AN ORDINANCE AMENDING CHAPTER 16 OF THE
FORT WORTH CITY CODE .(1964) AS PREVIOUSLY
AMENDED BY ORDINANCE NO. 5864, WHICH CHAP-
TER REGULATES THE COLLECTION OF GARBAGE
AND THE PAYMENT OF FEES THEREFOR BY IN-
CREASING FEES; MAKING THIS ORDINANCE CU-
MULATIVE OF PRIOR ORDINANCES; REPEALING
ALL ORDINANCES AND PROVISIONS OF THE FORT
WORTH CITY CODE IN CONFLICT HEREWITH; PRO-
VIDING A SEVERABILITY CLAUSE; PROVIDING A
PENALTY; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FORT WORTH, TEXAS:
SECTION 1.
That Section 16-10 of the Fort Worth City Code (1964)
as previously amended by Ordinance No. 5864 is hereby amended,
and, after having been so amended, same shall hereafter read
as follows:
"Sec. 16-10. Charges for refuse removal service
-- Compulsory for single-family
residences and duplexes; optional
for group housing.
"Use of City garbage collection and brush
removal service and payment of the fees set out
below for such service shall be mandatory for
single-family residences, each unit of duplex
apartment buildings, garage apartments and
trailers occupied as dwelling units. The month-
ly fees for garbage collection and brush removal
service shall be as follows:

Trailer-dwellings (mandatory) 1.95
Residential buildings with 3 or 1.95 per unit

SECTION 2.
That Section 16-11 of Chapter 16 of the Fort Worth City Code (1964)
is hereby amended, and, after having been so amended, same shall hereafter
read as follows:
"Sec. 16-11. Same -- Business and Commercial buildings
and premises.
"Charges for refuse collection from houses, buildings
and premises used for commercial business, and other non-
residentail purposes, shall be based on a minimum service
charge for one standard 30-gallon container and an addi-
tional charge for number of additional containers used as
follows:

"For Class A. Class B and Class C Service where
more than ten containers are used by any one customer,
the total monthly charge shall include the minimum
monthly charge plus a charge per container (in excess
of one) computed on the basis of thirteen cents per
container per stop. The computation shall be made on
an annual basis and the monthly charge shall equal the
annual charge divided by twelve and rounded to the
nearest five cents.
"CLASS D. (SPECIAL SERVICE: UNSCHEDULED SERVICES)
"Upon request, the waste disposal division shall
make such special unscheduled collection of refuse
as is requested, and a charge shall be levied for
such service at the rate of twelve dollars per hour,
plus a fixed fee of six dollars for hauling to the
disposal sites, computed as follows:
"Actual time consumed to load truck, computed
from arrival to departure from the property served,
plus a fixed fee of six dollars based upon an aver-
age time of thirty minutes for hauling to the refuse
disposal site.
"CLASS E. (UNCLASSIFIED SERVICE)
In the event the garbage or trash to be col-
lected from any house, building or premises exceeds
that which can be placed in refuse containers, as
defined in section 16-6, the owner, occupant, tenant
or lessee thereof shall be charged proportionately
for the collection, removal and hauling of such
excess at the rate of twelve dollars per hour. The
monthly charge for such service shall be computed
upon the basis of the frequency of service provided
and the amount of time required for loading and
hauling to the refuse disposal site."

Charges for refuse collection from commercial establishments and other
buildings used for non-residential purposes which use 1, 2 and 3 cubic yard
containers, shall be based on the following table:

For multiple containers in excess of four, the rate shall be one-fourth
the rate for four containers times the number of containers.
SECTION 3.
That this ordinance shall repeal every prior ordinance and provision
of the Fort Worth City Code in conflict herewith

but only insofar as the portion of such prior ordinance or
provision shall be in conflict, and as to all other ordinances
or provisions of the Fort Worth City Code not in direct con-
flict herewith, this ordinance shall be and is hereby made
cumulative.
SECTION 4.
That if any section, part of a section or provision of
any section of this ordinance shall be held to be void, in-
effective or unconstitutional by a court of competent juris-
diction, the holding of such section, part of a section or
provision of any section to be void, ineffective or uncon-
stitutional for any cause whatsoever shall in no way affect
the validity of the remaining sections and provisions of this
ordinance, which shall remain in full force and effect. The
City Council would not have passed any sections, parts of
sections or provisions of any section of this ordinance that
were unconstitutional, void or ineffective if it had known
that they were unconstitutional, void or ineffective atthe
time of adopting this ordinance.
SECTION 5.
That the violation of any provision of this ordinance
or of the Fort Worth City Code relating to the disposal of
garbage and the payment of fees therefor shall be deemed an
offense and punishable by a fine not exceeding Two Hundred
Dollars ($200) , and each violation thereof and each day there
is a failure to comply with the terms of this ordinance shall
be and is hereby deemed to be a distinct and separate offense
and punishable as such.

SECTION 6.
That this ordinance shall be in full force and effect
from and after its passage and publication as required by
law.

It is proposed to amend Chapter 16 of the Fort Worth City Code (1964) by adding
service classes "F"3 "G"s "Hits "I".1 "J" and "Kitto it in order to establish
by ordinance the following rate schedules for the containerized collection
service provided by the City:

For multiple containers in excess of four, the rate shall be one-fourth the rate
for four containers times the number of containers.
Factors used to determine the rates include labor and vehicle costs, maintenance
and depreciation of containers, cost of additional service stops, and discount
for multiple containers serviced at one location. Revenue projections based on
these rates indicate that the service will be self-supporting.
Currently, users of containerized service are being charged fees based on volume
equal to 30 gallon cans (i.e. , a one cubic yard container holds the equivalent
of 6.75 thirty gallon cans) plus a one dollar per month charge for the use of
the container. The one dollar container use charge is inadequate to support the
cost of the containerized collection service.
The Irates proposed are, on the average, nine per cent higher than current rates
but thirty-one per cent lower than prevailing rates of the largest private
waste disposal firm operating in the City.
Recommendation
It is recommended that the City Council approve the propcsed containerized refuse
collection fee schedule described above by adopting the attached ordinance.
