HomeMy WebLinkAboutOrdinance 6134 a ORDINANCE NO. f AN ORDINANCE AMENDING ORDINANCE NO. 3011 , BEING AN ORDINANCE TO REGULATE AND TO RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCES, OR OTHER PURPOSES; THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDING; AND OTHER STRUCTURES: THE SIZE OF YARDS AND OTHER OPEN SPACES; OFF-STREET PARKING AND LOADING AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST BY FIXING DEFINITE USES OF THE BUILDINGS HEREINAFTER ERECTED IN SAID DESCRIBED AREAS FROM THE USES AS SHOWN ON THE MAPS CONTAINED IN SAID ORDINANCE NO. 3011; PRE- SCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN $5.00 NOR MORE THAN $200.00 FOR EACH OFFENSE, AND THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Ordinance No, 3011 be amended so that the following described uses in the hereinafter described area be altered, changed and amended as follows to wit: Z-69-108 The real property in Tarrant County, State of Texas, being all that certain tract or parcel of land out of the A. F. Albright Survey, Abstract No. 1849, in the County of Tarrant, State of Texas, more particularly described as follows, to wit: BEGINNING at a concrete monument marked TESCO, in the westerly right-of-way line of U.S.Highway 81, said point being the southeasterly corner of a 112.3 acre tract of land conveyed to Terminal Buildin Corporation of Texas (predecessor in interest to Santa Fe Land Improvement Company by Frank C. Beall et al , by deed dated February 25, 1950 recorded in Volume 2169 at Page 16 et seq., deed records of Tarrant County, Texas; said beginning point being 90.0 feet perpendicular distant westerly from the easterly line of said A. F. Albright Survey; THENCE north 10° 15' west along said westerly right-of-way line of U.S.Highway 81, which is also the easterly line of said 112.3 acre tract, a distance of 1091.2 feet; THENCE south 790 45' west, a distance of 350.0 feet; THENCE north 10. 15' west, a distance of 792.1 feet; THENCE southerly, along a curve to the right having a radius of 420.70 feet, a dis- tance of 122.0 feet; THENCE south 83° 37' 48" east, a distance of 41 .5 feet; THENCE northerly, along a curve to the right having a radius of 379.20 feet, a dis- tance of 110.0 feet; THENCE north 79° 45' east, a distance of 246.0 feet to a point in said westerly right-of-way line of U.S.Highway 81; THENCE northerly along said westerly right-of-way line of U.S.Highway 81, along a curve to the left having a radius of 5669.65 feet, 60 ft. westerly from and concentric with a 1• curve to the left in relocated center line of said U.S.High- way 81, a distance of 399.7 feet to the southeast corner of an 80.0 foot county road as described in quit claim deed from Terminal Building Corporation of Texas to Tarrant County, Texas dated May 22, 1961; THENCE south 790 45' west parallel with and 80.0 feet perpendicular distant souther- ly from the northerly line of said 112.3 acre tract, along the southerly line of said 80.0 foot county road, a distance of 1880.5 feet to a point in the westerly line of said 112.3 acre tract; THENCE south 100 14' east, along the westerly line of said 112.3 acre tract, a distance of 2504.0 feet to the southwest corner of said 112.3 acre tract; THENCE north 790 22' east, along the southerly line of said 112.3 acre tract, a distance of 1900.0 feet to the place of BEGINNING. Containing 101.03 acres of land, more or less. (U.S. 81 North and Longhorn Rd.) From Unzoned to "K" Heavy Industrial SECTION 2. The zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals and the general 4elfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provisions of transportation, water, sewerage, parks and other public require- ments. They have been made after a full and complete public hearing with reasonable considera- tion among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 3. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. Should any section, clause or provision of this ordinance be declared by the court to be in- valid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) nor more than Two Hundred and No/100 Dollars ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6.
