ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF Lgg AVF.MM AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH BAR RI.TULIT= rnPANV FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESS- MENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAP- TION OF SAME IN THE MI14UTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Texas Bitulithic Company for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit- 1. Lee Avenue From Grand Avenue to the north line of Lot 3, Block 81, North Fort Worth Addition, known and designated as a part of Unit No. 1, a 1k inch hot-mix asphaltic concrete surface on a 7 inch cement stabilized gravel base on a 40 foot roadway. 2, Lee Avenue: From the north line of Lot 3, Block 81, North Fort Worth Addition to Prospect Avenue, known and designated as a part of Unit No. 1, a 1k inch hot-mix asphaltic concrete surface on a 7 inch cement stabilized gravel base on a 30 foot roadway. 3. Prospect Avenue: From Lee Avenue to North West 21st Street, known and designated as a part of Unit No. 1, a 1k inch hot-mix asphaltic concrete surface on a 7 inch cement stab- ilized gravel base on a 30 foot roadway. 4. Prospect Avenue: From North West 21st Street to North West 26th Street, known and designated as Unit 2, a 1k inch hot-mix asphaltic concrete surface on a 7 inch cement stabil- ized gravel base on a 30 foot roadway. 5. Roosevelt Avenue: From the north line of Lot 11, North Point Addition to North West 28th Street, known and designated as a part of Unit No. 3, a lk inch hot-mix asphaltic concrete surface on a 7 inch cement stabilized gravel base on a 30 foot roadway. 6. Francis Avenue: From North West 20th Street to Hagan Avenue, known and designated as a part of Unit No. 3, a 1k inch hot-mix asphaltic concrete surface on a 7 inch cement stabilized gravel base on a 30 foot roadway. 7. Hagan Avenue: From North West 20th Street to the north line of Lot 14, Block 17, Baker Heights Addition, known and designated as a part of Unit No. 3, a 1'k inch hot-mix asphaltic concrete surface on a 7 inch cement stabilized gravel base on a 40 foot roadway. 8. Primrose Avenue: From Sylvania Avenue to North Riverside Drive, known and designated as Unit No. 4, a 1k inch hot-mix asphaltic concrete surface on a 7 inch cement stabilized gravel base on a 30 foot roadway. 9. Lee Avenue; From Prospect Avenue to North West 22nd Street, known and designated as a part of Unit No. 5, a 12 inch hot-mix asphaltic concrete surface on a 7 inch cement stabilized gravel base on a 30 foot roadway. 10. Lee From North West 23rd Street to North West 26th Street, known and designated as a part of Unit No. 5, a 1� inch hot-mix asphaltic concrete surface on a 7 inch cement stabilized gravel base on a 30 foot roadway. 11. Primrose Avenue: From North Riverside Drive to Bolton Street, known and designated as a part of Unit No. 6, a lk inch hot-mix asphaltic concrete surface on a 7 inch cement stabilized gravel base on a 40 foot roadway. 12. Bolton Street: From Primrose Avenue to Eagle Drive, known and designated as a part of Unit No. 6, a 1k inch hot-mix asphaltic concrete surface on a 7 inch cement stabilized gravel base on a 30 foot roadway. WHEREAS,-by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 5137 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort 'Korth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial ,justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 5137 , and WH&REA3, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro— perty assessed andshall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: When each of the certificates has been duly executed as hereinabove provid- ed, same shall be delivered to the Tax Assessor-Collector as tart payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. This condition was more pre- valent than indicated by the test holes. + 14,950.00 3) It was not necessary to remove and replace as much existing curb as was originally estimated. - 59557.80 4) Variation between estimated and measured quanti- ties account for the remaining difference between contract price and contract cost. 801.62 Total Over-run $159640.12 DATE REFERENCE SUBJECT:Final Payment, Reconstruction Of PAGE NUMBER Gravel Base Streets at Six Locutions, 8/9/65 FP-245 Project No. 094-27000-114 2 °i Compliance With Specifications Attached is a tabulation of paving test cores showing compliance with specifications within construction tolerance on Reconstruction of Gravel Base Streets at Six Locations. On Unit 1, Lee Avenue between North 15th Street and North 16th Street, the existing concrete base was left iuntact_ and is being used for the base for the new asphalt surface° During testing on this project, 185 surface corings and 179 base corings were made with the following results: Exceeds Even With Under Specs But Below Paving Specs Specs Within Tolerance Tolerance Surface 165 8 12 0 Base 164 8 7 0 On entire project the average thickness of the surface course is 1.98 inches as compared with 1.50 inches specified and the base course is 8.23 inches as compared with 7.00 inches specified. Tests made during construction of sub-base, base, and pavement show that the material used was in compliance with specifications. Recommended Council Action It is recommended that the above project be accepted by Adoption of an ordinance and that final payment of $22,304.98 be authorized to Texas Bitulithic Company.
