SECTION 1. The said city heretofore duly entered
into a contract with the ICetropolitan Construetior Company to
improve Hurley .'venue between the South Line of -1yrtle Itreet
d13H ,Opi ling D �g4ckm_ ;ng Street, and thereafter said
P.ietropolitan Construction Company duly sold, assigned : nd
transferred all its rights, title , ;nd interest in : nd to said
contract to Roach & IJanigan, a partnership, who a.ssuned .al 4
the obligations of said Construction Company under said con-
tract; which assignment was duly approved by said city by re-
solution adopted January 7, 1911; and all of he official pro-
ceedings prescribed by the charter and ordinances of said
city have hereto fore been duly and regularly taken and ob:,ct-
ed by the said city to enable it to levy, assess and cherge
the part of the cost of the said improvements required by
the said contract to i.c pL_id ;y '-he property butting there-

that respect has been riven and hf4.
SECTION 2. The -oard of Comrlissione-rs of s^id
City adopted in ma'ring the apportionments :-nd osessnents hr re-
inafter stated such rule of'; ortionnent - s wo •ld effect

substantial equality and justice between the several property
owners Effecte&, having in view the benefits received and bur-
dens imposed on such owners respectively for the reason that

the said 11Mrovdment against the property abutting upon said
improvement and its owners in the proportion of the frontage
of the property of each owner to the whole frontage of proper-
ty to be improved, and in accordance with the front foot rule
or plan would in the opinion of the $oard operate unjustly
in particular cases; and in the assessments hereinafter re-
cited on part of such cost assessed against any owner or his
property is in excess of the special benefits thereto in en-
hanced value thereof arising from the improvement.
SECTION 3. The said Board of Commissioners after
having given the notice and afforded the hearing provided for
in the charter of said city in respect to such aSEi-essments, c' ';-
inquired into, determined and adjudged all questions arelating
to the said assessment and to the regularity of the said im-
provement proceedings and the amount and validity of the ass-
essments and charge of personal liability against the persons.

recited are legal, equitable and valid.
F SECTION 4. There is hereby assessed, charged and
levied against the several owners of,property hereinafter
named, and against the respective lots, tracts or parcels of

names, abutting on that part of the said highway 'to be im-
proved as aforesaid, the amount set opposite the names o� the
property owners and the property oimed by them respectively,
to pay their just share of the cost of the said improvement
as the same -has been and is determined and adjusted by said

a;ainst each and every lot, tract or p,-rce1 of land al•ove de-
scribed, superior to all other liens , clips or titles except
lacrrul ta-,:es, to secure the payment of the -r,iount assessed
and charged against the saxle as aforesaid, together with inter-
est and costs of collection including a. reasonable attorne,-To
fee when incurred, and the respective owners of the said tracts
of land ire hereby declared to be 79ersonelly liable for the
payment of the amount assessed against them, -nd- the respec-
tive lots, tracts, or parcels of IBnd owned by them and here-
inbefore, as aforesaid; and the amounts so r.ssessed and charg-
ed shall be payable as follows; one-third within thirty days
after t],e completion and acceptance of the work by the city;
one-third in one year, 2na one-third in two years after such
date. 1,.11 deferred payments, if no default is rlr.cle in the pay-_
went of all installments when due, shall bear interest <.t the
rate of sire per cent per annun; but if default be nade in the
payment of any installment when due then the unpaid installn�ients

annum, Any ovmer shall have the right to dischnr e my instill-
ment before maturity by paying sarle with accrued interest to
the date of pm ment. Such deferred pa.yrnents to be evidenced
by improvement certificates to be issued by the said city pay-
able to the said Roach & Na.nigan, constituting e. personal
liability Qa.inst the respective property owners whose Ic-nds
are assessed as aforesaid, and be secured by the lien herein
created and fixed against the respective lots or tracts of
land; rind the chid improvement ccrt,.ficattes shall be issued
nxd be collectible in the manner and form prescribed. by the
laws and ordinances of the City of Fort 7orth.
