ARORDINANCE RATIFYING AND APPROVING ASSESSMENTS HE"-
E FT. WORTH, TEX.
TOFORE LEVIED BY THE CITY OF RIVER OAKS, TEXAS, ,FOR
A PART OF THE COST OF IMPROVING ROBERTS CUT-OFF ROAD
FROM HIGHWAY NO. 183 IN A NORTH AND WESTERLY DIRECTION
MEANDERING WITH THE ROAD TO THE CITY LIMIT LINE OF THE
CITY OF RIVER OAKS, WHICH PORTION OF SAID STREET IS
WHOLLY LOCATED WITHIN THE CORPORATE LIMITS OF THE
CITY OF RIVER OAKS, SAID ASSESSMENTS HAVING BEEN LEVIED
AGAINST THE OWNERS OF SAID PROPERTIES, WHICH PROPER-
TIES ABUT SAID STREET BUT ARE LOCATED WITHIN THE COR-
PORATE LIMITS OF THE CITY OF FORT WORTH, TEXAS; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the use by citizens of the City of River Oaks and
the City of Fort Worth of that portion of Roberts Cut-off Road
from Highway No. 183 in a north and westerly direction, meander-
ing with the road to the city limit line of the City of River
Oaks, requires that said portion of said street be improved by
paving, curb and gutter, widening, etc.; and,
WHEREAS, the City Council of the City of River Oaks has here-
tofore determined the necessity for, and has ordered the con-
struction of, said improvements and has levied assessments for
a part of the cost of said improvements as provided in Article
1105b of the Revised Civil Statutes of Texas; and,
WHEREAS, some of said assessments were levied against the
owners of certain tracts of land which abut the said street to
be improved but are located within the corporate limits of the
City of Fort Worth; and,
WHEREAS, the construction of said improvements will enhance
the value of, and specially benefit, each of said tracts in an
amount in excess of the amount assessed against it; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the assessments heretofore levied by the City Council
of the City of River Oaks, Texas, in Ordinance No. 296, dated
June 11, 1963,- be in all things hereby ratified and approved in
strict compliance with Section l (b) of Article 1105b of the Re-
vised Civil Statutes of Texas.
SECTION 2.
That this ordinance shall be in force and effect from and
after the date of its passage, and it is so ordained.

A proposed ordinance is attached which ratifies the assessments levied
by the River Oaks City Couna it in accortLaace with this agreement and an
assessment roll previously proviVed the City Council in M&C PW-1499, on
January 26, 1963.
On January 21, 1963, the City Council agreed to request of the River Oaks
City Council to adopt an ordinance ratifying paving assessments against bene-
fitted Fort Worth property owners along Robett Cu�-Off Road.
The City of River Oaks plans to construct permanent paving on Roberts
Cut-Off Road from a point near State Highway 183 to its northerly city limit
line. River Oaks will construct the base and curb and gutter with its city
forces, and award a contract for placing the 1� inch hot-mix asphaltic
concrete surface on the 40-foot roadway. A 3,092.4-foot section of the road
is adjacent to property in Fort north, although the entire street is in
River Oaks.
The amount to be assessed is $3.90 per lineal foot, including $1.50 per
foot for curb and gutter, a rate which compares favorably with prevailing
assessment rates for street construction, and with the average of $4.96 per
foot payment to the City of Fort Worth which River Oaks offerred to make for
property in that city along Isbell Road when this project was under consider-
ation.
The ordinance ratifying and "approving assessments levied by the City
of River Oaks for part of the cosE of improving that part of Roberts Cut-Off
Road lying adjacent to the City of Fort Worth# is ready for council action,
in accordance with the agreement approved by the City Council on January -21,
