ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF HANNA AVFNLIE AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH may,, R. FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with W. E. BRITTAIN, INC. for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-wit: L. HANNA AVENUE: From the North East line of Loraine Street to the North Line of N.W. 29th Street, known and designated as Unit No. 1, Project No. 097-24000-138. 2. HANNA AVENUE: From the North Line of N.W. 29th Street to the South Line of N.W. 30th Street, known and designated as Unit No. 2, Project No. 097-24000-138. 3. HANNA AVENUE From the North Line of N.W. 30th Street to the South Line of N.W. 31st Street, known and designated as Unit No. 3, Project No. 097-24000-138. 4. N.W. 30th STREET: From the West Line of Hanna Avenue to the West Line of Rosen Avenue, known and designated as Unit No. 4, Project No. 097-24000-138. 5. PRAIRIE AVENUE: From the South Line of Lot 2, Block 31 to the South Line of N.W. 31st Street, known and designated as Unit 5, Project 097-24000-138. 6. PRAIRIE AVENUE: From the North Line of N. WHEREAS, by sundry proceedings heretofore passed by the City Council of the '.ity of Fort Worth, Texas, including Crdinance No. 537 a portion of the cost of said improvements was levied and assessed against the respective properties abutting cn each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 5371 s and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed, IT. The Mayor, be, and he is hereby, directed to issue and execute in the name cf the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: lza. When each of the certifiaet.es has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Contract Awarded: May 3, 1965 (M&C C-498) Work Order Issued: July 13, 1965 Work Order Effective: July 26, 1965 Date of Final Inspection and Approval: July 8, 1966 Working Time Bid: 95 working days Working Time Used: 91 working days Supplemental Information Fourteen of the seventeen units were completed by December 31., 196.5. It was necessary to suspend operations because a 24-inch water main was still under construction in Units 7, 8, and 9, Loving Avenue. On April 8, 1966, Units 7, 8, and 9 were cleared of all utility work and at this time street work was resumed. Loving Avenue was completed and accepted on July 8, 1966. Proiect Cost and Financing Bid Price: $133,341.70 Final Contract Cost: $146,135.25 Partial Payments Previously Made: 9 Amount: $131,043.69 Final Payment Due: $15,091.56 Payment to be made from Project No. 097-24000-138 Deviation from Bid Price: $12,793.55 over-run for the following reasons: 1) Based on soil conditions determined by making test holes during plan preparation, it was estimated that lime stabilization of the subgrade would be neces- sary on about fifty per cent of this project; however, during construction, it was determined that ninety six per cent of the project required lime stabilization. + $ 5,625.20 2) During construction, more utility adjustments were re- quired than originally anticipated. + 5,511.62 3) Variations between quantities estimated in the contract specifications and quantities measured and used at the job site. + 1,656.73 Total Over-Run $12,793.55 OFFICK RECORD CITY SECRETARY FT. DATE REFERENCE SUBJECT: Final Payment, Assessment Paving PAGE NUMBER at 17 Locations on the North Side 8/8/66 FP-360 2 °' —2 - Compliance with Specifications During testing on this project, 70 corings were made with the following results: Exceeds Even With Under Specs But Below Paving Specs Specs Within Tolerance Tolerance Surface 67 1 2 0 Base 58 11 1 0 On the entire project, the average thickness of the base course is 4.61 inches as compared to 4.0 inches specified. The hot-mix asphaltic con- crete surface averaged 7.23 inches as compared to 6.0 inches specified. Tests made during construction of sub-grade, base and pavement show that materials used were in compliance with specifications. Recommendations It is recommended: 1) That a bond fund transfer of $7,690 be approved from Project No. 097-24000-901 to Project No. 097-24000-138 to provide additional funds needed for the project; and 2) That the above project be accepted by adoption of an ordinance and that final payment of $15,091.56 be authorized to W.
