The certificates shall provide substantially that if same shall not be paid promptly upon maturity, then they shall be collectable, with reasonable attorney's fees and costs of collection, if incurred, and shall provide substantially that the amounts evidenced thereby shall be paid to the Assessor and Collector of Taxes of the City of Fort Worth,Texas, who shall issue his receipt therefor, which shall be evidence of such payment on any demand for the same, and the Assessor and Collector of Taxes shall deposit the sums so received by him forth- with with the City Treasurer to be kept and held by him in a separate fund, and when any payment shall be made in the City the Assessor and Collector of Taxes upon such certificate shall, upon presentation to him of the certificate by the holder thereof endorse said payment thereof. If such certificate be assigned then the holder thereof shall be entitled to receive from the City Treasurer the amount paid upon the presentation to him of such certificate so endorsed and credited; and such endorsement and credit shall be the Treasurer's Warrant for making such payment. Such payments by the Treasurer shall be receipted for the holder of such certificate in writing and by surrender thereof when the principal, together with accrued interest and all costs of collection and reasonable attorney's fees, if incurred, have been paid in full. Said certificates shall further recite substantially that the proceedings with reference to making the improvements have been regularly had in compliance with the law,and that all prerequisites to the fixing of the assessment lien against the property described in such certificate and the personal liability of the owners thereof have been performed, and such recitals shall be prima facie evidence of all the matters recited in such certificates, and no further proof thereof shall be required in any court. The fact that such improvements may be omitted on any portion of any of said units adjacent to any premises exempt from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of such assessments upon other premises. X. Full power to make and levy reassessments and to correct mistakes, errors, invalidities or irregularities, either in the assessments or in the certificates issued in evidence thereof,is,in accordance with the law in force in this City, vested in the City. XI. All assessments levied are a personal liability and charge against the real and true owners of the premises described, notwithstanding such owners may not be named,or may be incorrectly named. XII. Pro- cedures concerning owner participation in the cost of construction, including methods and policies of determining assessments, construction standards, and methods of pay- ment were explained to twenty-one persons in attendance. SECTION 1 of UNIT IV - EIGHTH AVENUE - From W. Richmond to Magnolia Mr. Carl G. Anderson, 1813 Eighth Avenue, husband of Mabel Davis Anderson, owner of Lots 7 and 8, Block 11, Fairmount Addition, asked why the portion of Eighth Avenue abutting his property was being widened to 60 feet while another portion of the street was being widened to only 48 feet. It was explained that traffic circulation and available right-of-way determined the roadway width in this specific area. Mr. Ander- son also inquired about a drainage problem which he thought might have been caused by the recent improvement of Eighth Avenue from Cantey to Richmond. The drainage prob- lem mentioned has been investigated and it was found that the flooding occurred during construction of Eighth Avenue between Cantey and Richmond and that the storm drain facilities had not yet been completed. In the meantime, the storm drainage facili- ties south of Mr. Anderson's property have been completed, thereby greatly reducing possibility of future flooding. Mrs. Gladys Pittinger, 1517 Eighth Avenue, owner of Lot 2, Block 1, Stewart Addition., asked if her driveway opening would be affected by the widening of Eighth Avenue, and whether the existing sidewalk would be removed. Information was furnished that any improvements which had been made to the property prior to the construction project would be left in place or replaced at no cost to the property owner if damaged or if relocation were necessary. Mrs. Ione Sargent, 1616 Mistletoe, owner of Lot 4, Block 1, Stewart Addition, asked how much property was being taken for right-of-way to widen the side of the street abutting her property. It was reported that the curb would be moved back approxi_ mately six feet on the public right-of-way and would not change her property line. Mr. C. V. Snyder, representing Sinclair Refining Company, owner of Lots 1 through 4, Block 10, Fairmount Addition, asked if there would be an adjustment for gutter grade to correct a drainage problem, and also inquired about the method of computing the property owners' share of the cost of the paving. Standard assessment paving poli- cies and procedures were explained and he was advised that the new street and curb and gutter grade would alleviate the existing drainage problem mentioned. SECTION II, UNIT IV - EIGHTH AVENUE - Magnolia to Worth Street No objections to this portion of the project were stated at the Hearing. OFFICIAL RECORD CITY SECRETARY FT. WORTH, IM ' Page 2 of 2 .r •„r UNIT V - EIGHTH AVENUE - Worth to Pennsylvania Mr. Charles 0. RominIzer, Route 2, Box 274, owner of Lots 1 and 2, Block 5, Dissel Tract, asked why it was necessary to remove what appeared to be serviceable curb and gutter. It was explained that the existing six-inch curb and one foot gutter would be removed and a seven inch curb and two foot gutter constructed throughout to provide uniform gutters and curbs. Mrs. Valorie R. Walker, 901 Eighth Avenue, owner of Lot 1, Block 10, Field Welch Addition, inquired whether she would be assessed at residential rates because she occupies the residence on the property which is zoned "D" Apartment. Further dis- cussion revealed that an apartment on the premises is rented for additional income, which would make it necessary to levy assessments in accordance with the zoning. One person attending the hearing asked if owners of abutting property paid the same rates on both sides of the street. It was explained that all property owners within the same section or unit would be assessed at the same rate (taking into consideration zoning), if the prop3sed project is approved by the City Council.
