HomeMy WebLinkAboutOrdinance 17592-06-2007Ordinance No. 17592-06-2007 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STORM WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $87,632 FROM A STORM WATER UTILITY FUND TRANSFER, FOR THE PURPOSE OF EXECUTING A CONTRACT WITH LOPEZGARCIA GROUP TO DESIGN DRAINAGE IMPROVEMENTS AS PART OF THE EAST ROSEDALE STREET PROJECT (CITY PROJECT NO. 00138); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2006- 2007 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of $87,632 from a Storm Water Utility Fund transfer, for the purpose of executing a contract with LopezGarcia Group to design drainage improvements as part of the East Rosedale Street Project (City Project No. 00138). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer of $87,632 from the Storm Water Operating Fund to the Storm Water Capital Projects Fund; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of $87,632 from available funds; and 3. Authorize the City Manager to execute an engineering agreement with LopezGarcia Group, Inc., to design drainage improvements in accordance with City specifications as part of the East Rosedale Street Project (from IH-35W to US 287) (City Project No. 00138) in the amount of $87,632. DISCUSSION: On November 27, 1990, the City Council approved M&C G-8922 accepting the provisions of the then State Department of Highways and Public Transportation Commission (now the Texas Transportation Commission) Minute Order No. 90823 providing for the reconstruction of East Rosedale Street from IH-35W to US 287 as a six-lane divided arterial. The Texas Department of Transportation (TxDOT) is administering design and construction. LopezGarcia Group (LGG) was selected by TxDOT to perform roadway and drainage design. TxDOT drainage design standards are limited to the 25-year design frequency, but City standards call for design for the 100-year storm frequency protection. In order to meet City standards, staff requested LopezGarcia Group to submit a cost proposal and scope of work to upgrade the design for drainage improvements, which are located near Sycamore Creek Tributary. The upgraded scope of work includes four additional culverts, channel construction, and storm drain and channel improvements. LopezGarcia Group proposes to perform work for a lump sum fee of $87,632. City staff considers this fee to be fair and reasonable for the scope of services proposed. Because the upgrade design will be performed at the request of the City, the City will be responsible for 100 percent of the cost. LopezGarcia Group is in compliance with the City's M/WBE Ordinance by committing to 18 percent M/WBE participation. The City's goal on this project is 18 percent.
