AN ORDINANCE granting Walker Bread Company, its successors
and assigns, the right to lay,annstruct and extend a
side or spur railway track connected with the Texas &
Pacific Railway Company's railroad track+Beginning at a
point 11 ft. South of the North line of North Street, and
10 ft. West of the West line of Lamar Street, said street
lines being determined by the Walker Bread Company building;
and said beginning point being the terminus of an existing
spur track of the Texas & Pacific Railway Company; Thence
continue westerly in the same direction as the said
existing spur track 13.5 ft. to the P. C. of a 19 degree
2 minute curve; Thence westerly on a 19 deg. 2 minute
curve 29.9 ft. to the P. T. of said curve, said P. T.
being 5 ft. South of the north line of North Street,
Thence West 38 ft. to the end.
BE IT ORDAINED BY THE BOARD OF COM4ISSIONERS OF THE CITY OF
FORT WORTH:
Section 1: Whereas, Walker Bread Company owns certain
property lying at the corner of Lamar and North Street in the
City of Fort Worth, and along the south side of which,
desires to build, and cause to be built and constructed, a
certain spur railway track connecting with the track of the
Texas & Pacific Railway Company, which said spur or side track
is to be used to supply the property just north of the same
owned by the Walker Bread Company for industrial purposes.
Now, THEREFORE, the right, privilege and franchise is
hereby granted to said Walker Bread Company, its successors
and assigns, to extend said industrial spur track as follows:
Beginning at a point 11 feet South of the North line
of North Street and 10 feet West of the West line of Lamar
Street, said street lines being determined by the Walker Bread
Company Building; and said beginning point being the terminus
of an existing spur track; thence continuing Westerly in the
same direction as the existing spur track 13 5/10 feet to the
P-- C. of a 19 degree-$ minute curve; thence Westerly on a
19 degree-3 minute curve 49 9/10 feet to the P. T. of said curve,
said P. T. being 5 feet South of the North line of North Street;
thence West 38 feet to the end.
All tracks laid under the provisions of this Ordinance
shall be laid under the supervision, and according to the
directiobs of the City Engineer of the City of Fort Worth, and
all tracks laid or constructed under the provisions of this
Ordinance shall be made to conform to the surface of the street
where the same is laid, and the top of each rail of said spur
track, and the spaces between the rails, and for eighteen
ihches on each side of the rails of said track, shall be kept
level with the street alongside of said track, and said track
shall be so constructed and maintained that travel on said
street shall not be unnecessarily obstructed or endangered at
any place, and all matters of construction and maintenance
shall be subject to the approval of the city engineer and
the Board of Commissioners of the city of Fort Worth.
Section 3: All tracks laid under the terms of this
ordinance on said street, that are now or shall hereafter be
paved, shall be of firstclass rails of such kind as shall be
designated by the city engineer of the city of Fort Worth, and
shall be laid in such manner as to make the least possible
obstruction to vehicles, and shall be maintained in that con-
dition.
Section 3: The said Walker Bread Company, its succes-
sore and assigns, shall, at its or their cost and expense,

pave and repave or otherwise surface and resurface, and keep
constantly in good order and condition with the same material
with which the street on the outside of said tracks is paved,
and surface all that part of each street or streets occupied
by it, or that which lies between the rails of said tracks,
and for eighteen inches on each side thereof, as may be laid
under the provisions of this Ordinance, and the said Talker
Bread Company, its successors and assigns, shall conform
said tracks or any part thereof, to the proper grade of the
street, and change the level of said tracks as often and
whanever the grade of any such streets is changed so that
every part of each track shall always be kept at the duly
established grade line, or as near thereto as the surface
of the grade of the street along the sides thereof will
permit.
Section 4: The said Walker Bread Company, its
successors and assigns, does hereby agree to indemnify and
hold the City of Fort North harmless because of, and promptly
to pay off and discharge, or repay to the said City, all
damages, claims, judgments, attorney's fees, and other cost
and expense rendered against, or incurred or paid out by the
said City of Fort North by reason of injuries either to
persona or property occasioned as the proximate result of
anything done, or permitted, or in any way proximately
arising out of the construction, operation or maintenance ,
upon the above street and thoroughfare of the said spur track.
Section 5: This Ordinance shall take effect and be
in force from and after its passage.
