HomeMy WebLinkAboutOrdinance 6426 ORDINANCE NO. 1� ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF SEMINARY DRIVE AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE CITY OF FORT WORTH, TEXAS; DECLARING THE CONTRACT WITH AUSTIN ROAD COMPANY FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMED; DIRECTING THE ISSUANCE, 19XECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND BY FILING THE COMPLETE ORDINANCE IN APPRO- PRIATE ORDINANCE RECORDS OF SAID CITY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with Austin Read Company for the making and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in .said City, to-wit: SEMINARY DRIVE From Cherokee Trail to McCart Street, (Reconstruction) known and designated as Project No. 104-27000-142. WHEREAS, by sundry proceedings heretofore passed by the City Council of the City of Fort Worth, Texas, including Ordinance No. 6265 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues and public places and against the real and true owners thereof; and, WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 6265 , and WHEREAS, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: I. The improvements on each of the portions of streets, avenues and public places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed. II. The Mayor, be, and he is hereby, directed to issue and execute in -the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance with the proceedings relating to such improvements and assessments. The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereon. The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: TTT. When each of the certifiactes has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract price. IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete ordinance in the appropriate Ordinance Records of said City. APPROVED AS TO FORM AND LEGALITY: 150�1 r ' City Attorney PROJECT NO, 104-27000-142„ RECONSTRUCTION OF SEMINARY DRIVE FROM CHEROKEE TRAIL TO McCART STREET, to be improved with four-inch thick hot-mix asphaltic concrete :pavement on seven- inch thick cement or lime stabilized base, as specified, under which is a seven-inch thick lime stabilized subgrade, with seven=inch high concrete curb and..two-foo$ wide concrete gutter, so that the finished roadway will be sixty feet wide, and by constructing six-inch thick concrete driveways and four or six-foot wide concrete sidewalks where specified. Paving and Reconstruction of Seminary Drive from Chero- kee Trail to McCart Street, Project No. 104-27000-142 Contractor,: Austin Road Company Contract Awarded: March 2, 1970 (M&C C-1682) Work Order Issued: July 16, 1970 Work Order Effective: July 27, 1970 Date of Final Inspection and Approval: December 3, 1970 Working Time Bid: 125 Working Days Working Time Used: 70 Working Days Project Cost and Financing Original Bid Price: $185,124.75 Final Contract Cost: $179,871.15 Partial Payments Previously made: 5 Amount: $160,273.85 Final Payment due: $19,597.30 Sufficient funds are available for the final payment to be made from Project Number 104-27000-142. Deviation from Bid Price: The final cost of this project is $5,253.60 under the original bid price. This cost difference can be attributed to minor vari- ations between quantities estimated .in the contract documents and quantities actually measured and used at the job site. Tests made during construction snow that materi- als used were in compliance with contract specifications. Recommendations It is recommended that the project described above be accepted by the adoption of an ordinance and that final payment of $19,597.30 be authorized to the Austin Road Company.
