ORDINANCE NO.
ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF ROSEN AVENUE
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES
IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH
GENERAL CONSTRUCTION COMPANY FOR THE CONSTRUCTION CF SAID
IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE I33UANCE,
EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDE14CE OF SPECIAL ASSESS-
MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED
AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY
SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP-
TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH,
TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE
RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract
with General Construction Camvany for the making and construction of certain
street improvements on the hereinafter described portions of streets, avenues and public
places in said City, to-wit:
1. ROSEN AVENUE., From Loraine Street to 29th Street,
known and designated as Unit No. 1.
2. ROSEN AVENUE: From 29th Street to 30th Street,
known and designated as Unit No. 2.
3. 30th STREET: From Rosen Avenue to the South to
Rosen Avenue to the North, known and
designated as Unit No. 3.
4. ROSEN AVENUE: From 30th Street to 31st Street,
known and designated as Unit No. 4.
5. ROSEN AVENUE: From 31st Street to 32nd Street,
known and designated as Unit No. 5.
6. ROSEN AVENUE: From 32nd Street to 33rd Street, known
and designated as Unit No. 6.
7. ROOSEVELT AVENUE: From 30th Street to 31st Street,
known and designated as Unit No. 7.
8. ROOSEVELT AVENUE: From 31st Street to 32nd Street,
known and designated as Unit No. 8.
9. ROOSEVELT AVENUE: From 32nd Street to 33rd Street,
known and designated as Unit No. 9.
10. PRAIRIE AVENUES From 32nd Street to 33rd Streets
known and designated as Unit No. 10.
11. N. W. 22nd STREET: From Long Avenue to Kearney Avenue,
known and designated as Unit No. 11.
12. McKINLEY AVENU£s From 32nd Street to 33rd Street,
known and designated as Unit No. 12.
13. HARRINGTON AVENUEs From Terrace Avenue to Grand Avenue,
known and designated as Unit No. 13.
WHEREAS,'by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No. 5085 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 5085 , and
WHEREAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;
NOW, THEREFORE,
HE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT:
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro—
perty assessed andshall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows:

When each of the certificates has been duly executed as hereinabove provid-
ed, same shall be delivered to the Tax Assessor-Collector as .part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Rook of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

Variations between estimated and measured quantities account
for the difference between contract price and contract cost.
Compliance with Specifications
Attached is a tabulation of paving test cores showing compliance within
acceptable tolerances, except for one area in Unit 2 which was removed
and replaced to specified plan thickness as shown on core tabulation.
During testing on this project, 60 corings were made with the following
results:
Exceeds Meets Under Specs but Below Tolerances and
Specs Specs within Tolerances subject to reconstruction.

The average thickness of the cement stabilized base was 8.08" as compared
to 7.00" specified and the surface was 1.80" as compared to 1.50"
specified. Tests made during construction of the sub-base, base and pave-
ment also show that the material used was in compliance with specifications.

Recommendations
It is recommended that the above project be accepted by adoption of
- an ordinance and that final payment of $9,731.84 be authorized to
General Construction Company.
