths inch or three one
inch meters shall be attached to and served by a one
and one-half inch tap. Not more than one two inch,
four one inch or six five-eighths by three-fourths
inch meters shall be attached to and served by a two
inch tap.
" (3) Seasonal meters. Customers using a
separate water meter for one or more seasonal pur-
poses (such as lawn watering, but not being limited.
thereto) shall pay the minimum monthly charge pre-
scribed herein for such meter throughout the year,
whether such service is active or not. If such
service is disconnected at the request of the cus-
tomer and the customer requests that the service be
reconnected within the next twelve months, a re-
connection charge shall be paid equivalent to the
monthly minimum charge times the number of months
that such service has been disconnected."
SECTION 4.
That this ordinance shall repeal every prior ordinance
and provision of the Fort Worth City Code in conflict here-

with but only insofar as the portion of such prior
ordinance or provision shall be in conflict, and as to
all other ordinances or provisions of the Fort Worth
City Code not in direct conflict herewith, this ordinance
shall be and is hereby made cumulative.
SECTION 5,
It is hereby declared to be the intention of the
city council that the sections, paragraphs, sentences,
clauses and phrases of this ordinance are severable, and
if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared unconstitutional by the
valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, para-
graphs and sections of this ordinance, since the same
would have been enacted by the city council without the
incorporation in this ordinance of any such unconstitution-
al phrase, clause, sentence, paragraph or section.
SECTION 6.
That the violation of any provision of this ordinance
or of the Fort Worth City Code relating to water and sewer
service shall be deemed an offense and punishable by a
fine not exceeding Two Hundred Dollars ($200) , and each
violation thereof, and each day on which there is a failure
to comply with the terms of this ordinance shall be and is
hereby declared to be a distinct and separate offense and
punishable as such.

SECTION 7.
That this ordinance shall be in full force and
effect from and after September 1, 1970 and it is so
ordained.

Approval of the Cedar Creek pipeline, construction of the Rolling Hills treat-
ment plant and continuing increases in other costs of the Water and Sewer
' ' Utility necessitate an increase in rates for water and sewer service beginning
in October, 1970. The proposed increase, for the average customer, will amount
to approximately $1.10 per month of which 35 cents is for increased raw water
costs and 75 cents will cover other increased costs of the water and sewer
utility. It is proposed to increase minimum bills from $2.00 per month to
$2.40 per month. The first increment in the rate schedule will increase by
nine cents per 100 cubic feet of water used; from 37 cents to 46 cents. Of
this increase, 3.5 cents is for the increased cost of raw water and 5.5 cents
for all other cost increases.
The proposed rate increase is the first rate change since October, 1965. In-
creased costs which must be paid by the Water and Sewer Department are illus-
trated by changes in the consumer price index since that date. In October,
1965, the consuler .p rice index was 110.4 while in May, 1970 it stands at 134.6,
an increase of 14.2 points.
Consideration of the rate change at this time, even though it does not become
effective until October is recommended to permit scheduling of the September
bond sale for the Cedar Creek pipeline and w complete budget preparation for
the 1970-71 fiscal year.
More detailed information concerning the proposed rate increase follows.
Raw Water Rate Increase
Contract. No. 4200 between the City of Fort Worth and the Tarrant County Water
Control and Improvement District No. 1 provides that beginning with the date
when the first bonds are sold by the District for construction of the Cedar
Creek pipeline the City shall pay eight cents per 1000 gallons for all raw
water used. The present payment to the District for raw water is 4 cents
per 1000 gallons.
On May 5, 1969, the City Council adopted a resolution requesting the Water Dis-
trict to proceed with the construction of the Cedar Creek pipeline so that it
Will be completed early in 1973.
In order to meet construction schedules for the pipeline, the Water District ,
plans to sell the first bonds for construction of the pipeline in September,
1970, and the first increased payment for raw water by the City will be due in
October for water used during September. In order to compensate for system
losses, a rate increase of 3.5 cents per 100 cubic feet (4.67 cents per 1000
gallons) is required to provide sufficient revenues to offset increased raw
water costs. It is proposed to increase the water portion of the water and
sewer rate schedule 3.5 cents per 100 cubic feet for all steps in the rate
structure. This represents a uniform recovery of these increased costs from
all water customers.

Untreated Water Sold by the City
A small number of customers purchase untreated water from Lake Worth, Lake
Worth conduits and the Clear Fork of the Trinity River. The proposed increase
in charges for untreated water is shown in the following tabulation.

Increase in Regular Water and Sewer Rate
Projections of expenditures and revenues under the existing rate schedule for
water and sewer service for the next 5 years show substantial dificits begin-
ning in 1970-71. Based on proposed bond sales to pay for new and expanded
water and sanitary sewage treatment plants plus additions to the collection and
distribution systems the projection shows that without the recommended rate
increase effective next year, sufficient revenue coverage will not be available
to permit debt financing after 1972.
The last water and sewer rate increase was in October, 1965. Since that time,
there has been a substantial increase in the cost of operating the water and
sanitary sewer systems due to inflation. These increases have included the
cost of money (higher interest charges for bonds) , materials and manpower. For
example, in 1965 water revenue bonds required interest payments of 3.2067 per
cent. Bonds sold early in 1970 required a net interest rate of 6.1426 per cent.
Representative price increases for various materials and supplies required by
the Water Department follow.

Increased Costs of Sewage Treatment and Improved Sewage Effluent
In addition to the higher costs due to inflation as outlined above, the operat-
ing costs of sanitary sewage operations are being increased as a result of ac-
tion taken by the Texas Water Quality Board to improve the quality of sewage
effluent. The estimated cost of chlorine for sewage effluent at the Riverside
treatment plant for 1970-71 is $30,000. This cost will more than double when
chlorination of the Village Creek plant effluent begins upon completion of the
expanded plant facilities. Other cost increases will result from the change
of the discharge of settling basin sludge at the Holly Water Treatment plant
and increased emphasis on reducing infiltration and overflows from sewer lines.
Proposed Rate Increase
In addition to the 3.5 cents per 100 cubic feet increase for raw water, it is
proposed to increase the regular water and sewer service rate Schedule A by
15 per cent. Charges for water service only and sewer service only will also
be increased proportionately.
It is anticipated that this increase in rates will be adequate to finance the
current standard of operation of the two systems and to provide sufficient bond
funds for major construction projects for at least three years , assuming in-
flationary pressure eases somewhat during this period.
Monthly minimum charges for meters of various sizes are proposed to be revised
in proportion to the proposed rate schedule.
It is proposed to delete the requirement in the rate ordinance of a flat rate o
$1.75 monthly minimum sewer charge for residential customers and $3.00 for com-
mercial customers who have unmetered private wells. The monthly sewer charge
for these customers will be estimated in accordance with the new sewer only
charge. At present there are 9 residential accounts and 41 commercial accounts
whose private wells are not metered. Meters are required on private wells used
by customers with industrial waste permits.
The proposed rate schedules and monthly minimum charges are outlined on the
following pages.

The proposed 15 per cent increase plus the raw water increase will amount to
an increase in water and sanitary sewer rates of 20 per cent for the smallest
user and up to approximately 37 per cent for the largest users. The monthly
charge for water and sanitary sewer service for the average quantity of water
(approximately 1000 cubic feet or 7500 gallons) used by residential customers
will increase 22.2 per cent or $1.10 per month.
Comparison of Proposed Rates with Other Cities
Water and sanitary sewer charges for 1000 cubic feet (7500 gallons) under the
proposed rates have been compared with similar charges for customers in Dallas ,
Oklahoma City, Houston, and San Antonio.

(1) All sewer costs are not financed by the monthly service charge
(2) Charges are net, i.e. , do not include 10 per cent charge for

It is noted that the proposed rate is less than the above cities which have
surface water supplies , that is , Dallas and Oklahoma City. The charges are
higher than those cities having substantial ground water supplies , that is,
Houston and San Antonio.
Effective Date of Proposed Rate Increase
It is proposed that the ordinance increasing the proposed rate schedules be
adopted with the increase effective for all bills issued after October 1, 1970.
The proposed increase in water rates is submitted to the City Council for its
consideration at this time so that budget planning, construction scheduling
and regional bond sales can be more accurately determined based upon estimates
of revenues for the 1970-71 and succeeding fiscal years.
New Water Account Service Charge
The City Code provides a $3.00 transfer charge for all customers requesting
a transfer of service from one location to another. There is not a service
charge for opening an account by a new customer.
Two local utilities have service charges for new accounts as de--
scribed below:

Under present procedures, a new water customer moving from an existing cus-
tomer location pays a transfer charge whereas a new customer moving from a
location of different ownership is not charged. A more equitable procedure
would be to apply the service charge of $3.00 to all new accounts and delete.
the transfer charge. The estimated average cost to open a new account for
office procedures and field operations is $2.90.
Approximately 25,000 new accounts are processed annually and approximately
5,000 are transfer accounts. The proposed service charge of $3.00 for new
accounts would provide an increase in annual revenues of approximately
$60,000.
Recommendation
It is recommended the attached ordinance be adopted increasing water and
sewer rates as described above.
