HomeMy WebLinkAboutOrdinance 6425 ORDINANCE NO. oU�� ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF BLACKSTONE DRIVE AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH SRO Asphalt, Inc., Arlington, Texas FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with SRO Asphalt, Inc. , Arlington, Texas for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in -said City, to-wit: UNIT 1, BLACKSTONE DRIVE From Churchill Drive to Isbell Road, known and designated as Unit 1, Project No. 104-24000-198. UNIT 2, TIDWELL DRIVE From Banks Street to Springer Street, known and designated as Unit 2, Project No. 104-24000-198. UNIT 3, QUAIL TRAIL From Shenna Boulevard to Ohio Garden Road, known and designated as Unit 3, Project No. 104-24000-198. UNIT 4, ROBINSON STREET DELETED UNIT 5, ROBINSON STREET DELETED UNIT 6, McCANDLESS STREET From NW. Loraine Street to NW. 32nd Street, known and designated as Unit 6, Project No. 104-24000-198. UNIT 7, 29TH STREET From McCandless Street to Titus Avenue, known and designated as Unit 7, Project No. 104-24000-198. UNIT 8, NW. LORAINE STREET From Titus Avenue to Sherman Avenue, known and designated as Unit 8, Project No. 104- 240001198. WHEREAS, by sundry proceedings heretofore passed by the City Council of the city of Fort Worth, Texas, including Ordinance No. 6259 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 6259 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in the name cf the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: III. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying_ the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the. appropriate Ordinance Records of said City. V. This ordinance shall take effect and be in full force and effect from and after the date of its passage. Contract Awarded: February 9, 1970 Work Order Issued: June 23, 1970 Work Order Effective: July 3, 1970 Date of Final Inspection and Approval: November 10, 1970 Working Time Bid: 145 Working Days Working Time Used: 86 Working Days Project Cost and Financing Original Bid Price: $146,310.75 Change Order No. 1: -$ 34,.188.50 (M&C G-1516, 3/9/70, Delete sidewalks on Unit 1 and all of Units 4 and 5) Change Order No. 2: -$ 1,868.63 (A.R. 1-15, 2.2 12/19/70, temporary deletion of HMAC surface on Unit 3, Quail Trail) Revised Bid Price: $110,2,53.62 Final Contract Cost: $ 97,419.31 Partial Payments Previously Made: 5 Amount: $87,677.38 Final Payment Due: $ 9,741.93 Sufficient funds are available for the final payment to be made from Project Account Number 104-24000-198. Deviation from Bid Price: The final cost of this project is $12,834.31 under the revised bid price. This under-run was caused primarily by the following: 1) The necessity for fewer utility adjustments than anticipated, which resulted in a savings of $2,363.02, and 2) The elimination of a 6 inch metal pipe subdrain, which resulted in a savings of $8,250. The remainder of this cost difference, $2,221.29 is attributed to minor variations between quantities estimated in the contract 'documents and quantities actually measured and used at the job site. DATE REFERENCE SUBJECT: Final Payment - Assessment PAGE NUMBER Paving at Eight Locations on th 2 Of 2 1/18/71 FP-772 Northwest Side Compliance with Specifications During testing on this project 34 corings were made with the following results: Units 1,2,6,7 & 8 (6" HMAC, 6" Stabilized sub-grade) 30 corings Exceeds Even with Below Specs but Below Specs Specs Within Tolerance Tolerance Paving 22 4 4 0 Sub-grade 14 16 0 0 On these units the average thickness of the hot-mix asphaltic concrete paving is 6.26 inches as compared to the 6.00 inches specified, and the average thick- ness of the stabilized sub-grade is 6.10 inches as compared to the 6.00 inches specified. Unit 3, Quail Trail, cannot be completed until after the Water Department has completed installation of a planned sanitary sewer. Therefore, only the binder has been laid. The surface will not be laid until after completion of the sanitary sewer installation. The binder and stabilized sub-grade on Unit 3 were cored and the results were as follows: Unit 3 (43V" HMAC Binder, 6" stabilized sub-grade) 4 corings. Exceeds Even with Below Specs but Below Specs Specs Within Tolerance Tolerance Binder 4 0 0 0 Sub-grade 4 0 0 0 On Unit 3 the average thickness of the hot-mix asphaltic binder is 4.75 inches as compared to the 4.50 inches specified, and the average thickness of the stabilized sub-grade is 6.16 inches as compared to the 6.00 inches specified. Tests made during construction show that materials used were in compliance with specifications. Recommendation It is recommended that the adjacent property owners on Unit 3 not be required to pay their assessment cost until Quail Trail is completed and that the pro- ject described above be accepted by the adoption of an ordinance and that final payment of $9,741.93 be authorized to SRO Asphalt, Inc.
