AN ORDINANCE REQUIRING ALL PUBLIC UTILITIES, PERSONS, FIRMS, CORPORATIONS OR ASSOCIATION OF PERSONS OWNING, MAINTAINING OR OPERATING TELEGRAPH, TELEPHONE OR ANY OTHER KIND OR CHARACTER OF LINES THAT REQUIRE THE USE OF WIRES ON POLES, EXCEPT OWNERS OF STREET RAIL- WAYS AND ELECTRIC POWER AND LIGHT LINES, TO REMOVE SAID WIRES AND POLES FROM THE SURFACE OF THE STREET IN, OVER AND ALONG WEST SEVENTH STREET FROM THE WEST END OF TIDE VAN ZANDT VIADUCT TO THE POINT OF INTERSECTION OF CAMP BOWIE BOULEVARD WITH SAID STREET IN THE CITY OF FORT WORTH, TEXAS, AND PROVIDING A FORFEI- TURE FRANCHISE FOR THE VIOLATION THEREOF. WHEREAS, the City of Fort Worth is preparing tib make extensive improvements on West Seventh Street from the west end of the Van Zandt Viaduct to the point of intersec- tion of Camp Bowie Boulevard with the said West Seventh Street; and WHEREAS, West Seventh Street is one of the main arteries among the thoroughfares leading into the City of Fort Worth; that it is a very heavily travelled thoroughfare and the traffic on said street frequently becomes extremely congested; and WHEREAS, the presence of poles conducting and holding telephone, telegraph, eleet.ric wires and other lines of a similar nature creates a public menace on said street, greatly interferes with traffic and makes the use of fire apparatus by the Fire Department in case of fires along said street hazardous; and WHEREAS, as a condition for the use of public streets, highways, alleys and thoroughfares of this City by public utili- ties, persons, firms, corporations or association of persons that requires the installation of any kind or character of poles extending above the surface of said public Ways, a right was reserved in all franchises, privileges and grants given to demand and require of the owners of such lines that the poles be removed and that the said lines be placed undegsroun4 at any time that the governing body of said City should deem such action essential and necessary. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION I. That all public utilities, persons, firms, corpo- rations or association bf persons owning, operating or maintain- ing poles extending above the surface of streets, alleys or other public thoroughfares in the City of Fort Worth for the purpose of conducting or holding telephone, telegraph, electric or any other kind of wires in, over or along West Seventh Street from the west end of the Van Zandt Viaduct to the point of Intersection of Camp Bowie Boulevard with said West Seventh Street in the City of Fort Worth, shall remove said wires and poles from the surface of said thoroughfare, and that if said public utili- ties, persons, firms, corporations or association of persons desire to further operate and maintain said lines in or along said, thoroughfare, that they shall place such lines underground and in conduits in accordance with the specifications and regulations made and provided by the laws of the State of Texas and the Ordi- nances of the City of Fort Worth. SECTION II. That underground construction work herein contem- plated and required shall be begun within ten (10) days from the date hereof and said work shall be fully completed within forty (40) days from this date. SECTION III. That the provisions of this Ordinance shall in no way affect lines used for the purpose of distributing electricity for domestic and industrial consumers, or the use of poles and wires by the owners and operators of street railways insofar as the maintenance of such wires and poles above the surface of the street may be necessary and essential to hold and support trolley wires for the purpose of furnishing electric power to street cars. SECTION IV. That the Secretary-Treasurer of the City of Fort Worth is hereby directed to furnish all public utilities, per- sons, firms, corporations or association of persons owning or maintaining pole and wire lines along the thoroughfares herein described a copy of this Ordinance immediately. SECTION V. That the construction work herein required shall be done under the supervision and control of the Director of Public Utilities of the City of Fort Worth. SECTION VI. That the failure or refusal of any public utility, person, firm, corporation or association of persons to comply with the provisions of this Ordinance shall constitute a viola- tion of its terms, and shall subject the right, privilege, grant or franchise of such public utility, person, firm, corpora- tion or association of persons to use the public streets, high- ways, alleys and thoroughfares by installing their equipment, appliances or appurtenances either on, above or below the sur- face of same, to forfeiture.
