WHEREAS, the Contract involves engineering services for the following

WHEREAS, it has become necessary to execute Amendment No. 1 to
said Contract to include an increased scope of work and revised maximum
fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following agreement

Article I of the Contract is amended to include the additional
engineering services speced in a proposal letter dated JUIy 30, 2008, a
copy of which is attached hereto and incorporated herein. The cost to City
for the additional services to be performed by Engineer total $75,965.00.
2.
Article II of the Contract is amended to provide for an increase in the
maximum fee to be paid to Engineer for all work and services performed
under the Contract, as amended, so that the total fee paid by the City for all
work and services shall not exceed the sum of $87,745.00.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Request for Engineering Design and Surveying Proposal, Project No. 0487
Mrs. Johnson:
Lockwood, Andrews, &Newnam, Inc. (LAN) completed the Conceptual Drainage
Analysis for 8100 Trinity Boulevard in September 2007. Subsequently, we received
a written comment to proceed with the design of the proposed culvert
improvements. As our original contract dated December 13, 2006 did not include
the engineering design services or field surveying, we have prepared the exhibits
needed to amend the engineering fee proposal for our Standard Agreement for
Engineering Services. The fee proposal is based on our understanding of the project
and the Conceptual Drainage Analysis LAN prepared. We are pleased to provide
this fee.proposal for engineering and design surveying services and understand time
is of the essence. Our understanding of the project description is outlined in
Exhibit-2 and includes:
Prepare engineering plans and contract documents to bid the storm drain culvert
improvements located in the 8100 Block of Trinity Boulevard. Replace 4-66" and 1-60"
pipe culvert with 4-10'x6' box culverts
The scope provided to us in May of 2006 requested "Design of a culvert and adjacent
channel improvements for both stream WF-9 to convey local (flash flood) Q100 under
the roadway, assuming Trinity River is not in flood stage. Provide CLOMR/LOMR if
FEMA map revisions will result".
The M/WBE project goal has been set at 16%
M/WBE participation on this project.
PROTECT SCOPE OF SERVICES
LAN has provided for 16.5%
The project scope of services shall include the Basic and Special Services in
accordance with the City's "Attachment A", Scope of Services and the following
items:

1. This proposal does not include preparation of easement documents, legal
descriptions, exhibits or ROW dedications.
2. Relocation of water, wastewater, or other utilities not specified in the project
understanding will be considered an Additional Service. We have
coordinated with your staff to insure that water or sewer lines are not
planned in this area.

The engineer's opinion of probable construction cost in 2008 dollars is $382,228
based on recent comparable construction projects. The original contract specified a
Conceptual Drainage Analysis and it was provided for a fee of $11,780. The
Contract will be amended to include the design fees shown below.

Compensation for the basic professional services shall be for a lump sum amount of
Twenty Nine Thousand Two Hundred Forty Dollars ($29,240.00). Compensation
for the special services shall be not to exceed Forty Six Thousand seven Hundred
Twenty Five Dollars ($46,725.00) for the rates shown on Exhibit "B-3A" Summary
of Total Project Fees (topographic survey base map and LOMR field survey
verification shall be lump sum $13,400.00; LOMR shall be lump sum $17,505.001
SWPPP shall be lump sum $2,000.00; Traffic Control $1,500 and reproduction
costs shall be unit rate reimbursable not to exceed $3,369.00). The combined
basic and special services fee shall not exceed Seventy Five Thousand Nine
Hundred Sixty-five Dollars ($75,965.00).
Combining the original contract amount of $11,780 and the new design fee of
$75,965 for Amendment No. 1 brings the project total fee to $87,745 (Eighty Seven
Thousand Seven Hundred Forty-five Dollars), as shown below.

Compensation
A. The Engineer shall be compensated a total lump sum fee of $ 75,965.00
as summarized in Exhibit "B-3". Payment of the total lump sum fee shall
be considered full compensation for the services described in Attachment
"A" and Exhibit "A-1" for all labor, materials, supplies and equipment
necessary to complete the project.
B. The Engineer shall be paid monthly as described in Exhibit "B-1 ", Section
1 — Method of Payment.
C. Each invoice is to be verified as to its accuracy and compliance with the
terms of this contract by an officer of the Engineer.
II. Schedule
Final Plans and Contract Documents for bid advertisement shall be submitted
with 360 calendar days after the "Notice to Proceed" letter is issued.
A. Preliminary Engineering Report (PER) — 90 calendar days
B. Preliminary Construction Plans — 60 calendar days
C. Final Construction Documents — 30 calendar days
D. Final Plans and Contract Documents for Bid Advertisement — 30 calendar
days

I. Method of Payment
Partial payment shall be made to the Engineer monthly upon City's approval of
an invoice from the Engineer outlining the estimated current percent complete of
the total project.
The aggregate of such monthly partial fee payments shall not exceed the
following:
Until satisfactory completion of ExhibitA-1, Preliminary Engineering Report
(PER) and approval by the City, a sum not to exceed 30 percent of the total lump
sum fee.
Until satisfactory completion of Exhibit A-1, Preliminary Construction Plans and
approval by the City, a sum not to exceed 60 percent of the total lump sum fee,
less previous payments.
Until satisfactory completion of Exhibit A-1, Final Construction Documents and
approval by the City, a sum not to exceed 90 percent of the total lump sum fee,
less previous payments.
The balance of fees, less previous payments, shall be payable after all of the pre -
construction meetings for the Project have been conducted.
II. Progress Reports
A. The Engineer shall submit to the designated representative of the
Directory of the Department of Engineering monthly progress reports
covering all phases of design by the last working day of every month in the
format required by the City.
B. If the Engineer determines in the course of making design drawings and
specifications that the opinion of probable construction cost of $382,228
(as estimated in Exhibit B-4) will be exceeded, whether by change in the
scope of the project, increased cost or other conditions, the Engineer shall
immediately report such fact to City's Director of the Department of
Engineering and, if so instructed by the Director of the Department of
Engineering shall suspend all work hereunder.

Surveying Services
TOPOGRAPHIC SURVEY:
1. Research property owners and obtain copies of subdivision plats and ownership deeds in
the area of the creek survey limits.
2. Locate property corners and establish property lines and existing right-of-way lines. Prepare
a right-of-way map of the existing right-of-way showing lot numbers, ownership with
recording information and all of the parcels of land affected by the project. Deliverables
include a right-of-way map to overlay onto the topographic survey prepared in Microstation
along with copies of deeds, subdivision plats and tax ownership information.
3. Establish vertical control for the project from NAVD 88 Datum. Establish two benchmarks
for the project. The horizontal control shall be Texas State Plane Coordinates, North Central
Zone, NAD83.
4. Provide a topographic survey of the drainage project with the limits as follows:
a. Provide a topographic survey of Trinity Blvd. that shall extend 1,000 feed east and west
from the centerline of the creek and shall tie only the roadway pavement.

b. Provide a topographic survey of the creek extending 500 feet up stream and 100 feet
downstream of the culvert at Trinity Boulevard and being 400 feet in width (200 feet left
and right of flowline). The topographic survey of the creek shall include, but is not limited
to, locating all existing features such as water valves, tops & toes of slope, sidewalks,
fences, storm & sewer manholes, tree lines or trees 6" and larger, power poles, telephone

LOMR VERIFICATION SURVEY:
1. Provide a topographic survey of the creek extending 500 feet up stream and 100 feet
downstream of the culvert at Trinity Boulevard and being 400 feet in width (200 feet left and
right of flow line). The topographic survey of the creek shall include the new culvert,
roadway improvements and all areas disturbed due to grading or construction to verify as built
conditions.
2. The LOMR verification survey shall be tied to the same benchmark used for the
topographic survey and certified by an RPLS.
3. Deliverables shall include a final digital design file in AutoCAD or Microstation format
showing features located along with one -foot interval contours and a digital terrain model.
Provide copies of the survey field notes, a hard copy of the coordinates and an ASCII file of
the coordinates for the points located.

No. 34384 an Engineering Agreement with Lockwood, Andrews and Newnam, Inc., for 8100 Trinity
Boulevard Culvert Improvements (Project No. 00487)
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 in the
amount of $75,965.00 to City Secretary Contract No. 34384 with Lockwood, Andrews and Newnam, Inc.,
thereby, revising the total cost to $87,745.00.
DISCUSSION:
The Storm Water Management Program was established to reduce flooding in Fort Worth, preserve
streams, minimize water pollution and to operate the storm water system in a more effective manner to fully
comply with state and federal regulatory requirements. This will be accomplished by infrastructure
reconstruction and system maintenance, master planning, enhanced development review, and increased
public education and outreach.
On October 16, 2007, (Ordinance No. 17840-10-2007) City Council authorized the issuance and sale of
$25,000,000.00 in Storm Water (Drainage) Revenue Bonds, Series 2007, to fund a two year Storm Water
Capital project program.
On December 13, 2006, the City Manager administratively executed an engineering agreement with
Lockwood, Andrews and Newnam, Inc., for the study of proposed culvert improvements at 8100 Trinity
Boulevard.
The study has been completed and recommendations provided in order to convey local flash flood storm
water flow under the roadway, assuming the Trinity River is not in flood stage. In addition, the study
recommended that a Conditional Letter of Map Revision (CLOMR) be submitted and approved prior to
construction and a Letter of Map Revision (LOMR) be submitted and approved after improvements are
constructed to change the effective Flood Insurance Rate Map (FIRM).
Amendment No. 1 for the subject engineering agreement will provide the following:
. Topographic survey (approximately 2,600 linear feet) for design;
. Design and preparation of engineering plans and contract documents for the bidding and construction of
the recommended improvements, which include replacing the existing four 66-inch and one 60-inch pipe
culverts with four 10 feet x 6 feet box culverts;
. Subsurface Utility Engineering (Level B);

. Preparation and submittal of CLOMR prior to construction;
. Preparation and submittal of LOMR after improvements are completed; and
. Field verification of LOMR.
Lockwood, Andrews and Newnam, Inc., proposes to perform the additional survey/design work and prepare
the appropriate CLOMR and LOMR for a lump sum fee of $75,965.00. City staff considers the fee to be fair
and reasonable for the scope of services proposed.
In addition to the contract amount, $21,900.00 is required for project management by the Engineering
Department.
M/WBE -Lockwood, Andrews and Newnam, Inc., is in compliance with the City's MM/BE Ordinance by
committing to 16 percent M/WBE participation. The City's goal on the project is 16 percent.
This project is located in COUNCIL DISTRICT 4, Mapsco 66B.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that funds are available in the current capital budget, as appropriated of the
Storm Water Capital Projects 2007 Revenue Bond Fund.
