'_L 10 " AN ORDINANCE PERMITTING FRANK MILLIGAN AND WIFE, DELMA MILLIGAN, TO LEAVE THEIR HOUSE AND BUILDING IN ITS PRESENT LOCATION ON A TRACT OF LAND OWNED r BY THEM AND ENCROACHING UPON A NEWLY ACQUIRED THOROUGHFARE OF THE CITY OF FORT WORTH UNTIL SAID BUILDING IS EITHER DEMOLISHED OR REMOVED; AND PRO- VIDING THAT SAID ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER THE DATE OF ITS PASSAGE. WHEREAS, in connection with the construction of the East-West Ex- pressway, it was necessary for the City of Fort Worth to acquire for right of way purposes a portion of the following described land: All that certain lot, tract and parcel of land lying and being situated in the City of Fort Worth, Tarrant County, Texas, and being the west 81 feet of Block 25 of Edward Heirs Addition to the City of Fort Worth, Tarrant County, Texas, save and except the north 128 feet, which has here- tofore been deeded to John Milligan and wife, Lizzie Milli- gan, by deed dated December 10, 1945, and recorded in Vol. 1752, page 186, Deed Records of Tarrant County, Texas; and, WHEREAS, Frank Milligan and wife, Delma Milligan, own all of said tract except a portion taken by the City of Fort Worth for its right of way; and, WHEREAS, the said Frank Milligan and wife, Delma Milligan, own a building which constitutes their homestead, a part of which extends for approximately six (6) feet into the newly acquired right of way of the City of Fort Worth; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1, That Frank Milligan and wife, Delma Milligan, their heirs and assigns, shall be permitted to leave their existing building, which encroaches for approximately six (6) feet into the new right of way of the EastWest,Ex- presaway, in its present location; and that said building be allowed to main as it is now constructed, with the express condition, however, that if it should ever be demolished or removed, any new buildings shall be constructed in accordance with rules governing the building of structures in and along the newly created thoroughfare. SECTION 2, That this ordinance shall take effect and be in full force and ef— fect from and after the date of its passage, and it is so ordained. APPROVED AS TO FURM: City Attorney ORDINANCE Na.
