The certificates shall provide substantially that if same shall not be paid promptly upon maturity, then they shall be collectable, with reasonable attorney's fees and costs of collection, if incurred, and shall provide substantially that the amounts evidenced thereby shall be paid to the Assessor and Collector of Taxes of the City of Fort Worth,Texas, who shall issue his receipt therefor, which shall be evidence of such payment on any demand for the same, and the Assessor and Collector of Taxes shall deposit the sums so received by him forth- with with the City Treasurer to be kept and held by him in a separate fund, and when any payment shall be made in the City the Assessor and Collector of Taxes upon such certificate shall, upon presentation to him of the certificate by the holder thereof endorse said payment thereof. If such certificate be assigned then the holder thereof shall be entitled to receive from the City Treasurer the amount paid upon the presentation to him of such certificate so endorsed and credited; and such endorsement and credit shall be the Treasurer's Warrant for making such payment. Such payments by the Treasurer shall be receipted for the holder of such certificate in writing and by surrender thereof when the principal, together with accrued interest and all costs of collection and reasonable attorneys fees, if incurred, have been paid in full. Said certificates shall further recite substantially that the proceedings with reference to making the improvements have been regularly had in compliance with the law,and that all prerequisites to the fixing of the assessment lien against the property described in such certificate and the personal liability of the owners thereof have been performed, and such recitals shall be prima facie evidence of all the matters recited in such certificates, and no further proof thereof shall be required in any court. Said certificates may have coupons attached thereto in evidence of each or any of the several installments thereof, or may have coupons for each of the first four installments, leaving the main certificate to serve for the fifth installment, which coupons may be payable to the City of Fort Worth,or its assigns may be signed with the facsimile signatures of the Mayor and City Secretary. The fact that such improvements may be omitted on any portion of any of said units adjacent to any premises exempt from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of such assessments upon other premises. X. Full power to make and levy reassessments and to correct mistakes, errors, invalidities or irregularities, either in the assessments or in the certificates issued in evidence thereof,is,in accordance with the law in force in this City, vested in the City. M. Daggett Elementary School, for the paving of Seven Locations on the South Side, Proiect 104-24000-1.46. The procedures concerning owner participation in the cost of paving, including methods and policies of determining assessments, street construction standards, and method of payment were explained to the 10 persons in attendance. UNIT 1 - EAST FOURTH STREET - Brandies Street to DeGosta Street. No objections to the paving were stated at the hearing. UNIT 2 - EAST FOURTH STREET - DeGosta Street to Gross Street. No objections to the paving were stated at the hearing. East Fourth Street, which is 'located north and east of the contract area was placed in this project because of the urgent request of property owners to have the street paved as soon as possible due to the dusty conditions. The petition for paving Unit 2, East Fourth Street. from DeGosta Street to Gross Street was received on July 14, 1965 and had been delayed pending the outcome of the bond election. Unit 1, East Fourth Street from Brandies Street to DeGosta, was placed in the project in order to avoid a paving skip in the 3900 block c,f East Fourth. UNIT 3 - TRAVI.S AVENUE ® Hawthorne St.ree:t to Arlington Avenue. Mr. E. B. Brown, 5201 Stacey Street, the owner of the east 'k of Lots 4 and 5, Block 7, E. B. Webster's Revision of Bellvue Hill, stated that he was of the opinion that the paving was being forced on property owners of Travis Street because of the large hold- ings of Mr. A. B. Culbertson, who circulated the petition. It was explained to Mr. Brown that requests for paving are normally processed if property owners representing fifty per cent or more of the footage petition for the paving. Mr. Brown is one of four owners adjacent to the project, and is the only property owner shown as opposed to the project as determined by the post card survey, the summary of which is attached. Mr. A. B. Culbertson of A. B. Culbertson and Company, Mortgage and Investment Banking, with offices at 4235 East Lancaster, is the owner of four of six lots abutting Arlington Avenue, Unit 6, comprising 49.75 per cent of the abutting front footage of the Unit. Mr. Culbertson is also the owner of 4 of 7 lots abutting Travis Avenue, Unit 3 of the project, or 55.68 per cent of the abutting footage. In computing the assessments against property owned by Mr. Culbertson, residential and side lot credits were applied. Later, after reviewing the holdings of Mr. Culbertson, the Public Works Department concluded that according to policy the property should have been assessed at developer's rates and that residential and side lot credits should not be allowed, even though the property is zoned for residential usage. This is in accordance with City policy onifingroving border streets on the asses9ment basis. T' SECRETARY .a ATTACHMENT "A" Page 2 of 2 Tabulated below are the assessments as first computed as opposed to assessments without side lot and residential credit. Dearing, owner of Lot 2 and the north h of Lot 3, Block N, Bellvue Hill Addition, said there had been no petition for the paving of the block, and that he was opposed to the paving. This unit was included to avoid a 100 foot paving skip between Baltimore and Richmond Avenues. Mrs, Dorothy Schroeder, owner of the east h of Lots 1, 2, 3, and 4, Block M, Bellvue Hill Addition, stated that she opposed the assessment and the paving. UNIT 6 - ARLINGTON AVENUE - Lipscomb Street to Travis Avenue. Mrs. Lavirne Mahanay, owner of Lot 5, Block 3, E. B. Webster's Revision of Bellvue Hill, stated that she could not afford the proposed assessment. Mrs. Mandnay was invited to discuss with the staff alternate methods of payment which would not be a financial hardship. UNIT 7 - DEVITT STREET - Townsend Drive to Gordon Avenue.
