HomeMy WebLinkAboutOrdinance 5433 ORDINANCE NO. } AN ORDINANCE PROVIDING THAT A PORTION OF THE ALLEY IN BLOCK 61, FOSTEPCO HEIGHTS ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, BE ABANDONED, VACATED AND CLOSED; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the hereinafter described portion of the alley in Block 61, Fostepco Heights Addition to the City of Fort Worth, Tarrant County, Texas, be and the same is hereby vacated, closed and permanently abandoned as an alley or public thoroughfare of any kind or character whatever: Beginning at the northeast corner of Lot 2, Block 61, Fostepco Heights Addition; Thence south 7 degrees 52 minutes 30 seconds east a distance of 270.79 feet; Thence north 86 degrees 30 minutes east a distance of 15.04 feet; Thence north 7 degrees 52 minutes 30 seconds west a distance of 270.79 feet; Thence south 86 degrees 30 minutes west a distance of 15.04 feet to the place of be- ginning. SECTION 2. That the interest of the City of Fort Worth in the fee to the land in said portion of the alley is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. APPRQVED AS TO PFORM AN�D� LEGALITY: VL City Attorney City of Fort Worth, Texas Mayor and Council Communication DATE REFERENCE SUBJECT: Proposed Alley Abandonment in PAGE NUMBER PZ-149 Fostepco Heights Addition 1 or 8/23/65 1 Safeway Stores, Inc. , owner of all adjoining property, has requested abandon- ment of a portion of the alley in Block 61, Fostepco Heights Addition, as shown on the attached map. Abandonment of the alley will permit construction of a retail store on Lots 2-7 and 18-23, Block 61, owned by Safeway Stores, Inc. Private utility companies, Public Works, Water, Traffic Engineering, and Planning Departments have reviewed the request and do not object to the abandonment. The City Plan Commission has reviewed the request and recommends adoption of the ordinance that has been prepared abandoning the alley as requested, sub- ject to a replat of the property owned by Safewway Stores, Inc. The owners have agreed to dedicate a new east-west alley and additional right-of-way for the widening of 33rd Street. The required replat has been submitted and approved for filing, pending a decision on the requested alley closing. City Council action on the Plan Commission recommendation is requested.
