("Consultant") made and entered into City of Fort Worth City Secretary Contract No. 38003, ("Contract"); and WHEREAS, the Contract involves professional services for the following project: Greenway Park Road and Parking Improvements; and WHEREAS, it has become necessary to amend the Contract to include an increased scope of work and/or revised maximum fee. NOW, THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the contract: 1. Article I, Section A of the Contract is amended to include the additional engineering services specified in a letter dated February 16, 2010, a copy of which is attached hereto and mco Yorated herein. 2. Article II of the Contract is amended to provide for an increase in the maximum fee in the amount of $30,000, which is to be paid to Consultant for all work and services under the Contract, as amended, so that the total fee to be paid by City for all work and services shall not exceed the sum of $88,015. 3. All other provisions of the Contract that are not expressly amended herein shall remain in full force and effect. Executed on this the day of LC , 2010. (NSI) offers additional Professional Engineering Services for this project. These additional services are required for design of Greenway Park Drive in Greenway Park in North Central Fort Worth. The specific services are outlined in Attachment A. NSI proposes to provide these additional services for the lump sum of $30,000.00. All additional services proposed will be performed in accordance with the original contract dated December 4, 2008. This Amendment, consisting of one page, and Attachment A (two pages) represents this entire amendment to the original agreement between the City of Fort Worth and Neel -Schaffer, Inc. If the terms of this Amendment are acceptable, please execute both copies and return one to our office to begin the additional services. TX , Mite � ,, 710, $7.7.222, Fax iY,:70,ffi ATTACHMENT A SCOPE OF SERVICES AMENDMENT 2 The City of Fort Worth desires to make road and parking improvements at Greenway Park. These are illustrated on a Concept Alternative Site Plan Phase H. Approximately 194 paved parking spaces are desired. They are located along both sides of Pharr Street, which has previously been designed, and Greenway Park Drive. About 950' of road improvements will be required on Greenway Park Drive. All parking spaces are 90 degree. The road will be 24' wide and have curb and gutter and the parking spaces will have wheel stops. The construction documents shall include demolition of the existing asphalt road and sidewalks, and accessible parking in accordance with Texas Department of Licensing and Regulation (TDLR) requirements. Based on the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM), a portion of the road and parking improvements are in the floodplain, but a prior City F000dplain permit will be used for this phase. U.S. Army Corps of Engineers 404 permitting is not anticipated since the work is generally rebuilding existing roads. Greenway Park Drive will be relocated slightly and will have tight turns to discourage truck traffic. The existing pavement along the road will be removed and additional parking will be added to provide a total of about 194 parking spaces. Submittals will be required to TDLR and TxDOT. Coordination will be required with both the Transportation and Public Works Department and the Water Department. A Storm Water Pollution Prevention Plan (SWPPP) Notice of Intent (NOI) shall also be prepared and submitted to PACS for execution. PACS will be responsible for TDLR submittal. Survey data will be provided by the City. Land acquisition is not anticipated. Geotechnical design services are not included. The paving section will be the same as the one used on Pharr Street. The tasks included in this amendment are specifically: 1. Attend one coordination meeting to discuss the project constraints 2. Prepare the following construction documents (This assumes the work will be change ordered into an existing construction contract): ➢ SWPPP and erosion control plan ➢ Demolition Plan ➢ Drainage area map ➢ Drainage calculations sheet ➢ Plan and profile sheets at 20 and two scale (two sheets) ➢ Cross section sheets at 20 and two scale (spaced at 50' and requiring one sheet) 2/16/2010 O:\Jobs\7404 -Fort Worth Greenway Park\Admin\Contract\Amendment 2\Attachment A.doc Page 1 of 2 ➢ Standard City detail sheets (paving and drainage) 3. Preliminary opinion of probable construction cost 4. Submit PDF's of 50 percent preliminary plans and specifications with preliminary opinion of probable construction cost to City for review 5. Attend meeting with City to discuss comments 5. Revise plans as appropriate 7. Finalize plans and opinion of probable construction cost 8. Submit PDF's of 90 percent final plans with opinion of probable construction cost to City for review 9. Attend meeting with City to discuss comments 10. Revise plans as appropriate 11. Submit two copies of the plans to TxDOT for coordination of the intersection 12. Provide PDF's of drawings to PACS for printing 13. Attend and document pre -construction meeting 14. Review and approve shop drawings, observe construction procedures and results, and provide plan interpretation for resolving field construction discrepancies or field design deficiencies 15. Make and document a maximum of one periodic site visit; attend final inspection (City prepares punch list): total two site visits during construction The following items, if needed, are not part of the proposal services /fee and will be considered extra work: • Design/topographic surveying or property boundary surveying • Parcel acquisition services (survey, negotiation, appraisals, condemnation, etc.) • Geotechnical investigations • Additional meetings and/or site visits not identified above • Printing • TDLR submittal and fees • Preparing record drawings • Cover sheet • General notes sheet • Specifications and special provisions • Bidding Services (if not change ordered into existing construction contract) 2/16/2010 O:\Jobs\7404 -Fort Worth Greenway Park\P,dmin\Contract\Amendment 2\Attachment A.doc Page 2 of 2 Amendment 2 Fee Schedule Greenway Park Road and Parking Improvements The Engineer shall be paid monthly subject to the following limits: • Preliminary submittal (tasks 1 to 4) — 75% of total fee ($22,500.00) • Final submittal (tasks 5 to 8) — 85% of total fee ($25,500.00) • Bidding (tasks 9 to 12) — 95% of total fee ($28,500.00) • Construction (tasks 13 to 15) — 100% of total fee ($30,000.00) I. Schedule (Calendar Days) The schedule for the above services follows: • Kickoff meeting within one week of notice to proceed • Preliminary submittal within eight weeks of notice to proceed • Final submittal within four weeks of preliminary comments • Bidding documents within two weeks of final comments • Total: 14 weeks, exclusive of PACE review time Page 1 of 1
