Cv AN ORDINANCE PROVIDING FOR THE CLOSING, VACATING AND ABANDONING OF THE FOLLOWING PUBLIC RIGHTS-OF- WAY AND UTILITY EASEMENTS IN RALPH BUNCHE ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS: BRIERY STREET FROM FITZHUGH STREET SOUTI� TO THE SOUTH LOT LINE OF LOT 1, BLOCK "F"; ANDERSON STREET FROM BRIERY STREET EAST TO CASS STREET; CASS STREET FROM THE NORTH LOT LINES OF LOT 15, BLOCK "E, AND LOT 3, BLOCK "H", SOUTH TO THE SOUTH LOT LINES OF LOT 21., BLOCK "F", AND LOT 7, BLOCK "H"; AND ALL UTILITY EASEMENTS IN BLOCKS "E", "F" AND "H" WITH THE EXCEPTION OF THE UTILITY EASEMENT ALONG THE SOUTH LOT LINES OF LOTS 11 THROUGH 14, BLOCK "E", AND A DRAINAGE EASEMENT ALONG THE WEST LINE OF LOT 12, BLOCK "F"; PROVIDING FOR THE REVERSION OF THE INTEREST OF THE CITY OF FORT WORTH IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described public rights-of-way in Ralph Bunche Addition to the City of Fort Worth, Tarrant County, Texas, be and the same are hereby closed, abandoned and permanently vacated as streets or public thoroughfares of any kind or character whatever: Briery Street from Fitzhugh Street south to the south lot line of Lot 1, Block "F"; Anderson Street from Briery Street east to Cass Street; Cass Street from the north lot lines of Lot 15, Block "E", and Lot 3, Block "H", south to the south lot lines of Lot 11, Block "F", and Lot 7, Block "H". SECTION 2. That all utility easements in Blocks "E", "F" and "H", Ralph Bunche Addition, be amd the same are hereby extinguished, vacated, closed and permanently abandoned as easements for pub- M� lic utilities, save and except that the utility easement along the south lot lines of Lots 11 through 14, Block "E", and the drainage easement along the west line of Lot 12, Block "F", are retained. SECTION 3. That the interest of the City of Fort Worth in the fee to the land in said streets and easements above described is hereby released and shall revert to the adjacent owner of the fee as provided by law. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5. That this ordinance shall take effect and be in full force and effect from and after the date of its passage. City vacate certain public rights-of-way and utility easements in the Ralph Bunche Addition as follows: 1. Briery Street from Fitzhugh Street south; 2. Anderson Street from Briery Street east to Cass Street; 3. Cass Street south from the north lot lines of Lot 15, Block E; and 4. All utility easements in Blocks E, F, and H with the exception of the utility easement along the south lot lines of Lots 11 through Y 14, Block E. 1 Subject rights-of-way, acquired by dedication, are not open on the ground. The Applicant proposes to develop a planned unit duplex project and, if this request is granted, will provide interior circulation via a system of private streets to be designated as emergency and public access easements. City Departments and private utility companies have reviewed this request and have no objections if the Applicant plats the vacated rights-of-way with adjoining property and provides all necessary emergency access , public ac- cess, drainage and utility easements. A satisfactory replat has been sub- mitted. The City Plan Commission has reviewed this request and recommends adoption of an ordinance vacating the public rights-of-way and utility easements as requested. Recommendation It is recommended that an ordinance be adopted vacating subject rights-of-way and utility easements as recommended by the City Plan Commission.
