HomeMy WebLinkAboutOrdinance 5432 ORDINANCE N0. 5432 AN ORDINANCE AMENDING CHAPTER 37 OF THE FORT WORTH CITY CODE (1964) , WHICH CHAPTER REGULATES THE FURNISHING OF WATER AND SEWER SERVICE, BY INCREASING CHARGES FOR WATER AND/OR SEWER SERVICE, PROVIDING FOR CHARGES TO BE PAID BY MUNICIPAL DEPARTMENTS OF THE CITY FOR WATER AND SEWER SERVICE, PROVIDING CHARGES FOR THE SALE OF RAW WATER, INCREASING MINIMUM CHARGES FOR CONNECTIONS WITH WATER MAINS OR SEWER MAINS, REQUIRING DETECTOR-TYPE CHECK VALVES IN FIRE PROTECTION SYSTEMS, REGULATING THE SIZE OF METERS, AND REQUIRING MINIMUM CHARGES FOR SEPARATE METERS USED FOR SEASONAL PURPOSES ; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES ; REPEALING ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS : SECTION 1 . Sec. 37-25 of Chapter 37, Article III , of the Fort Worth City Code is hereby amended, and, after being so amended, same shall be and read as follows : Sec. 37-25• Water and sewer rates within City. (a) The following schedules of rates per month, or fraction there- of, shall be the charges to all persons, as herein defined, for furnishing water to water consumers and for rendering sanitary sewer- age service to premises located within the City: Schedule A. Rates for water and sewerage service: CUBIC FEET RATE First 200 or less cu. ft. of water used per month $2.00 Minimum For the next 1 ,800 cu. ft. of water used per month 0.370 per 100 cu. ft. For the next 8,000 cu. ft. of water used per month 0.340 per 100 cu. ft. For the next 40,000 cu. ft. of water used per month 0.320 per 100 cu. ft . For the next 75,000 cu. ft. of water used per month 0.290 per 100 cu. ft. For the next 125,000 cu. ft. of water used per month 0.200 per 100 cu. ft. For all in excess of 250,000 cu. ft. of water used per month 0. 150 per 100 cu. ft. Where a customer is furnished both water and sewerage service, the Director of the City Waterworks is authorized to combine such billing under the symbols "WTR" or 'IV' or such symbols as may be necessary to designate the applicable charge. Schedule B. Rates for water service only: CUBIC FEET RATE First 200 or less cu. ft. of water used per month $1 .50 Minimum For the next 1 ,800 cu. ft. of water used per month 0.280 per 100 cu. ft. For the next 8,000 cu. ft. of water used per month 0.270 per 100 cu. ft. For the next 40,000 cu. ft. of water used per month 0.260 per 100 cu. ft. For the next 75,000 cu. ft. of water used per month 0.250 per 100 cu. ft. For the next 125,000 cu. ft. of water used per month 0. 165 per 100 cu. ft. For all in excess of 250,000 cu. ft. of water used per month 0. 120 per 100 cu. ft. Schedule C. Rates for sewerage service only: CUBIC FEET RATE First 200 or less cu. ft. of water used per month $0.90 Minimum For the next 1 ,800 cu. ft. of water used per month 0.090 per 100 cu. ft. For the next 8,000 cu. ft. of water used per month 0.070 per 100 cu. ft. For the next 40,000 cu. ft. of water used per month 0.060 per 100 cu. ft. For the next 75,000 cu. ft. of water used per month 0.040 per 100 cu. ft. For the next 125,000 cu. ft. of water used per month 0.035 per 100 cu. ft. For all in excess of 250,000 cu. ft. of water used per month 0.030 per 100 cu. ft. The service charges set out in the foregoing Schedules A, B and C are based upon the amount of water used as measured by meters. (b) For sanitary sewerage service customers whose water is not measured by a meter, a flat rate of $1 .75 per month shall be charged for each dwelling unit to which service is provided directly or indirectly. (c) For each business, commercial or industrial unit to which sanitary sewerage service is furnished directly or indirectly and whose use of water is not measured by a meter, the Director of the Waterworks is authorized to apply Schedule C, based upon an estimated water use to determine such monthly charge. The minimum monthly charge for each such customer shall be $3.00. (d) The monthly charge to be made for each industrial waste producer for rendering service in connection with the treatment of industrial waste shall be based on the Five-Day Biochemical Oxygen Demand content of such waste. The relative strength or base factor of industrial waste introduced into the sanitary sewerage system shall be computed using the Five-Day Biochemical Oxygen Demand content for domestic sewage of three hundred parts per million by weight for comparison. The billing factor shall be the Five-Day Biochemical Oxygen Demand content of the industrial waste as expressed in parts per million by weight divided by the figure three hundred. The monthly sewage service charge for an industrial waste producer shall be computed using the applicable rate schedule above, multi- plied by such billing factor. The Director of the Waterworks is authorized to determine or cause to be determined the Biochemical Oxygen Demand content of industrial waste not less than once each year. (e) Charges paid by municipal departments of the City for water service only shall be: 55% of Rate B beginning October 1 , 1965, 70% of Rate B beginning October 1 , 1966, 85% of Rate B beginning October 1 , 1967, and 100% of Rate B beginning October 1 , 1968. Charges paid for sewerage service shall be at rates in effect. (f) The following schedule of rates per month shall apply for furnishing raw water to consumers located within the City: GALLONS RATE First 1 ,000,000 gallons $0. 12 per 1 ,000 gallons All over 1 ,000,000 gallons 0.09 per 1 ,000 gallons SECTION 2. Section 37-26 (a) of Chapter 37, Article III , of the Fort Worth City Code is hereby amended, and, after being so amended, same shall be and read as follows : Sec. 37-26. Minimum charges and connection charges. (a) A minimum charge per month, or fraction thereof, shall be made for each connection with the water mains or sewer mains of the City Waterworks. Charges for water furnished through meters shall be made at rates in effect, and each meter shall be read and billed separately. (1 ) Fire Line Meters. The monthly charges for connections to unmetered automatic sprinkler systems or other fire lines installed and used for fire protection only shall be $1 . 15 per inch of diameter of the fire service connection. When it is determined that water has been or is being used through or from an unmetered automatic sprinkler system for purposes other than for fire fighting, the consumer shall pay the full cost of a meter installation on the fire line. All fire protection systems used exclusively for fire- fighting purposes and provided with outlets other than standard closed sprinkler heads shall be provided with detector-type check valves at customer' s cost before connection with the water mains of the City. in case it is determined that water is used through such detector check valves for purposes other than for fire- fighting, the detector check valve installation shall be replaced with a standard meter with the consumer paying the full cost of the meter installation. (2) Meter Sizes. Only one 5/8" x 3/4" meter shall be attached to and served by a 3/4" tap. No more than two 5/8" x 3/4'' or one 1" meter shall be attached to and served by a 1" tap. Not more than one 1 -1 /2" or three 5/8" x 3/4" or three 1" meters shall be attached to and served by a 1-1 /2" tap. Not more than one 211, four I" or six 5/8" x 3/4" meters shall be attached to and served by a 2" tap. (3) Seasonal Meters. Customers using a separate water meter for one or more seasonal purposes (such as lawn watering, but not being limited thereto) shall pay the minimum monthly charge prescribed herein for such meter throughout the year, whether such service is active or not. If such service is disconnected at the request of the customer and the customer requests that the service be reconnected within the next twelve months, a reconnection charge shall be paid equivalent to the monthly minimum charge times the number of months that such service has been disconnected. SECTION 3. This ordinance shall repeal every prior ordinance and provision of the Fort Worth City Code in conflict herewith but only insofar as the portion of such prior ordinance or provision shall be in conflict, and as to all other ordinances or provisions of the Fort Worth City Code not in direct conflict herewith, this ordinance shall be and is hereby made cumulative. SECTION 4. If any section, part of a section or provision of any section of this ordinance shall be held to be void, ineffective or unconstitutional by a court of competent jurisdiction, the holding of such section, part of a section or provision of any section to be void, ineffective or unconstitu- tional for any cause whatsoever shall in no way affect the validity of the remaining sections and provisions of this ordinance, which shall remain in full force and effect. The City Council would not have passed any sections, parts of sections or provisions of any section of this ordinance that were unconstitutional , void or ineffective if it had known that they were uncon- stitutional , void or ineffective at the time of adopting this ordinance. SECTION 5. A violation of any of the above rules and regulations of the City Waterworks as set out herein, or a doing or causing to be done by any person or persons, firm or association, of any of the things or acts for- bidden or made unlawful in any of such rules and regulations, shall be deemed to constitute a violation under the terms of this ordinance and an offense, and shall be punishable as such; and for each and every violation of the terms of this ordinance, the person, firm, association or corporation shall, upon conviction thereof in the Corporation Court, be fined not to ex- ceed Two Hundred Dollars ($200.00) , and each violation and each day there is a failure to comply with the terms of this ordinance shall constitute a separate offense. SECTION 6. The rates prescribed in this ordinance shall be placed in effect with the October, 1965 billing, after the date of its passage and publication as required by law, and it is so ordained.
