ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF NORTH RIVERSIDE DRIVE
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES
IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH
WORTH CONSTRUCTION COMPANY FOR THE CONSTRUCTION QF SAID
IMPROVLWMS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE,
EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS-
MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED
AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY
SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP-
TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL QF FORT WORTH,
TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE
RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract
with Worth Construction Company for the making and construction of certain
street improvements on the hereinafter described portions of streets, avenues and public
places in said City, to-wit:
NORTH RIVERSIDE DRIVF4 From East Belknap Street to the Alley North of Bird
Street, known and designated as Unit 7 ( Unit no. 1
of Contract 4) a seven inch reinforced concrete
pavement with a seven inch curb and two foot gutter
on a sixty foot roadway.
WHEREAS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No. 5095 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
WHEREAS, the City Council of the City of Fort worth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 5095 , and
WHEREAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance with the contract therefor;
NOW, THEREFORE,
BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, THAT:
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed andshall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after giving
effect to such credit, if any, are hereby enumerated and itemized as follows:
It.
When each of the certificates has been duly executed as hereinabove provid-
ed, same shall be delivered to the Tax Assessor-Collector as .part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council of Fort ;North, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City.
V.
This ordinance shall take effect and be in fall force and effect from and
after the date of its passage.

for the difference between contract price and contract cost.
Compliance With Specifications
Attached is a tabulation of paving cores showing results of depth
thickness tests. The following is a summary of the 39 corings made
on the project:

Because the concrete pavement in some 4reas was not within construction
tolerances, as indicated above, penalties were applied in accordance with
the terms of the contract using the same formula applied on previous
projects and in a manner similar to penalties applied by the Texas Highway
Department. An area of 515.3 square yards, comprising 4 per cent of the
total square yards of pavement constructed, was determined by the corings
to be below construction tolerances, and is subject to a proposed penalty
of $212.45.
The maximum deviation from specified thickness was 0.49 inches with an
average deviation of 0.35 inches in the deficient area representing a
shortage of about 5 cubic yards of concrete. The thickness of pavement
within the deficient area averaged 5 per cent less than the specified
thickness, but a penalty of 9.84 per cent of the bid price of placing
515.3 square yards of pavement was applied.
FIDr the entire project, the average thickness of base is 4.16 inches, com-
pared with 4 inches specified, and the concrete pavement is 7.14 inches
c mpared with 7 inches specified.
R commendations
It is recommended that the project be accepted by adoption of an
ordinance and that final payment of $8,317.06 be authorized to
Worth Construction Company.
